Legal Regulation of the Natura 2000 Network in the Czech Republic and the Federal Republic of Germany

The network Natura 2000 represents a system of nature protection areas, which were established to protect and conserve European biodiversity of wild fauna and flora. This master thesis copes with the legal aspects of implementing European directives in relation with the Natura 2000 network into the national legal systems. A comparison was made between two EU-member states, the Czech Republic and the Federal Republic of Germany. The master thesis is divided into 7 chapters including the introduction and the conclusion. In the chapter 1, the subject and aims of the thesis are explained, as well as the brief history of nature conservation. Development of nature conservation in International and European law is introduced in the chapter 2. The chapter 3 focuses on legal basis of Natura 2000 regulations on European law level. Essential parts of the master thesis are the chapters 4, 5 and 6, which describe how the network was established through site designation, how the protection and site management is ensured and what assessment of plans and projects means. The law system of Saxony was chosen as an example to display some partial distinctions between the federal law level and the federal state law level in Germany. The legal regime of practicing tourism and sports in specially protected areas

The diploma thesis deals with legal regime of practicing tourism and sports in specially protected areas of the Czech Republic. Specially protected areas are areas with stricter protection regime of nature on specific accurately assessed flat territory. The thesis is composed of five chapters dealing with mutual relationship between sports and environmental protection, general definition of law of specially protected areas of the Czech Republic with a focus on protection tools and sports and tourism activities. Last two chapters are devoted to the pursuit of climbing in the Protected Landscape Area Jizerské hory and the National Park České Švýcarsko. Use of the Brdy PLA in High-School Science Teaching

Presented work studies the possibilities of recently established protected landscape area (PLA) Brdy for a systematic use in teaching nature and biology related subjects at schools closely neighboring the PLA. The theoretical part of this diploma work makes a resume of basic information regarding the legal status of PLA's and introduces the reader into main facts about the PLA Brdy focusing on its natural aspects and specifics. General methods of education are reviewed briefly, followed by a more detailed discussion about the educational form of field trip and about possibilities how such trips or excursions to the PLA Brdy can be used in the education practice. The key part of this work is a relatively large questionnaire research for teachers, pupils and students of elementary and secondary schools next to Brdy. It establishes a database of their approaches to and existing experiences with field trips generally and excursions into PLA Brdy in particular. Two separate questionnaires have been used: one for teachers (16 questions, 26 respondents) and another one for pupils and students (30 questions, 152 respondents). National parks regulation in the Czech Republic and the Kingdom of Spain

1 Abstract Legal Regime of National Parks in the Czech Republic and the Kingdom of Spain National parks as traditional instruments of in situ nature protection, which ensure the protection of the most valuable natural values of the state, have long been a socially debated topic that deserves repeated attention. The fact that this is a current and fundamental issue is proved by the fact that both legal regulations examined in this thesis have undergone extensive changes. The Czech regulation of national parks was amended completely in 2017 and the Kingdom of Spain adopted a new law on national parks in 2014, also in response to a long-standing dispute between the autonomous regions and the central government over jurisdiction over specially protected areas. The aim of this work is to present and analyze the basic legal concept of national parks in the Kingdom of Spain and the Czech Republic, sources of legislation, tools used for nature protection, their anchoring in legislation and institutions related to the administration of national parks. Molluscs of Boulder Sites in Křivoklátsko PLA and Their Use in Education

The work deals with molluscs as specific inhabitants of boulder sites in southern part of Křivoklátsko PLA. It discusses related questions and information sources connected with nature protection. The thesis describes molluscs as generally lesser known, but diverse group of animals with variety of ecological requirements. It shows the results of malacozoological site research performed using collection of leaf litter samples and compares them to previous works. It also examines how the topic could be incorporated in education. The work emphasizes the ecology of molluscs, whose knowledge can facilitate contextual thinking about various organisms and also is not confined to a narrow scope of biology. Management of native and alien plants in garden monuments

The work covers garden monuments in context of spontaneous nature and the occurrence of non-native plant species. We present the management approaches for selected groups of invasive species. The text was written in the context of fields other than monument care and ecology and nature conservatioin. We offer not a simplified methodological guide with a prepared solution of standard situations. We prefer to formulate the text at a greater distance and show the problems themselves, we offer a way to think about them. The approaches are accompanied with examples. In the text, we show local solutions using case studies.

National parks legislation of Czech Republic, Slovakia and USA Abstract The thesis offers a look at the legal regulation of national parks in the Czech Republic, Slovakia and the USA. The diploma thesis points out the legal instruments used for nature protection, especially in the Czech Republic and Slovakia. It gives a picture of common as well as different ways, which were often inspired by each other in the creation of means of nature protection. The work is also focused on amendments to nature protection legislation and their gradual development over time. The content of the work is processed by a descriptive method combining legal regulations of different states. Formally divided into ten chapters. The first chapter offers a historical excursion into the development of nature protection with the first introduction of unregulated efforts by individuals or smaller groups to create specially protected areas. The second and third chapters focus on the presentation of the IUCN international classification, nature conservation management or the presentation of international and EU nature conservation institutions. Global Climate Change - Water Springs and Landscape Memory

The subject of this master thesis is the tradition of creating human - made water springs and caring for them in the research area of protected landscape areas Kysuce (in Slovakia) and Beskydy (in Czech Republic). Both areas are characterized by the occurrence of numerous natural springs of water. People from both places have been enhancing surroundings of these springs for a long time. The creation and care of these objects have become over time a form of tradition, coupled with respect for water and nature as a whole. The aim of the thesis is to identify the shift in this tradition and what it signalizes to people. It is also about bringing the context of changes in traditions with global climate change and with changes in the human relationship and management of landscape. In order to analyze this problem, the methods characteristic for the qualitative type of research were used, such as interviews and observation, which were subsequently evaluated by means of a framework analysis. The work is a kind of microetnographic study that deals with a close group of people who are carying for such water springs in mentioned research areas. Balancing Public Interests in Nature Protection

Balancing Public Interests in Nature Protection Abstract This thesis focuses on the broader scope and the implications of balancing of public interests in nature protection. Czech Nature and Landscape Protection Act (Act No. 114/1992 Coll.) often requires the existence of an overriding public interest in order to allow interference with protected environmental interests. Furthermore, it implements requirements of the Birds Directive and the Habitats Directive, which introduced the concept of IROPI in protection of habitats and particular derogatory regimes from the protection of wild birds and endangered species. The traditional Czech nature conservation system has not been consumed or displaced by the requirements of EU rules. Both systems employ a slightly different approach to territorial protection, but the derogations in general rely on the same set of conditions including the concept of public interest, which needs to be interpreted in each individual case. The core of the thesis lies in the analysis of the case law of the Czech courts and the Court of Justice of the European Union, in particular with an emphasis on common requirements for the identification and balancing of public interests in protection of nature.
