Codification of the Rules of Diplomatic Protection
Špaček, Metod ; Šturma, Pavel (advisor) ; Ondřej, Jan (referee) ; Šmíd, Marek (referee)
This thesis deals with one of the modern topics of international law - diplomatic protection. It provides for its comprehensive assessment from a wider and deeper perspective on the background of the codification process, which culminated in 2006, when the International Law Commission (ILC) adopted 19 Draft Articles on Diplomatic Protection. In the current state of international law, diplomatic protection is based on customary international law. It is an instrument to protect nationals (be it a natural or legal person) by their state of nationality, if they injured by another (host) state in violation of international law. Under the current definition, diplomatic protection means the invocation (through peaceful means) by a state of the responsibility of another state for an injury caused to a national by an internationally wrongful act of that another state. The aim of diplomatic protection is to implement this responsibility. The application and exercise of diplomatic protection is considered to be a sovereign, discretional right of the state, although the thesis points out the some recent developments in international law towards the need to recognize the rights and interests of the individual, as well as the constitutional practice of some states guaranteeing its citizens a (domestic) right to...

Šmíd, Marek ; Doubek, Vratislav (advisor) ; Šebek, Jaroslav (referee) ; Wiendl, Jan (referee)
Kritika demokracie z pozic českého katolického prostředí vletech 1918-1938 nebyla osamoceným jevem meziválečného období, ale logickým a rozhodným pokračováním kritiky společenského řádu, započatého v období po Velké francouzské revoluci. Zatímco se tehdy ekonomický vzestup evropských zemí, způsobený nástupem průmyslové revoluce na konci 18. století, neustále zrychloval, církev zůstávala pevně ukotvena 'na jednom místě', odmítavě se stavěla vůči moderní době, pokroku, technice a rozumu a snažila se posilovat vlastní cíle způsoby, které nenacházely v liberální společnosti 19. století příznivou odezvu, čímž ztrácela podporu věřících, její vliv na dění ve společnosti slábl a ona pozbývala všeobecné autority, jíž se dosud těšila. Církev přestávala plnil roli garanta intelektuálního a uměleckého dění. [...]

Minimum wage in the Czech Republic and European Union
Šmíd, Marek ; Pavelka, Tomáš (advisor) ; Janíčko, Pavel (referee)
The Master's thesis deals with analysis of the minimum wage in the Czech Republic and European Union. The first three chapters describe the function and development of the minimum wage, as well as the theoretical approaches of the minimum wage. Furthermore the arguments for and against the minimum wage are summarized. In the practical part the development of the minimum wage in the Czech Republic from 1991 is analyzed and the minimum wage across the EU countries is compared. The last analysis follows minimum wage based on further criteria: unemployment rate and poverty. The results show that during the years, in which the minimum wage increases more than average wage, the unemployment rate in Czech Republic is higher. Moreover, the countries with higher minimum wage have lower in-work-poverty rate.
