Probation and its Elements in the Czech Legal System

At present, number of developed countries seeking alternatives to punish the perpetrators. As an alternative to unconditional sentence of imprisonment is called probation and this institute is a central issue this rigorous work. Regularization of probation can be found in Act No. 257/2000, Coll. the Probation and Mediation Service, as amended. The performance of probation is authorized Probation and Mediation Service, respectively their individual centers. This rigorous work is divided into two parts, namely the theoretical and practical. The theoretical part includes the interpretation of terms associated with probation and its performance, a description of the Probation and Mediation Service, an analysis of existing legislation with regard to the institutions in which it is applied, and description probation activities in Great Britain. In the practical part of the study was used knowledge and information that I gained during visits the Probation and Mediation Service in Rokycany.
Supervision of a probation officer over criminal irresponsible children

Diploma thesis "Supervision of a probation officer over criminal irresponsible children" deals with juvenile delinquency, juvenile justice law adaptation for criminal responsible children younger 15 years of age and concerns with the ways by which society can react to the juvenile delinquency according to valid law adaptation. In its theoretical part this thesis focuses on definition of the keywords such are 'child', 'age limits of criminal responsibility', 'delinquency'. Thesis includes also description of juvenile delinquency as such where the law adaptation related to this issue is taken into consideration as well as the discipline precautions which can be ordered by court of law as a reaction to the unlawful behaviour. The goal of the practical part is to map the obstacles which discourage effective usage of discipline precautions supervision of a probation Office and suggest possible solving. The analytical part of the thesis was realised by two techniques, namely, questioning technique and document analysis.
Role of probation and education programmes in tercial prevention of social deviation

This dissertation is focused on role of probation and education programs in area of tertiary prevention of social deviation. Large amount of youngsters usually fail or break the rules during the program. It was my goal to look over a point of view of adolescents to another implication of probation programs for their lives. My dissertation objective was to reveal the reason of probation programs for youngsters, who attend these programs either voluntarily or obligatorily.Probation officers, who choose the youngsters for program, haven't information about how big importance their clients attribute to sense of probation program and what experience they get. My dissertation is divided into two parts. For first theory. Theory is based on study of available literature, which deals with youth crime. Important part is explanation of the fact, what probation programs are and what is the sense and purpose of them. I will describe current experiences but also new knowledge about research of work with youth and successful foreign projects. The theoretical part is followed by empirical part. I've decided to make this research by form of interviews with clients of PMS, who ended the program successfully. The possibilities of criminal's reintegration into society

The bachelor thesis is focused on the possibility of integrating criminals back into society. In the theoretical part are introduced the main terms and issues to layman, thanks to the literature and acquired information. In the practical part will be described the process of data collection up to the results of the research. The main aim of the bachelor thesis on "Possibilities of social integration of criminals back into society"is to clarify the integration of the perpetrator of criminal activity back into society after release from imprisonment. In a secondary goal will be found out whether the needs of released prisoners, when they are reintegrated into society, correspond to the possibilities provided by our society.

PaedDr. Eva Šotolová, Ph.D. ABSTRACT: The thesis presents the agenda of the Probation and Mediation Service and it's approach to offenders and victims of crime in the agenda of probation workers. It focuses on the area of re-offending and the possibility of reducing reoffending through appropriate follow-up services for conditionally released persons with probation supervision. The thesis analyses the problems resulting in the unsuccessful reconciliation of persons released from prison, in accordance with the aim of the thesis based on combined research (respondents were all probation workers in the Czech republic), as well as proposing possibilities for further development of work with conditionally released persons with probation supervision, and suggests systematic measures that could reduce the risk and rate of re-offending. Alternative measures to inprisonment under Czech Law

The presented rigorosum thesis is focused on the field of alternative measures to prison sentence in Czech law, including set institutes whose primary objective is replacing prison sentence, their arrangement and mutual relations, and is further focused on related issues. The thesis is divided into eight major chapters further divided into smaller subchapters. The first half of the thesis is focused on the concept and main principals on which the alternative measures are based. The second half is dedicated to specification of individual alternative punishment methods, while it does not only describe them but also assesses their positives and shortcomings.
Expert evidence in criminal proceedings

This thesis addresses the use of expert evidence in criminal trial proceedings. The author's primary aim is to present a thorough analysis of this highly specific form of evidence as contained in the Criminal Procedure Code, Act No. 141/1961 Coll., to identify its insufficiencies, and to suggest some potential legislative modifications. The author is aware that the role of an expert in criminal proceedings is also determined in part by the Act on Experts and Interpreters, Act No. 36/1967 Coll., but he deals with this organizational norm only marginally, as his main goal is to analyze the possibilities of using expert evaluations within the framework of criminal procedure. In this thesis, the author describes the historical development of this type of evidence, discusses the concept of the role of the expert in legal theory, and above all, presents his views regarding the law currently in effect, describing the use of expert evidence from its initial stages of appointment of an expert to the preparation and presentation of the expert opinion and the evaluation thereof. The author also takes account of some currently topical issues such as the confrontation of experts and the use of computer software in the expert's work. Activities of the probation and mediation service in serving alternative sanctions

This thesis, called Activities of the probation and mediation service in serving alternative sanctions aims to describe a role of the Probation and mediation service of the Czech Republic especially in serving alternative sentences, its legal base and problems, which may occur during these activities. Probation and mediation service of the Czech Republic is an organization which helps to apply the principles of the restorative justice and provides more effective exercise of the alternative sanctions. Different persons and institutions had been in charge with these tasks but the specialized Probation and mediation service is young, it has been established in 2001. The thesis consists of ten chapters, which deal with various partial topics. A separate chapter deals with a historical evolution of the alternative sanctions and probation. A part with the definition of the alternative sentence and a legal base of those sentences whose exercise is assured by the Probation and mediation service is an important chapter. The thesis also contains a description of the structure of the Probation and mediation service, rights and duties of its officers and awareness among Czech public.
