Proof of qualification in public contracts, in particular with respect to proving qualifications through a subcontractor
Součková, Silvie ; Horáček, Tomáš (advisor) ; Zahradníčková, Marie (referee)
The issue of public procurement is one that is extremely closely followed, particularly due to the redistribution of public resources. The current Czech legal regulations are based on the so- called European Procurement Directives. These Directives also comprise the origin of the provisions regulating proof of qualifications through a third party (a subcontractor). For a reliable interpretation of this provision, a thorough analysis of the European legal regulations, ECJ case law, and decision-making practice in the Czech Republic was therefore necessary. Technical books and articles also proved to be a helpful backup. The analysis indicated that decision-making practice in the Czech Republic is disunited and cannot be relied upon for an interpretation. The key guide was therefore EU- compliant interpretation, as well as patient and detailed analysis of the individual possible issues in respect of proof of qualifying prerequisites through a subcontractor with emphasis on the legislator's intentions and on logic. The result is, then, a relatively safe guide on how to proceed in the case of individual problematic qualifying prerequisites and how to comply reliably with problematic legal provisions.

Women´s Attitudes towards Alternative Birhting
TESAŘOVÁ, Blanka
The bachelor's research work "Women´s Attitudes towards Alternative Birhting" is focusing on the topic of alternative birthing, especially birthing outwith the medical facilities, that are currently quite often discussed issues. Alternative birthing is the matter of historical, legislagive and personal aspect. The objective of the research is to find out more about the women´s attitude towards the alternative birthing and reasons that lead to this choice, or, on the contrary, the reasons that discourage them from it. The historical development of obstetrics and birth assistance in the Czech Republic and abroad is described in the theoretical part as well as gradual transition of childbirths from homes to medical facilities, where the main objective is to secure the accessible medical care and to reduce the risk of birth in injuries for mothers and children. Appropriate attention is also paid to current situation and legislation in the Czech Republic, as the alternative birthing issues are not satisfying in this matter. Contemporary pressure of some experts as well as non-professionals on the freedom of making decisions about the births and place of births is mentioned here. The summary of opinions of supportes and opponents of this possibility is presented . Positives, negatives, complications and health hazards of deliveries, not only outwith the medical facilities, are described briefly. The post of midwifes and their qualifications embodied in legislature is also mentioned. Practical part of the dissertation is the qualitative research of the sample of four women who were asked about their attitude towards the alternative birthing issue through the designed indepth interview. These talks are processed and analysed. The result is the attitude of the presented sample of women towards this issue, which, however, does not respond to neither supporters´or opponents´ view. All the interviewed women appreciate the intimacy of alternative birthing, its course, familiar and informal atmosphere and a certain possibility of motion during the birth itself. On the other hand, they also realize possible complications related to the delivery and they are aware of the fact that if the medical help is late or not possible, there is an enhanced risk for mother and child. From the survey with this presented sample of respondents it can be concluded that all these women would welcome the posibility to deliver at the maternal hospital with the immediate medical care, in case of complications, but they would appreciate the stay with more privacy, comfort, possibility to move and certain freedom to cooperate on the procedures. Some of the women would appreciate delivery with the help of midwife who would be appointed in advance, if the physiological delivery is without problems. That means that there would be only the midwife during the delivery but the doctor would not be present.

Contracompetitive decisions of contracting entities
Vršecký, Radek ; Boháček, Martin (advisor) ; Kotoučová, Jiřina (referee) ; Marek, Karel (referee) ; Krč, Robert (referee)
The thesis deals with typical decisions made by contracting entities which restrict the competition among economic operators. The thesis analyses the typical mistakes which are made by the contract entities in awarding procedures. The causes of mistakes being made by contracting entities can be summarized into three groups. Into the first group belong conscious mistakes. For these mistakes shall be contracting entities` agents held responsible. Into the second group belong mistakes in planning. Mistakes from the third group are made as a consequence of lack of professional skills. None of these mistakes can be prevented just by an amendment to the Act on Public Contracts. Any proposal of an amendment solving the lack of professional skills shall consider also all connected negative effects; mainly additional time demands, financial costs and the risk of underfinanced praxis turning into formalism. Professionally skilled agents are usually more careful when they apply the Act on Public Contracts because they are aware of legal risks. Considering current limited budget resources it should be decided whether to put stress on cooperation with internal or external experts. The author recommends internal experts because external experts do not do their best if they are aware of the fact being not controlled effectively by internal experts. However the current Act on Public Contracts is not perfect, the duties laid by it are enforced successfully. Considering a new amendment also the legal theory shall be taken into account. The author presumes similarity of preventing of breaches against the Act on Public Contracts and of preventing of crimes. The most important factor preventing from criminality is to be aware that the punishment is inescapable, not its rates. The author points out also the opinion of the general theory of law according to which a new act is to be passed only if there is an objective necessary need. It should not to be passed by a fortuity or because of subjective views. There should be also a time space between the amendments. There was an amendment to Act on Public Contracts approved in 2010 and European Union currently prepares amending of awarding directives. The author therefore prefers improving the praxis of awarding in the Czech Republic by granting additional human resources to the Office for the Protection of Competition to passing of another amendment to the Act on Public Contracts. The scope of the Act on Public Contracts is also not convenient for amending a list of contract clauses which are not allowed to be concluded by contracting entities. There are two reasons. Contracting entities are constituted by various groups of subjects and contracts selling their property are outside the scope of the Act on Public Contracts. Contracting entities should use standard awarding procedure to promote competition among economic operators. They should concentrate on exactness of tender conditions. A good prevention to mistakes in awarding procedure is also good planning and skilled human recourses of contracting entities.
