Transparency of proceedings in international arbitration
Poliaková, Lucia ; Balaš, Vladimír (advisor) ; Horáček, Vít (referee)
1 Transparency of proceedings in international arbitration Summary The purpose of my thesis is to explore the concept of transparency in international arbitration. There are different types of international arbitration, characterized by different participants and naturally distinct aspects of procedure. One of these aspects is, according to my opinion, the said transparency of the proceedings. For the purposes of this thesis, I have decided to analyze the position of transparency in two major areas, namely in investment arbitration and in commercial arbitration, respectively. As the concept of transparency in international arbitration is only recently developing, there is much to be resolved. Thus, the state of the affairs with respect to the subject matter of this thesis is ambiguous and misty. The aim of my research is to describe the position of transparency in two basic types of arbitration and identify the reasons for different trends in this respect. The thesis is composed of an Introduction, four basic chapters and a Conclusion. Chapters are divided into subchapters and parts, respectively. The Introduction presents the topic, defines relevant terminology and sets out the aim of my thesis. Chapter One deals with the confidentiality of arbitration which is clearly opposite concept than that of the...

Why do NIKE shoes cost twice as much in Prague than in the USA?
Nečasová, Romana ; Hudík, Marek (advisor) ; Šťastný, Daniel (referee)
I study retail prices of sport goods for a particular multinational producer across European countries and in the USA to examine behaviour of the law of one price. Although average prices across all goods in the sample differ only slightly across most of the countries, I find significant price differences for individual goods for almost each country pair, including a group of the states that are generally considered as relatively integrated. The conducted analysis has not confirmed that these differences are caused primarily by various distribution costs. The computed relative prices across products vary significantly once compared internationally even within a group of similar goods of which distribution costs should be the same. The price variation, which prevails even when costs are excluded, points to the existence of strategic pricing and lagging arbitrage.
Alternative dispute resolutions in trade relations
Štávorská, Zuzana ; Kotoučová, Jiřina (advisor) ; Švarc, Zbyněk (referee)
This thesis discusses the alternative dispute resolution methods in trade relations. The main objective of this thesis is to describe and analyze ADR as a group of methods used to resolute disputes with focus on two main methods - mediation and arbitration. My objective is to describe the main principles of ADR, to compare their main advantages and disadvantages and to analyse the process of resoluting disputes by these methods. Another objective is to evaluate and analyze the development of ADR in the Czech Republic, their legal regulation and its current status. A short part of the thesis concerns about regulation of mediation in the EU and the analysis of implementation of the European Parliament and Council Directive 2008/52/EC dated May 21, 2008 to national legislation. Thesis is divided into five separate chapters. The first, introductory chapter only briefly discusses about dispute and conflict and ways they can be solved. The second chapter already characterizes ADR as a group methods of dispute resolution, its main principles, advantages and disadvantages and finally briefly describes some of the ADR. The third and fourth chapter focuses on the mediation, its principles, advantages, disadvantages, the mediation process and mediator. It monitors the development of mediation in the Czech republic and the current situation in the legal regulation of mediation in the country. The last chapter deals with arbitration. It describes its basic principles, advantages and disadvantages again. The conclusion discusses the czech Arbitration law and the forthcoming amendment.
Economic Analysis of Judicial Activity
Zabranská, Monika ; Kühn, Zdeněk (advisor) ; Munzi, Tomáš (referee)
The thesis deals with the problem of the monopoly structure of the modern justice system and the heavy regulation of most fields of dispute resolution. In this system, judges themselves comprise a self-interested group seeking relaxed regulation and increased rights from the government. The thesis describes inefficiencies and dangers stemming from the lack of market control of the modern justice system and suggests an alternative in the form of a private justice system. The purpose of this paper is to examine both the problem of successful implementation of competition into the current justice system, while describing various models as to how the private justice system could function without state control, with examples from history. This paper further examines the economic differences between private and public justice systems in terms of incentives, efficiency, the process of law creation, speed, and consumers' satisfaction, as well as the conditions under which different systems work best. The main conclusion of this paper is that society should allow all subjects desirous of opportunities to provide goods and services through new enterprises, even in areas currently the exclusive domain of the state, as doing so brings an increase in quality, speed of solution/service, and innovation.
