Pola, Jan ; Wintr, Jan (advisor) ; Ondřejek, Pavel (referee)
1 Recodification of private law from the perspective of the quality of legislation Abstract: The key regulation of the recodification of private law is the Civil Code. Legislative work has insisted on it for many years, and as such, it represents a complete, internally interconnected whole. Since its approval in 2012, it has been gradually adopted by the professional and general public alike, yet when we read it, we always find something new in it that we didn't previously notice. This then leads us to various considerations on how to interpret a specific provision, and how to apply it in practice. The Civil Code is a legally precisely written set of laws, yet it contains certain ambiguities, or even inaccuracies. This thesis deals with proposals for amendments to the Civil Code, submitted to the Chamber of Deputies. There were already a total of thirty-one of these, and six of them have been successful so far. For the individual proposals, the second part of the thesis evaluates the reasons for which the changes are proposed, and also whether these changes are generally necessary, whether they are necessary to achieve the intended goal, whether a change in such a fundamental code as the Civil Code is really necessary, whether the change can be assessed as appropriate, i.e. whether its pros outweigh its...

Vodičková, Martina ; Pohl, Tomáš (advisor) ; Macková, Alena (referee)
Discharge - resolving of insolvency of a debtor A discharge is, in addition to bankruptcy order and restructuring, one of the options for resolving of the insolvency or imminent bankruptcy of a debtor in insolvency proceedings. The discharge can be initiated only by proposal from debtor, but only certain person can this proposal write and submit (the lawyer, the notary, the executot, the insolvency administrator or the accredited person). If the debtor proves that his proposal has honest intent, and that he is able to pay at least 30 % of his claims to the creditors, then the court will grant the discharge from debts. The discharge can be done in three ways: the liquidation of the assets, the performance of the payment calendary for up to 5 years or a combination of these two methods. The debtor himself can show his preferred way in the proposal, but the final decision is on unsecured creditors. Only if the creditors do not agree on any of these ways, will the court decide. If the debtor performs his duties for the duration of the discharge, the court will decide on fulfillment of the discharge and exempts the debtor from paying the remaining parts of his claims. In the event of the performance of payment calendary, the debtor may be exempt from paying the remaining parts of his claims, even if he has not...

Dvořáková, Veronika ; Sánchez Fernández, Juan Antonio (advisor) ; Poláková, Dora (referee)
The aim of the present Master`s Degree Thesis is to make an approximation to the Basque theme in the selected works of Pío Baroja. Concretely, it`s close to twenty short stories and the novels of the tetralogy Tierra vasca (Basque country), namely, La casa de Aizgorri, Zalacaín el aventurero, La leyenda de Jaun de Alzate y El mayorazgo de Labraz. First, the San Sebastian writer`s relation with the Basque country is presented, as well as his vision of his fatherland in the history context. Second, the presence of the Basque language - as known as euskera - in the works is described, as in the vocabulary, the onomastic or for example in phrases or in popular songs. Third, we study concrete Basque motives, such as the landscape, the cities and towns, the people, the history or the Basque sorcery and mythology.
Intersexuality in Germany. Scholarly ans Societal Debate around the Law Amendment in 2012-2013
Misařová, Adéla ; Kučera, Rudolf (advisor) ; Emler, David (referee)
Germany was the first country in Europe that took an important step to helping intersex people. Since the 1st of November 2013 the intersex new-born have been enacting an opportunity to withhold information about the gender in its personal documents. Germany is now among the few countries in the world that gave intersexed people the opportunity to stay for a lifetime, if they so desire, without a gender. Intersex people are classified as individuals who are born with ambiguous sex characteristics (such as genitalia, chromosomes and hormones). Therefore they can't fall into either of the male or the female sex category. Amendment to the german Civil Code, which allowed marking gender of intersex children in its personal documents with the letter "X", was preceded by intense debate in the field of professional, political and social. Partial discussions of this topic took place in Germany since the 90s and were carried out thanks to the interest groups of intersex people. The most important stimulus for the amendment to civil code was the opinion of the German Council for Ethics from February 2012. The loudest argument in discussions appeared, pointed in particular to the need to ban dangerous surgeries on intersex children, which caused them health problems in adulthood. Other reason for this...
