Bankruptcy of an entrepreneur and methods of its solution

In this Bachelor Thesis I firstly defined the applicable legislation on the subject of bankruptcy of an entrepreneur and methods of its solution. In the chapter Analysis of the examined issue, introduced theoretically possible methods of solution of a bankruptcy, therefore Discharge of debts, Bankruptcy and Reorganization. Despite the fact that other methods of solution of bankruptcy exist, I respect the limited scope of this Bachelor Thesis and devoted it primarily to the analysis of methods of solution of bankruptcy in insolvency proceeding. Further I introduced genuine cases of methods of a solution of a bankruptcy acquired from study of court cases of bankruptcy and its effectiveness. Further I dealt with the statistics of the occurrence of the bankruptcy in the above mentioned period I determined that the number of the declared bankruptcies increased each year of the examined period. In the last part of the chapter Analysis of the examined issue I followed up the most common causes of a bankruptcy and appropriate means of its prevention based on the results of a questionnaire survey. In the chapter Summary of the result of the research I evaluated the applicable legislation of the subject of bankruptcy as insufficient because of the low rate of satisfaction of creditors in the insolvency proceeding. In this chapter I also proposed means for increasing the rate of satisfaction of creditors in the insolvency proceeding. After that I summarized the results of the research of the main causes of the bankruptcy, methods of its solution and development of the occurrence of the bankruptcy. In the conclusion of the mentioned chapter and the whole thesis I introduced the appropriate means of prevention of a bankruptcy.
Trade unions

The work deals with different functions for Workers and the success of trade unions in enterprises. The first part deals with the characteristics of the market, the definition of trade unions, the history of the trade union movement, the position of trade unions in the Czech Republic. The second part will focus on the position of trade unions in a selected company and subsequent draft resolution. The aim this diploma thesis is to identify the activities of trade unions. Role of Trade Unions in the present. Activities of trade unions to apply economic theory and bring a real trade union influence on economic entity in the Czech Republic. In selected enterprises will be made on the basis of the survey, which will be an evaluation of the success of the trade union in the company. Furthermore, a comparison is made with successful enterprise trade unions and enterprises with trade union organizations nonfunctional.
Legally economical aspects of marriage

Nowadays only approximately a half of marriages in the Czech Republic succeed. The society is faced with about a 50 per cent divorce rate. The number of marriages is reducing and on the other hand, the number of cohabitation is increasing. The aforementioned issues show the declining institution of marriage. A marriage is a topic that concerns, to a certain extent, every member of a society and so it should be given more attention. Therefore, the thesis focuses on this topic, specifically on legal and economic aspects of a marriage. The objective of the thesis is to evaluate whether legal and economic aspects impact a decision of couples to marry. To obtain information used in the preparation of the thesis, specialist literature and Internet sources were analysed. The research is based on methods of comparison and surveys. The main conclusion of the thesis is that the law and economics do not impact a decision of couples to marry. It can be also stated that it is good that these aspects do not affect couples who want to marry; feelings continue to be the decisive factor. On the other hand, there is a large percentage of couples just living together. Therefore, the main authorities of the Czech Republic should consider whether to take certain legislative steps to support the institution of marriage.

Po stručném historickém exkurzu vývoje práva na odpověď se studie věnuje obecným teoretickým otázkám. Zmiňuje se o jednotlivých koncepcích tohoto práva, které se v jednotlivých právních úpravách vyskytují a vyjadřuje se i k jeho vztahu k ochraně, kterou nabízí občanské právo. Pojednává i o úpravě, která byla doporučena pro členské státy Rady Evropy. Těžiště studie však spočívá v popisu jednotlivých právních úprav institutu práva na odpověď ve vybraných evropských státech. Struktura textu popisu jednotlivých úprav sleduje toto schéma: po vymezení pramenů práva je pozornost věnována obsahu samotného institutu a tomu, kdo je oprávněnou osobou. Dále je vymezen způsob, jakým se reaguje na žádost oprávněné osoby domáhající se svého práva, tzn. uveřejnění či odmítnutí odpovědi, a též je pojednáno o možnosti právní ochrany oprávněné osoby pro případ, že dojde k porušení práva. Intellectual Property Rights in the Theatre Practice Context

This master thesis is focused on the intellectual property rights in the context of theatre practice. Its aim is to analyse the area of intellectual property rights and to show that intellectual property rights do not end with copyright, but it is just a beginning. The results are answers to following research questions: What are intellectual property rights and what does this term include? How are intellectual property rights applicable within the theatre practice? What are the basic types of protection when these rights are violated in the theatre / by theatre? The diploma thesis is composed of three main chapters, in which I progressively try to find answers to the above mentioned research questions. The first chapter is focused on the intellectual property rights and on their definition, including their terminological distinction from similar definitions, and analysis of that area. The second chapter introduces selected areas of intellectual property rights that are relevant for the theatre practice, and these selected areas are illustrated by examples. The third and last chapter outlines some of the basic mechanisms in the protection of intellectual property rights. The conclusion summarizes the findings and on their basis it tries to answer the research questions on their basis.

In last chapter is presented financial accessibility and some specifications in realization of e-commerce.

To calculation methodology of baseless enrichment

The issue of determining the amount of unjust enrichment in the construction lies in the fact that there is no legislation or other methodological tool that would assist for example legal experts in building above unjust enrichment. Through the analysis of individual problems, their evaluation and subsequent proposal for a potential solution procedure, to create a methodology that would facilitate the work. Within this article will explain the problem situation, are sampled possible division of examples at unjust enrichment in the construction and subsequent application of the problem in the example.
