Euthanasia

In this thesis, I examined the definition of euthanasia and its different forms, as well as the legal evolution of this term and its constitutional foundations in the Czech Republic. Furthermore, I focused on the legislative treatment of euthanasia in the Czech criminal law, and compared it to the legislative treatment of euthanasia in Australia, Colombia, and England. In every individual state, I tried to capture the most important moments concerning the legal regulation of euthanasia and assisted suicide. In Australia, I focused mainly on the very first legal regulation of euthanasia, in Colombia, progression of an application of the Constitutional Court judgment on active euthanasia and in England, the evolution of relevant case law, usually related to assisted suicide. The most detailed explanation, of course, focuses on the Czech Republic. In my analysis, I used a variety of Czech and foreign legal sources, including modern sources such as video conferencing. By comparing the approaches, I provided a general overview of differentiation of euthanasia and its potential criminal impact. Right to live vs. unnatural termination of life

The aim of this thesis is to clarify the concept of the right to life in the legislative in the Czech Republic and in abroad with a comparison with its unnatural end, while abortion and euthanasia. This work is primarily devoted to law regulation of these institutes, but also covers other aspects such as religion, philosophy and science. It is designed so that each and every chapter is in its introductory section devoted to the formulation of the topic, the historical development in the Czech Republic but also abroad, it introduces the possible procedures and attitudes, it mentions for example and briefly compares similar institutes. Other parts of the diploma deal with legislation whether the right to life, abortion or euthanasia, provides comparison of domestic legislation with internationals. In light of the judgments of the European Court of Human Rights points the views and attitudes on the subject at the international level. The final section is then evaluated core issues especially from the standpoint of law.
Euthanasia and its legislation

The aim of this thesis is the analysis of domestic legislation affecting euthanasia and analysis of such adjustments abroad. The author questions the appropriateness of such adjustments in the Czech Republic. The current legal regulation does not regulate euthanasia in any way, and so the adoption of such regulation is appropriate. Domestic experts criticize this fact for a long time. In the first part the author deals with the most comprehensive definition of the subject of euthanasia and its development abroad and, particularly, in the Czech Republic. Other parts, using the historical-empirical methods, deal with the legal arrangements and their analysis in the Benelux countries, where the euthanasia is legal under certain given conditions. They describe not only the current treatment, but also the path that led to it. In the last section the author assesses the non-legal aspects of euthanasia and outlines two basic directions, which the domestic legislation could take in the future.
Transformation of the Public Discourse on Euthanasia between 2008 and 2020

Klára Žáková, Proměna veřejného diskurzu o eutanázii mezi lety 2008 a 2020 The theoretical part of this work will be an interpretation of used terms and a presentation of arguments for and against euthanasia with the help of research of academic publications and articles. The analytical part of the work will be qualitative research, where I will perform a discursive analysis of the legalization of euthanasia in the Czech Republic. It will focus on the change of approaches during the years 2008-2020, when the draft law on legalization took place and their subsequent nonacceptance. The analysis will focus on the media image of this situation, the actors who enter into this issue and their attitudes. The primary source will be the media archive Newton Media, which will help map the media space on this topic in the Czech Republic.
Medical ethos and assisted suicide: ethical reflection regarding the role of a doctor

This diploma thesis deals with bioethical and medical issues of assisted suicide. Compatibility of assisted suicide and medical ethos is one of the most urgent ethical questions of modern medicine. The centre of the diploma thesis will consist of an ethical reflection of tension between assisted suicide by a doctor on one side and medical ethos, as contained, for example in the Hippocratic Oath, the code of the World Medical Association and other important medical documents, on the other side. In the introduction the diploma thesis describes the distinction between assisted suicide and other forms of active euthanasia, basic information about the legal regulations and essential elements of assisted suicide in individual countries where assisted suicide is legalized. Then, the subject will be systematically reflected based on critical analysis of the medical codes and legal regulations of the countries. Ethical reflection will also be based on the experience and reflection of doctors themselves, as recorded in professional ethical publications from countries where assisted suicide is practiced. The aim of my thesis is to unify the total view of the issue of euthanasia and assisted suicide with an emphasis on the criminal law. I am not trying to concluded whether legalize euthanasia in the Czech legal system or not, I just would like to outline the posibilities of the legal regulation in the Czech Republic in the future, after providing the analysis of the countries where euthanasia has happened legal in the last few years. My thesis is divided into eight chapters. At the beginning I try to give a detailed description of the substance of euthanasia and other related terms as assisted suicide, do not resuscitate and then I state usual forms and divisions of euthanasia. Then I deal with the history of euthanasia in the world because for understanding and clarification it is necessary. The next chapter is already about euthanasia in Czech Republic, where euthanasia has never been legalised but there were some efforts in some forms to do that. In this part I deal with a legal qualification of killing on request and assisted suicide de lege lata and de lege ferenda. Euthanasia and Criminal Law

The thesis deals with legal aspects of euthanasia with special focus on criminal law context. It is divided into four broad chapters. First chapter defines terms that need to be understood perfectly for further work on the topic. Therefore, it deals with the term "euthanasia" and its division into active and passive euthanasia, direct and indirect, requested and unsolicited. There are also mentioned some related institutes such as dysthanasia, palliative and hospice care and assisted suicide. Last but not least, this chapter presents some arguments for and against euthanasia. Second chapter is devoted to legislation in foreign countries where euthanasia (or assisted suicide) has been legalized. Wider context of foreign legislation is important for realizing the consequences that possible legalization of euthanasia in the Czech Republic would bring. It can be clearly seen on the example of individual foreign states what legalization of euthanasia entails, how stringent the conditions that a request for termination of life has to meet are, and ultimately, we can decide whether we tend to endorse the legalization of euthanasia or go in the opposite course. Society's view of euthanasia legalization problems

The diploma thesis is focused on the society's view of the problems of legalization of euthanasia. The thesis is divided into two main parts, the theoretical and the empirical one. The theoretical part consists of the basic terms related to the given problems, further of historical development of euthanasia, countries where euthanasia is legalized, arguments of proponents and opponents of euthanasia and paliative care. The practical part follows after theoretical information and deals with analysis of data gained by a questionnaire research and interpretation of individual findings relating to respondents' general awareness of euthanasia and differences in the view of euthanasia between lay public and professionals. At the end of the thesis, the concrete recommendations in future discussions about euthanasia are proposed on the basis of gained information.
