Pola, Jan ; Wintr, Jan (advisor) ; Ondřejek, Pavel (referee)
1 Recodification of private law from the perspective of the quality of legislation Abstract: The key regulation of the recodification of private law is the Civil Code. Legislative work has insisted on it for many years, and as such, it represents a complete, internally interconnected whole. Since its approval in 2012, it has been gradually adopted by the professional and general public alike, yet when we read it, we always find something new in it that we didn't previously notice. This then leads us to various considerations on how to interpret a specific provision, and how to apply it in practice. The Civil Code is a legally precisely written set of laws, yet it contains certain ambiguities, or even inaccuracies. This thesis deals with proposals for amendments to the Civil Code, submitted to the Chamber of Deputies. There were already a total of thirty-one of these, and six of them have been successful so far. For the individual proposals, the second part of the thesis evaluates the reasons for which the changes are proposed, and also whether these changes are generally necessary, whether they are necessary to achieve the intended goal, whether a change in such a fundamental code as the Civil Code is really necessary, whether the change can be assessed as appropriate, i.e. whether its pros outweigh its...

Baček, Richard ; Staša, Josef (advisor) ; Rajchl, Jiří (referee)
1 Free Access to Information and Public Procurement, Abstract and Keywords Abstract The aim of this thesis is to analyse free access to information of public administration in relation to public contracts, especially in regards with the issue of trade secrets protection in contracts concluded as result of public procurement versus the right to information from public authorities. The thesis focuses on several key aspects of this relationship, the interpretation of which is currently problematic. The thesis examines whether freedom of information legislation applies to all types of contracting authorities, procurements and procurement procedures; whether mandatory disclosures also relate to information on public procurement of the authorities concerned; and whether there may be information provided on request in public procurement. It also focuses on manifestations of restrictions of the right to information in public procurements and manifestations of the right to information in protection of trade secret contained in contracts concluded in public tenders. The thesis defines basic terms of the surveyed area, i.e. the terms "information", "free access", "contracting authority" and "public procurement". It also discusses the freedom of access to information in the context of public administration, reporting...

This rigorous thesis deals with the current legal regulation of renting an apartment, especially with the emphasis on evaluating the position of tenant representing the "weaker" part. The second chapter, following the first one, deals with regulation of rent, which is a current topic today. The third chapter is devoted to legal certainty, which has undergone certain changes since the legal force of Act No. 89/2019 Coll., The Civil Code. The fourth chapter introduces some of the possibilities of security institutes and also points out the possible ways of securing the landlord in case the tenant breaks its obligations. In the fifth chapter, the selected rights and rental obligations are mentioned. Kapounková, Barbara ; Boháč, Radim (advisor) ; Vybíral, Roman (referee)
Aspects of consumer's credit in financial law Abstract This rigorous thesis deals with consumer credit and current issues which are being discussed in the area. The latter mainly include efforts for further restriction of payments related to consumer (debtor) in default and respective claims of consumer credit providers (creditors). Another debated matter is the opinion of the Czech National Bank from 7th March, 2019, which refers to the nature of effectively spent expenses which a provider may demand from a consumer in connection to an early repayment of a consumer housing credit. Apart from the obligatory introduction and conclusion, this thesis consists of 3 parts. The first part is mainly theoretical. It deals with the categorization of credit within the system of financial law, the interpretation of terminology, the division of credits and a brief evolution of consumer credit with a special focus on the limitation of a "price of a credit" in question. The above is followed by an assessment of Act No. 257/2016 Coll., on Consumer Credit, from the perspective of its financial law aspects. The second part of the thesis concerns payments related to a consumer in default, contractual and legal interests on late payments and the evolution of a possibility to conclude on these interests in a consumer credit...
