Environmental protection instruments in Czech law

This diploma thesis deals with the instruments of environmental protection which are used in the Czech legal system. Thanks to these instruments, the state and other institutions try to assign the most effective environmental protection possible. We can divide these instruments into two main categories, direct and indirect. The direct instruments are divided into conceptual, administrative - law, vindicatory and voluntary. The indirect are represented by the economic instruments, which can be divided into instruments of positive and negative stimulation. The thesis also contains specification of the particular basic principles of the environmental protection and the concretization of the institutions responsible for the protection. Each chapter also contains a demonstration of how each particular group of instruments can be practically applied in the nature and landscape protection.
Agrioenvironmental programms, landscape and nature friendly practices

Agriculture is an important economic phenomenon. Its function, however, today not only in food production but also in the creation and protection of the countryside. It is one of the most important factors affecting biodiversity. In today's agricultural landscape in particular, suffer a small number of habitats for wild fauna and flora. New opportunities for promoting farming friendly nature brings agri-environmental programs, a set of titles contributing to maintaining a harmonious and colorful mosaic environment. Already his name combine agricultural and environmental approach. Gradually become an important financial instrument for the protection, maintenance and active creation of a nature and landscape. Farmers are allocated subsidies for friendly farming, which protects nature and the landscape beyond the normal agricultural practice. This thesis aims to summarize the general knowledge on agri- environmental programs and determine how they impact on nature and landscape. I will try to identify problem areas in the CR and provide an overview of the implementation of programs abroad.
Overnight Sleeping in the Large Landscape Protected Areas: The Relation Between Conservationist and Bivouacking Subject

This thesis deals with the conflict of nature and the landscape protection with recreational use of nature. This conflict is examined in relation to "conservationist subject" and "bivouacking subject" in the context of ecogovernmentality, i.e. the shift of nature to the government sphere. The aim of this thesis is to introduce more of cosmology of nature protection, besides the dominant one - conservational, and to understand their relation. The thesis is divided into two parts - a theoretical part and an empirical part. The theoretical part is devoted to the theory of subjectivity and the concept of ecogovernmentality in the context of chosen ethnographic studies. The empirical part is dedicated to ethnographic research of bivouacking subjects. The results of the research are based on the comparison of data acquired from the ethnographic research with abstracted figures of "conservationist subject" - as defined by visitor rules of the protected areas and the law of nature and landscape protection and "bivouacking subject" - made by stays in nature or scout education. Legal regulation of nature and landscape protection in relation to location of roads Abstract: The relationship between environmental protection and road construction often causes conflicts in society. This dissertation contributes to the discussion by focusing on the analysis of the legal regulation relating to nature and landscape protection in the processes of planning and location of new roads in the Czech Republic. This issue has not yet been comprehensively addressed. It, however, includes the following important questions: How is the route of a planned road lo- cated according to Czech law? How are nature and landscape protection requirements integrated into the location process? How is the issue of landscape fragmentation addressed in the process? What implications may have the current changes of the applicable law? The objective of the dissertation is to create a foundation for a formulation of recommendations aimed at optimiza- tion of the legal framework of nature and landscape protection in the relevant processes in order to ensure the most effective protection of this important public interest even if it has been de- cided to carry out the construction. The restrictions of the ownership of real property for the purpose of nature and landscape protection Abstract This diploma thesis focuses on restrictions of the ownership of real property for the purpose of nature and landscape protection, which are regulated in Act No. 114/1992 Coll., On nature and landscape protection. The thesis is divided into two parts. The first part focuses on the general bases of the legal regulation of the restriction of the ownership of real property due to nature and landscape protection and contains four chapters. The first chapter defines essential legal institutes. The second chapter contains sources of regulation at international, European and national level. The third chapter discusses generally the conflict of property right with the right to a favourable environment. The fourth chapter deals with individual ways of limiting the property right. Illegal expansion of forested land estates illustrated by the example of thep rotected landscape area Žďárské Vrchy

The thesis objective is to highlight the recent enlargement of the forested land area within the PLA Žďárské vrchy and to point out the nature conservation risks stemming from illegal afforestation, in particular. The work includes a quantification study on the natural biotope loss due to illegal afforestation within the PLA since 2001, pricing the incurred loss as ecological damage. Moreover, it adumbrates and considers the efficiency of specific preventive, corrective, compensatory and repressive measures to minimize negative impacts on the subjects of protection, which are available to the government authorities. The thesis also includes literary research focused on the biological and legal aspects of afforestation with an emphasis on the specifics of the PLA Žďárské vrchy.
Ochrana historických krajinných struktur v plánech rozvoje území

The thesis works with a theme of historical landscape structures with a focus on their identification, taxonomy and protection. First part deals with theoretical base, its forms, ways of identification, its bonds with a cultural landscape and temporary valid laws dealing with its protection either from the view of the nature and landscape protection or heritage conservation, in general. In the next part we see the results of the research of the old maps, literature and terrain research of the area of interest, which is placed around the town of Rosice. The outcome of that is the cataloging of the local historical landscape structures. Then the planing documentation of the town was studied with the focus on eventual threats to the found historical structures. The main outcome of the thesis is a concept of the areal study with the optimal attitude to the conservation of the found structures and their renewal. Meanwhile the concept deals with a supplementation of the vegetal elements and of the landscape context and also accents the sustainable developement.
Mapování významných krajinných prvků na území ORP Kyjov

The diploma thesis deals with registered significant landscape elements in ORP Kyjov. The literary research is focused on the nature conservation and landscape protection in the Czech Republic, which is subsequently compared with foreign countries. An integral part is the presentation of significant landscape element as a general tool for nature and landscape protection. The theoretical part also marginally deals with environmental education in nature conservation and landscape protection. Then the characteristics of the area follows, which focuses mainly on natural conditions and landscape protection. The main task is to evaluate the current state of significant landscape elements in the area. In order to achieve this goal, a field survey was carried out. The results are summarized by the catalogue of significant landscape elements, supplemented by photographs of the landscape. In addition to the care for significant landscape elements, an analysis of their funding in recent years was carried out. In the practical part several maps were created in ArcGIS. In addition, a questionnaire survey on citizens' awareness of significant landscape elements took place. Finally, the options to raise citizens' awareness of this protection institution were determined.
Conceptual tools of spatial planning and its specifics in specially protected areas in Šumava

Conceptual tools of spatial planning and its specifics in specially protected areas in Šumava The thesis concerns with the relation between nature and landscape protection and spatial planning in Šumava. In Šumava we find Czech biggest national park and the whole area is protected with some other territorial protection tools of landscape and nature. Simultaneously we find in Šumava a large number of villages some of them located in the most strictly protected areas. In 2017 an amendment to the act no. 114/1992 Coll., on nature and landscape protection, was approved. The thesis was created at the turn of 2019 and 2020 when some territorial protection tools, such as quiet zones in national park, national park management plans and national parks zoning systems were redefined based on the 2017 amendment. This amendment has changed significantly the protection tools of landscape and nature and strengthen its role in the national parks. The mayors of municipalities were outright against the amendment and argued that as a result of this amendment the development of the villages would be limited. Binding opinions as an instrument of the natural and landscape protection

This thesis focuses on the binding opinion and defines its key role in nature and landscape protection. From the author's viewpoint construction activity is an activity with the greatest impact on nature and landscape and the submitted work focuses, among other things, on the evidence that the purpose of issuing binding opinions is the regulation of construction. The thesis consists of introduction, conclusion and five chapters divided into subchapters according to logical and well-arranged structure. The first chapter discusses the role of the body concerned in the protection of the public interest, which is the protection of nature and landscape. The second chapter is structured into several subchapters and is devoted to the description of the binding opinion. The author analyzed its definition features, its legal nature and its content requirements. The last part of this chapter is devoted to the process of issuing binding opinions. Furthermore, the author focused on the review mechanism of binding opinions, namely its legislation in the Code of Administrative Procedure, the Code of Administrative Justice, including a deviation from the general regime laid down by the Building Act.
