Directive on environmental liability with regard to the prevention and remedying of environmental damage and transposition in the Czech legal system
Jelínková, Petra ; Tichý, Luboš (advisor) ; Svoboda, Pavel (referee)
The subject of my master thesis is the EU directive 2004/35 on environmental responsibility, prevention and damage redress, its implementation into the legal order of the Czech Republic and the potential impact of undue transposition of the directive. The first part of my thesis deals with the harmonization need in this area and with the directive itself. Following a brief introduction of the directive, I'm presenting an overview of its basic institutes and their legal form. I'm also making an effort at identifying possible shortcomings of the directive. The basic institutes of the directive include: key principles, the environmental damage itself, operational activity, responsibility mechanisms, financial safeguards and the administrative procedure to impose a preventive or a remedial provisions. The second part of my thesis deals with the theoretical aspects of appropriate implementation, such as the interpretation of the directive, a timely adoption of the transposition provisions, proper projection of the content of the directive, due form of the transposition provisions, the application of EU norms, the equivalence and effectiveness imperative and the internal Czech rules for the implementation of EU norms that have been laid down by the governmental provision Nr. 1304 (methodological directions). Authentic counterfeit in viral marketing
Jelínková, Petra ; Štůsek, Jaromír (advisor) ; Marie, Marie (referee)
This master thesis deals with authentic fake, a phenomenon present in viral marketing. After a brief introduction into the issue and clarification of terms, the study aims to find out whether a seemingly authentic video recording of a catchy incident helps a marketing campaign to succeed, that is to say to achieve high sharing figures amongst internet users. In a theoretical part, the thesis elaborates information from technical books, publications and internet sources dealing with authenticity as such, viral marketing and a match they create, an authentic fake in viral marketing. Theoretical findings from these sources are applied in an empirical analysis. Empirical part of the thesis focuses on analyzing 100 most successful viral campaigns of the world. For this purpose, we consider 4 regression models (linear and logarithmic) with 6 different factors including an authenticity factor. Results of the regression analysis allow us to estimate the influence of these factors on video sharing and to answer questions like why do authentic fake campaigns exist and what are the pros and cons of such marketing strategies. At the end, the thesis contemplates on the future of this phenomenon.
Measurement rainfall kinetic energy using laser disdrometer
Jelínková, Petra ; Petrů, Jan (advisor) ; Hrabalíková, Michaela (referee)
The issue of water erosion is spread all over the world. It is closely related with soil aggregates breaking up and the subsequent soil nutrients loss. The total and intensity of rain are important parameters for determining the kinetic energy of rain. The measurement of rain characteristics was done in the laboratory at Czech University of Life Sciences Prague. To obtain the data rain simulator and laser disdrometer were used. With its help the intensity, volume, spectrum, even size and falling velocity of rain was found out. Overall 90 measurements were taken which describe the simulated rain characteristics in detail. Each measurement took 5 minutes. The kinetic energy was found out from the size of raindrop and its falling velocity. The average intensity of rain was 58.6 mm/h and reached KEtime 706,6 J m2/h. The droplets diameter median of all measurements was set in range of 0.375 to 0.5 mm.

The course of execution proceedings
Jelínková, Petra ; Žák, Květoslav (advisor) ; Spirit, Michal (referee)
The thesis deals with a very actual issue of execution, from the beginning to the end of proceedings, which monitors and analyzes each individual stage. Discusses the legal rules execution, execution modes, specifies the notion of the party and also addresses every single stage of the execution proceedings separately and in detail. It also deals with the rights of debtors and the frequent problems associated with the course of the execution proceedings, and shows the real life situation from the perspective of a party, whether in the role of the debtor himself, debtor spouse or roommate. The aim is to clarify the basic rights of debtor during the execution proceedings and demarcate negotiations of executors. Furthermore, my goal is to evaluate the current legal status of execution proceedings under the Enforcement Regulations, focusing in particular on its shortcomings and difficulties and also to ascertain whether the rights of debtors are sufficient. The motivation for the treatment of this issue for me is the large media coverage of the topic, his ignorance of the citizens and also a major financial illiteracy of the nation, which each year brings more problems to individuals and families.
