Codes of procedure of municipal and regional councils

MUNICIPAL AND REGIONAL PROCEDURE RULES Abstract The theme of work are municipal and regional procedure rules according to positive law. An important issue is legal nature and relevance of procedure rules according to positive law. The conclusion of this part of the diploma work is the negative and positive definition of the legal nature of procedure rules. The core of the assessment of the appropriatiness and legality of the specific procedure rules is the analysis of contemporary case law addressing the legal action against unlawful interference with the rights the question of right of a citizen of the county, eventually municipality to comment on individual agenda items discussed by the council. The specific procedure rules of various councils were analysed from the point of possible discrepancies with the law, redundant provisions copying the law or details concerning the implementation of the citizen rights to express their attitudes towards the issues discussed by the council. The conclusion of my work are suggestions de lege ferenda, which can be briefly summarized into three scopes. The first of all is an explicit statutory regulation of the obligation to publish the procedure rules in a manner allowing remote access. Issues in education of officials of territorial self-governing units in Ostrava

This diploma thesis deals with the education of officials of public administration on the level of territorial self-government. The aim of this diploma thesis is to evaluate a system of education of officials of territorial self-governing units on example of a particular town district authority in Ostrava, to identify problematic spheres and to propose the possibilities of their solution. After introductory determination of the problem in the beginning of the thesis there are theoretical solutions stated and there are contemporary trends of development in education of officials in Europe outlined. Afterwards there is an origin of contemporary system of education of officials of territorial self-governing units in the Czech Republic described in the context of reform of public administration which is followed by the determination of legislative framework, by organisation of education and by overview of participants engaged in this sphere. Municipal self-government in the Czech Republic: theoretical and historical basics

The dissertation deals with the municipal self-government specifically focusing on its theoretical and historical background. The aim of this work was to elaborate the municipal self-government, not only to transcript or write a comment on the legal regulation, but also to inspect the assigned problem by the optics of legal theory, legal history and political science perspectives. This dissertation should provide a comprehensive perspective on the issue of municipal self-government, not only in its current legal regulation, but also identifying its theoretical backgrounds and historical roots. This paper primarily defines a set of institutions that can be summarized as fundamental theoretical aspects of public self-government (emphasizing the specifics of local or municipal self-government). In the context of the origin and development of modern public administration the work examines the main causes which led to the incorporation of elements of self-government into the modern administration. Bachelor thesis deals with financial health of municipality Bezděkov and city Ždírec nad Doubravou in the years 2011-2015. The literary research contains the basic concepts that characterize the territorial self-government, municipal budget and financial analysis in the public sector. The practical part uses analysis of budget revenues and expenditures and financial analysis of financial statements. Based on the SWOT analyses and available information that was discovered there are suggested the recommendations to both municipalities.
Audit of budget management of local self-government

55 Abstract This diploma thesis gives an insight into the system of control and supervision procedures applied to local self-governments. The aim of this work is to evaluate possible problematic aspects of established supervisory procedures applied to budgetary management and to assess whether it is needed to extend the Supreme Audit Office's competence by enable it to control the budgetary management of local self-governing units with their own assets. The introductory chapter briefly summarizes the issue of budgetary management of local governments, while a more detailed interpretation is devoted to the duty of the local self-goverments to comply with the rules of budgetary responsibility, which was brought by Act No. 23/2017 Coll., On rules of budgetary responsibility, as amended. The following chapters are devoted to the various supervisory procedures and their systematics. Audit of budget management of local self-government

This diploma thesis provides a basic classification and description of a control system in a budgetary management of self-governing municipalities as subjects of public administration and then it evaluates these control mechanisms from the point of view of their importance and purpose. The introduction deal with a basic outlook of the self-governing municipalities themselves, that is the principles of a contemporary zoning organisation in the Czech Republic. The following part of the thesis, an issue of financial management of the municipalities is summarised in a following order - through an interpretation in the field of their property and limits in its management, furthermore through a description of the essentials of a budgeting process from its draft to its authorisation, an implementation of the management itself to a closing account. Generally binding ordinances of municipalities Abstract This thesis deals with generally binding ordinances of municipalities. Generally binding ordinances are legal regulation which issue municipalities in independent competence on the basis of Article 104 Paragraph 3 of the Constitution of the Czech Republic. It is necessary to distinguish them from decree of municipality issued in delegated competence according to Article 79 Paragraph 3 of Constitution. The approach to generally binding ordinances significantly influenced the Constitutional Court. The first chapter deals with constitutional and legal basics of local administration generally, also with territorial and personal basis and independent and delegated competence of municipalities. The second chapter analyses in more detail process of passing of generally binding ordinances and potential public involvement on this process, also content requirements and structure of generally binding ordinances. Appreciation in Municipal Property over Time

The aim of thesis "Appreciation in municipal property over time" is the selection of the most suitable variant of financing the investment project. The project solves the reconstruction of the existing unused House of Services at the Community House of Seniors. The theoretical part of the thesis deals with the functioning of public administration and territorial self-government, public and mixed goods. Municipal budget and revenues of territorial budgets. Furthermore, project funding, grant titles and project preparation and implementation are mentioned. The practical part deals with ways of financing an investment project using bank products, where the use of state subsidy is also used. The calculations take into account income from regulated and market rents. Variants are compared to find the most appropriate funding option for this project.
Assessment of housing opportunities in Prague and Brno

This thesis deals with possibilities of living in two biggest cities in the Czech republic, which are Prague and Brno. In the first part is stated definition of investment, structure of local self-government, regional policy and regional development. This serves as the background for better understanding of linkage between different regions, definition of territorial units, and means how regions are developed. In the next part of this thesis are mentioned basic indicators for the whole Czech republic, including trend in prices of properties, which is important for assessment of living possibilities. This is the background for evaluation of chosen locations against Czech Republic. In the next chapter is analysis focused on chosen locations, based on data of whole Czech Republic as well as data focused only on these two locations and its surroundings. The conclusion is that Prague has special position in Czech Republic. There are broad working opportunities, high incomes, but also high living expense. Brno is not as high as Prague in evaluated indicators, but in comparison of whole Czech Republic is still on the top. It is necessary to take into account higher living expenses in both Prague and Brno but on the other hand compared to other regions, offered possibilities and services are on high level.

Diplomová práce se zabývá problémy současného územního členění České republiky. Základním východiskem práce je charakteristika historického, právního a společenského kontextu územního členění státu. Na tomto podkladě je následně proveden rozbor hlavních oblémů územního členění České republiky a navrženy eventuální možnosti řešení. První teoretická část je věnována fenoménu územního členění z pohledu obecné státovědy a sociální Uherské monarchie až po reformu veřejné správy provedenou po vzniku samostatné České republiky. Pozornost je zaměřena především na popis a hodnocení dobových koncepcí územního uspořádání a na proměny jednotlivých typů územních celků v čase. Třet zaměřena na úpravu územního členění v rovině ústavního pořádku České republiky. Jde zejména o rozbor relevantních obecných článků Ústavy včetně preambule. Samostatný pododdíl je potom věnován české koncepci územní samosprávy v podobě obcí a vyšších územně samosprávných celků. Drobná úvaha je rovněž věnována nejednoznačnému postavení statutárních měst. Čtvrtý oddíl se zaměřuje na právní úpravu administrativního členění České republiky. Práce poskytuje přehled správních obvodů ve formě obcí, vojenských újezdů, okresů, krajů a zvláštního postavení hlavního města Prahy.
