The bachelor thesis is dealing with equal treatment in work performance from the point of view of Czech antidiscrimination law n. 198/2009 Sb. This work includes explanation of terms concerning discrimination. For instance, types of discrimination, acceptable forms of discrimination, development of legal legislation in the field of protection of equal treatment of employees and job applicants. The thesis includes protective measures against discrimination and models of discrimination in the labour market as well. All terms relate to labour market. In practical part, based on interview with the company, the position of employees in specific company is analysed from the point of view od discrimination. The was company decides among potential job applicants. The conclusion is devoted to recommendations.

1 Equal treatment and non-discrimination in employment relations Abstract The thesis deals with the principle of equal treatment and non-discrimination in employment relations. The aim of the author is to introduce the basic concepts related to the issue under the thesis, to present the overview of related legislation, to mention sine key case law, to introduce other projects to promote equal treatment and ban discrimination and to evaluate the current legislation as well as recent changes and expected future developments. The introductory part defines basic concepts such as equality, discrimination (including its forms) and positive action. In the following sections, the legislation in international law and in European Union law is presented, including a closer look at some of the case law that can be identified as very important and that has contributed to the interpretation of the legal rules or to legislative changes. Then the regulation of the issue in the legal system of the Czech Republic is presented, from the constitutional foundations through the most important laws, including the Anti- Discrimination Act and the Labour Code, to other laws that relates to the issue. In my thesis I concentrate on the topic of the equal treatment and the prohibition of discrimination. The reason why I have chosen this subject matter is for its topicality and constantly increasing significance. The equal treatment, as well as the prohibition of discrimination, has to be respected in labour relations to create respectable conditions for employees and equal opportunities for job applicants. In practice, these principles support also better productivity in a workplace, because the work environment, where the law is maintained, is the healthy and prosperous one. However, the reality is different and these principles are not always enforced. That is the reason why discrimination or unequal treatment still exist today and it is not phenomenon, which would be typical only for relations between employers and employees or job applicants. Therefore, the international, European and interstate legislation is evolving constantly in this area and it is changing in an effort to reach more efficient application in practice. Resumé Equal treatment and non-discrimination are rules that are essential in international law, European law and national law. They are regulated in many international documents, in terms of European law, especially, in the regulations and directives. Czech Republic, as one of the member States of the European Union is obliged to ensure compliance of national law with European law. It was therefore necessary in order to ensure compliance with requirements of the EC / EU in the field of equal treatment and non-discrimination of employees that are regulated in anti-discrimination directives with our national law. This happened by adoption of Act No. 198/2009 Coll., Anti-Discrimination Act, which as a general law governing these principles. In my works I deal with treatment of these principles in the documents of international law and international organizations active in this area in the primary and secondary law of the EC/EU and also the current modification in our legal system. Resume v Aj The purpose of my thesis is to analyse the issue of gender discrimination in labor relations and its prohibition, enumerate the ways of legislation and compare legislation with the actual situation in the society. The thesis is composed of two parts divided into nine chapters, each of them dealing with diferent aspects of the issue in question. The first part is a sort of general parts, including introduction, historical development and sources of law. The second part, which could also be called special parts, then contains individual aspects of the right to equal treatment, demonstrated in specific cases, particularly judgments of the European Court of Justice. The first and second chapter deal with the history and development of anti- discrimination issues and define the basic concepts. The third and fourth chapter lists and describes the regulation of sex discrimination in international legal documents and documents of the European Union. The legal aspects of human rights in the court proceedings Abstract In the introductory part, this rigorous thesis deals with some legal aspects of human rights and fundamental freedoms in national, Community and international law, substantive and procedural institutes of their protection, including special cases of collision with international humanitarian law in armed conflicts. In the next part, the rigorous thesis deals with discriminatory legal norms and their application in administrative and judicial proceedings, including legal remedies under national law. In the final part, the rigorous thesis deals with the decision-making activities of the obliged entities in providing information under the Act on Free Access to Information, including the legal means of the judicial protection against illegal administrative acts of the competent administrative authorities. The aim of this thesis is to give a comprehensive informational overview on this topic and showcase its projection into legal documents and decision-making practice. The text itself is divided into six chapters, which precede the introduction and conclude the conclusion. The first chapter deals with the key terms such as equality, equal treatment, discrimination and other related concepts. It also contains classification of these terms and their definition. The second chapter focuses on the projection of the equal treatment and non- discrimination principles at the international level. Age Discrimination in Labour Law Abstract The topic of this thesis is discrimination on the grounds of age in labour law. Age as grounds for discrimination is very specific, because belonging to a certain age group changes as a person ages. Making some distinction on the basis of age is also still seen as acceptable in society. Stereotypes and negative bias connected to certain age groups are still prevalent and the work environment is one of the places where these negative attitudes can manifest themselves in the form of discriminatory action. The main aim of this thesis is to provide an overview of the current legal framework which deals with the prohibition of age discrimination in labour law on the international, European and national level and afterwords to systematically analyze the relevant case law of the Court of Justice of the European Union. Applying the prohibition of discrimination in employment relations. Abstract This thesis is about discrimination in employment relations. The objective of the text is to concentrate on applying the prohibition of discrimination in fields, where disparate treatment is most common, on the legal means of protection against employment discrimination and on the activities of public institutions, which have been entrusted with supervision over compliance with the principle of equal treatment. The thesis is divided into introduction, five separate sections, which are further divided into chapters, and conclusion. The first two sections are rather theoretical, containing definitions of basic terms, important for overall understanding of the thesis (such as equality, discrimination, harassment and others) and introduction of the EU and Czech Republic anti- discrimination law in employment relations. The aim of my thesis entitled Equal treatment and prohibited discrimination against employees is to provide a complete view of international, European and Czech legislation on this topic and inform about how to protect oneself against discrimination. The thesis is divided into four chapters. The first chapter is general. It deals with basic concepts relevant to this area, such as equality, equal treatment, discrimination and its types and others. The second chapter focuses on the most important international treaties regulating equal treatment and discrimination in labour-management relations. It has three parts and each part consists of conventions adopted by one international organization - The United Nations, International Labour Organization and Council of Europe. The third chapter concentrates on the legislation of European Union, both primary and secondary legislation and also deals with judgements of European Court of Justice. The fourth chapter is concentrated on Czech legislation which deals with the principles of equal treatment and prohibition of discrimination of employees, at first place on Anti - discrimination Act. This chapter also treats with various means of protection available to victims of discrimination.
