Omezení práv vlastníka nemovitosti z důvodu ochrany přírody a krajiny Abstrakt Tato diplomová práce se zaměřuje na omezení práv vlastníka nemovitosti z důvodu ochrany přírody a krajiny, která jsou upravena v zákoně č. 114/1992 Sb., o ochraně přírody a krajiny. Diplomová práce je členěná do dvou částí. První část je zaměřena na obecná východiska právní úpravy omezení vlastnického práva k nemovitosti z důvodu ochrany přírody a krajiny a obsahuje čtyři kapitoly. První kapitola vymezuje podstatné právní instituty. Druhá kapitola obsahuje prameny právní úpravy na mezinárodní, evropské i vnitrostátní úrovni. Třetí kapitola pojednává obecně o střetu vlastnického práva s právem na příznivé životní prostředí. Čtvrtá kapitola se zabývá jednotlivými způsoby omezení vlastnického práva. Druhá část rozebírá konkrétní omezení vlastnického práva k nemovitosti a je rovněž rozdělena do čtyř kapitol. Jedná se o stěžejní část této diplomové práce. První kapitola této části se věnuje modifikaci předmětu vlastnického práva z důvodu ochrany přírody a krajiny. Druhá kapitola pojednává o modifikaci vlastnického práva z hlediska omezení dispozice. Třetí kapitola dělí jednotlivá omezení vlastnického práva podle druhu právního chování. Čtvrtá kapitola se zabývá náhradami za omezení vlastnického práva z důvodu ochrany přírody a... The restrictions of the ownership of real property for the purpose of nature and landscape protection Abstract This diploma thesis focuses on restrictions of the ownership of real property for the purpose of nature and landscape protection, which are regulated in Act No. 114/1992 Coll., On nature and landscape protection. The thesis is divided into two parts. The first part focuses on the general bases of the legal regulation of the restriction of the ownership of real property due to nature and landscape protection and contains four chapters. The first chapter defines essential legal institutes. The second chapter contains sources of regulation at international, European and national level. The third chapter discusses generally the conflict of property right with the right to a favourable environment. The fourth chapter deals with individual ways of limiting the property right. The second part discusses specific restrictions on the right to property and is also divided into four chapters. This is the fundamental part of this thesis. The first chapter of this part is devoted to the modification of the subject of property rights to protect nature and landscape.
