The Europeanisation of Asylum law

The Europeanisation of Asylum law Abstract The content of this thesis focuses on the development of the European Union asylum policy, as the youngest but fastest developing EU policy. As the field of asylum law is highly influenced by the incorporation of EU legislation into the national legal orders of the Member States, this legal area can be described as strongly Europeanised. This thesis aims to document the process of Europeanisation of asylum law through the construction of a regional subsystem of refugee protection in the European area, called the Common European Asylum System, or CEAS for short. The thesis is divided into an introduction, seven chapters and a conclusion. The first chapter explains the basic concepts with which the thesis works, as well as emphasizes the necessity to consider the field of asylum law through the prism of three layers which mutually influence and complement each other. These layers are of the international, EU and national law. For this reason, the most important international legal pillars supporting the EU asylum acquis are mentioned. The following chapters deal with the very concept of the Common European Asylum System and EU asylum policy, in an attempt to capture the underlying conceptual ideas behind the need to build this system. Europeanisation of Czech, Polish, and SLovak media in the context of three crises

The dissertation focuses on the level and form of Europeanisation of Czech, Polish and Slovak media in the intense phases of three crises - the migration crisis, the coronavirus pandemic and the war in Ukraine. The theoretical starting points of the thesis are the theories of the public sphere. Its functional variant is considered in the context of the "European communication space" as a means or a necessary condition for eliminating various deficits of the European Union, especially the democratic deficit. Of the various approaches to conceptualizing the European public sphere, the research in this thesis adopts a Europeanization approach, through the lens of which the European public sphere is seen as a network of national public spheres that are increasingly "Europeanized", and which relies on individual national media in its empirical efforts to detect the European public sphere. A parallel quantitative and qualitative content analysis of the content published on Facebook by six Czech, Polish and Slovak mainstream media outlets in the early stages of each crisis identifies different levels of Europeanisation across crises, reflecting the different levels of competences that the EU possessed in each of them. Comparison of Europeanization in the field of justice and interior in Moldova and Ukraine

This diploma thesis examines the theoretical concept of Europeanization in the context of the Russian invasion of Ukraine on 24 February 2022. The ambition of this thesis is to compare the relative levels of Europeanisation in the field of justice and home affairs in Moldova and Ukraine and then place it in the context of the Russian aggression. The aim of this thesis is to determine whether both countries were sufficiently Europeanised prior to receiving candidate status, or whether this EU move was solely a reaction to Russian aggression. Europeanisation theory was chosen because it examines a process that is crucial for EU accession. In this case, it was defined as the degree of approximation of national legislations to the EU acquis in the field of justice and home affairs. The integration process is a natural response of states to external threats, but also an opportunity for economic integration and shared prosperity. This thesis therefore examines the motivations, but also the obstacles, that shape the bilateral relations between the EU and the countries aspiring to EU membership. The Lidice Case and Memory Politics in the Czech Republic

This diploma thesis deals with the issue of mobilization of political memory connected with the degree of collaboration in the Czechia with Nazi Germany. I put the whole case in the broader context of dealing with the Holocaust in post-communist countries. I analyzed the process and consequences of the mobilization of political memory on the specific case of the Lidice. I examined in more detail the concrete effects of a wrong and inaccurate alignment with the historical past on the current political scene and the public in the Czech Republic. The influence of the coordination of the foreign policy on economic diplomacy of the member states of the EU

The aim of this bachelor thesis was to critically examine the impact of the EU membership on the economic diplomacy of Slovak Republic. The research is based on the analysis of strategic documents of economic diplomacy of SR and official statements of its main representatives. The analytical part of this thesis was preceded by a theoretical section that explained and fixed the meaning of the terms such as Europeanisation and economic diplomacy. This was followed by a short introduction to the economic diplomacy of SR. In the selected documents, the changes in terms of the economic diplomacy of SR were examined on three different levels. Firstly, the exploration of the strategic level of the economic diplomacy was conducted, which elucidated the trends of the development of the economic diplomacy. Subsequently, the tasks of the economic diplomacy were clarified. Last but not least, the pressure on the institutional changes in the organisation of the country's representatives of the economic diplomacy was monitored. Europeanisation of political system of a federal state: the case of Belgium

The Master thesis "The Europeanization of a political system of a federal state: the case of Belgium" investigates the Europeanization effect on a federal polity in Belgium. It discusses the relations between the federal government and the federated entities in Belgium. It addresses two questions. Firstly, what is the impact of European integration on the relations between the federal government and the federated entities in Belgium and secondly, does European integration strengthen or rather weaken the role of federal government towards regions and communities. In particular, it argues that the combination of two parallel processes - on the one hand, the deepening of European integration and on the other hand, the domestic devolution of powers in Belgium - resulted in a situation where the position of the federal government is strengthened despite the constant pressure of federated units on decentralization. Using Germany and Austria as typical cases of federations to compare, the thesis assumes that Belgium is an exceptional case of federation. While in Austria and Germany the European integration consolidates the existing relations between federal government and federated entities, in Belgium it completely changes them. The Impact of the europeanisation process on Spain

This dissertation analyses the europeanisation process and its impact on Spain. Its main aim is to find answers to the following questions - which Spanish institutions were mostly affected by Spain joining the European Communities/European Union and how successful was Spain in putting their political priorities on the top of the list of the European Union agenda. It analyses the main impacts and emphasizes the institutional changes that were put in place with the aim of fulfilling the European political requirements. Having done the analysis using the appropriate tools, this dissertation comes to a conclusion that the Spanish membership in the European Communities/European Union had an important impact on domestic institutional structure and the political system. It also shows that in certain aspects Spain was able to push its national interests and to influence the European integration process in the areas of its priority interests. On the other hand, this dissertation also comes to a conclusion, that with the growing number of member states and the impact of economic crisis Spain has lost its productive power that was characteristic for this country until the end of 2004. The topic of this thesis is the Europeanisation of Criminal Procedural Law in the European Union region and in the Czech Republic. The thesis deals with the general questions of Europeanisation of Criminal Law including definition of the institute of Europeanisation of Criminal Law, outline of historical evolution of Europenisation and characteristic of the sources of law and besides concentrates on basic instruments of Europeanisation of Criminal Procedural Law, institutional framework for cooperation and the position of victims and aggrieved person. The last chapter deals with the analysis of fundamental rights and freedoms in the criminal procedure within the process of Europeanisation of Criminal Procedural Law with a view to the judicature of the Court of Justice of the European Union.

This thesis deals with the Europeanisation of criminal law. The aim of the thesis is to examine the evolution of Europeanisation within the European Union, to analyse current regulation and to focus on law enforcement institutions. The paper is composed of three chapters. Chapter One is introductory and explains the notion of the Europeanisation of criminal law and describes the evolution of police and judicial cooperation in criminal matters within the European Union. The text then concentrates on the impact that case law of the European Court of Justice has had on the Europeanisation. Chapter Two investigates the current versions of treaties and the main changes that the Lisbon Treaty brought about. Subsequently the paper explores the harmonisation of substantive criminal law and criminal procedure, the new legal concept of the 'emergency brake' and the extension of powers of the European Court of Justice. The following part of Chapter Two illustrates the accession of the European Union to the Convention for the Protection of Human Rights and Fundamental Freedoms and it also discusses the Charter of Fundamental Rights of the European Union. The First and Second Referendum on the Treaty of Lisabon

Master thesis "The First and Second Referendum on the Treaty of Lisbon in Ireland" is a comparative case study, which - using the concept of europeanization - analyses causes, which led to the opinion shift of Irish citizens on the Treaty of Lisbon between years 2008 and 2009. Whereas during the first poll in June 2008 Irish rejected the Treaty, 16 months later it was accepted by an expressive majority, when almost half a million people more voted for it. The thesis clarifies, which elements caused a totally different course and result, explores opinions of individual players such as political parties, government, trade unions, associations of interest or significant companies, observes course of the campaign before the referendum, summarizes and analyses outcomes and subsequent reactions both on national and Union level. From the discovered facts the thesis concludes, that behind the change of attitude of the Irish stood especially external effects. On one side pressure of the other member states of the Union and even the EU as a whole to finalize the process of institutional reform and also explicit refusal of repeating the scenario from 2005, when ratification of the Treaty establishing a Constitution for Europe was terminated after disagreement of France and the Netherlands.
