56 poukazovat na zanedbání péče ze strany ošetřujícího lékaře, tedy na postup non lege artis216 . V krajním případě by byl lékař vystaven i riziku trestního stíhání217 případně občanskoprávní žalobě na náhradu škody. V případě soudního řešení celé věci bude na zdravotnickém zařízení, aby prokázalo existenci informovaného nesouhlasu. Z tohoto pohledu se jeví jako klíčové, zda byla řádně vedena zdravotnická dokumentace a bude dostupný písemný (byť jak naznačeno výše i třeba nepodepsaný) negativní revers. Pokud bude písemné zachycení reversu nedostupné (např. proto, že se dokument ztratil), lze jej stále prokázat svědecky, nicméně důkazní pozice zdravotnického zařízení tím bude zcela jistě oslabena. Za nesouhlas pacienta s navrhovanou zdravotní péčí se nepovažuje situace, kdy je lékařem doporučen určitý léčebný postup, ale zároveň jsou uvedeny určité reálné alternativy a pacient se rozhodne pro jinou možnost než tu, jež doporučil lékař. V takovém případě jde o pouhou svobodnou volbu mezi dostupnými možnostmi. Pro postavení lékaře by bylo v takové situaci vhodné, aby pacient podepsal informovaný souhlas, v němž by pacientova volba jiné než doporučované alternativy byla zanesena. 7 Závěr Cílem právní úpravy informovaného souhlasu se zákrokem je dosáhnout určitého stupně ochrany práv pacientů. Musical abilities of childeren and young people as a pedagogical problem

Diplomová práce Je pojata jako kombinace teoretické studie a teoretickovýzkumných bloků. První část diplomové práce je teoretické povahy a odpovídá na základní otázky týkající se hudebních schopností dětí s důrazem na problematiku jejich měření a hodnocení. Pro lepší orientaci v oblasti hudebního školství a hudební pedagogiky je do teoretické části zahrnuta i část mapující historii a současnost hudebního školství v České republice. Výzkumná část diplomové práce je rozdělena na tři empirické bloky, jejichž cílem je měření hudebních schopností dětí a mládeže, reflexe hudebního prostředí v rodinách a dále zjištění stavu úrovně výuky hudební výchovy v současné škole. Pro jednotlivé výzkumné bloky jsou použity rozdílné metodologické nástroje. Výsledky těchto šetření včetně užitých postupů jsou podrobně rozpracovány spolu s obsáhlým zhodnocením jednotlivých okruhů a jevů. Tyto poznatky mohou sloužit k optimalizaci hudebně-výchovných koncepcí a k zavádění nových metod v hudebním vzdělávání dětí a mládeže.

Direct presidential election in Czech Republic : causes, conditions, consequences

The aim of this thesis is to analyze the process of changing the Czech Constitution from indirect presidential election to direct popular election. This happened in 2012 and it is the most significant change of the Czech Constitution since its adoption. The first chapter of this thesis focuses on characteristics of a president in the Czech Republic and his specific role in the constitutional political system, which is crucial for understanding the topic. The second chapter deals with the process of constitutional change from the indirect to popular presidential election. It describes the history of legislative bills from 1989 to 2012, when the last bill was passed by the Parliament. Also, this chapter introduces an expert discussion about this fundamental constitutional change, as well as its pros and cons. The arguments for a direct election are rare in expert discussion compare to the arguments which are against. The argumentation of the political representation is generally in favor of direct presidential elections. This is in a strong contrast with political scientists and constitutional lawyer's opinion. Parliamentary parties in the Czech Republic: functions, tools, stability

The thesis deals with activities of Czech parliamentary parties during EU-affairs discussion in the Chamber of Deputies, Parliament of the Czech Republic. The main focus is on three characteristic features of political parties during their activities on the parliamentary level: stability (rhetorical, voting, and programmatic), use of parliamentary oversight tools, and fulfilling their systemic function. The parties are seen through the prism of behavioural approach. EU-affairs are a rather new topic with a variable salience for national parties. EU-affairs influence party competition in extra-parliamentary arena. Conflict, however non-salient topics in parliamentary arena are ousted by governmental parties in order for them to keep governmental stability. The parties do not act according to their party manifestoes (low level of Europeanization); instead, their voting behaviour indicates that the parties follow logic of parliamentary competition between government and opposition. Parliamentarization of EU governance (engagement of national parliaments in broader institutional setting of the EU) leads to spreading of party competition on the national level to a new policy area. Political parties use tools of parliamentary scrutiny in a rather limited extent and according to their actual position within the system. The thesis also deals with party nomination and composition of the Committee on European affairs which holds oversight powers. The empirical analysis is based on the analysis of voting behaviour of parliamentary party groups (roll-call data), stenographic records, Committee and plenary session resolutions and quantitative analysis of composition of the Committee.

Employee care in a small organization

This bachelor thesis deals with an analysis and evaluation of employee care in a small organization. In the theoretical part, this issue is described and divided into several categories which are necessary for an application of the analysis in a real company. In the practical part, the author conducted a personal investigation of the actual employee care conditions in the organization. In addition, a questionnaire, reflecting satisfaction and loyalty to the company, was handed to the employees. Not only is the aim of the bachelor thesis to evaluate a current status of employee care in a small organization but also to suggest possibilities of how to improve working environment and treatment of employees, if needed.

Enterprise Efficiency and Value-based Management

This paper deals with theory of measuring enterprise performance in relation to its market value. Main objective is to explain the principles of value-based management and answer the question why managers prefer this concept of financial management. It is extended about less used financial performance indicators which respects principles of value-based management and implements to this traditional instrument new dynamic components. This theory is supported by case study.
