Proper law of contract under the Rome Convention and the Rome I Regulation

The aim of my thesis is to analyze the proper law under the Rome Convention and the Rome I Regulation and find out the differences and similarities between them. The reasons for my research are my interest in this topic and importance of such legal forms for contractual obligations mentioned above for the development of the European Union. The thesis is composed of introduction, four parts and conclusion. Parts One and Two are general and introductory. The core of this thesis is represented by the part Three, which has analytic character, and the part Four, which is summarizing the previous text. Part One is subdivided into five chapters. Chapter One describes Private International Law and explains the notion and methods of regulation. Chapters Two, Three, Four and Five deal with the European Private International Law (EPIL). They characterize notion, meaning, and sources of law and principles of application of EPIL. Part Two is concerned with the Rome Convention and the Rome I Regulation in general. Bachelor thesis "Debate about the introduction of a Bill of Rights in the United Kingdom" deals with a debate which has been taking place in the United Kingdom since 2007 and which mainly considers the possibility of introducing an original British Bill of Rights. The thesis presents the most important moments of the debate and opinions of its most significant participants. These are politicians, scholars in the fields of constitutional law and human rights as well as non-governmental organisations, think-tanks and pressure groups. The thesis analyses their arguments and opinions and examines which of these arguments are the most often mentioned and are the most influential. In general, the debate deals most with the questions whether a Bill of Rights should be introduced, what it should include and how it should be entrenched. The character and the content of the debate are significantly affected by the discussion of the current protection of rights in the country. This has been since 1998 represented by the Human Rights Act which incorporated the European Convention on Human Rights into the constitutional system. This thesis analyzes selected issues of the hiring of employees. It is the connection between the uncodified branch of human resources and the labour law generally. This topic is close to everyone because every person sometimes finds himself during the life in the position of job applicant and chooses acceptable employment and also person is hiring by employers. It is neccessary to know rights and responsibilities which everyone has to follow in the process of hiring of employees. The procedure of hiring of employees can be uderstood from many aspects. If we want discusse it closely we must focus on one of them. These selected issues of the hiring of employees are methods of hiring and protection of personal data which is connected by employer with application of methods. Internet business transactions with an international element The purpose of this thesis is to analyse particular issues arising out of cross-border business transactions conducted over the internet from perspective of private international law. It is mainly focused on the law applicable to contractual obligations in such transactions. The thesis consists of introduction, five chapters and conclusion. First chapter explains the concept of internet business transactions, describes different kinds of them and most importantly, shifts the focus from the traditional description of technical aspects of internet functioning to concept of internet governance, its reasons and different opinions on the need of rules designed for internet. Chapter Two begins with the definition of an international element. That is followed by characterizing the two basic methods used for regulation of the contractual relationships in private international law. Chapter Three is concerned with the rules of European private international law. The legal aspects of EU's asylum policy

The theme of this Bachelor thesis is the analysis of asylum legislation in the European Union. In the theoretical part of this thesis is the examination of the development of the asylum policy, starting with the 1951 Convention relating to the Status of Refugees and ending with a critique of the current situation. Each phase of harmonization corresponds with the most important treaties and programs which European Union members have adopted. The thesis also evaluates various stages of development and estimates the trajectory of future development. The practical part focuses on the judgments of the European Court of Justice, which determines and enacts the interpretation of EU directives and regulations related to asylum system. Furthermore this bachelor thesis focuses on the social, economic and safety factors associated with the asylum policy. In conclusion, this bachelor thesis will give a comprehensive view of the legislation, but also a practical demonstation relating to the rights themself.

Legal regulation and combating corruption in Spain

This bachelor thesis deals with corruption in Spain. The aim of this work is to explain the position of corruption primarily in the area of legislation and its combat. It also highlights the dangers of this phenomenon and the necessity for its elimination from the society. The first chapter discusses the definition and legal sources of corruption. The second chapter is about fight against corruption through international and European organizations. Court ruling about particular case of bribery is set in the third chapter. Final chapter analyzes the results of the questionnaire survey.

The graduation thesis analyses the status of woman since her birth to adult age in the 1st half of 19th century. In the beginning it is dealt with facts of European history. Further it focuses on woman, her childhood, adolescence and her adult age. The subject of the thesis is to show how the society behaved to a girl and a woman in the some specific social caste, how they thought of her, what type of rights, responsibilities and possibilities for education she had. The chosen areas are: the pedagogy history, the children education, the girl education and pedagogy, the family environment, the sociability, the marriage and maternity. The thesis subsequently responds how hardly and slowly the woman obtained her rights in the private also in the public life.

International Payments Law Reform: Introduction of Global Code of Payments Resumé As of November 2009, the member states of the European Union are to have implemented the EU Payment Services Directive ("PSD"), a noteworthy instrument of EU payments law. At the same time, but in the different part of the world, discussions about harmonization and unification of payments law arise. The PSD focuses solely on the transactions within the European Union, whilst, by way of comparison, discussions in the U.S. focus solely on domestic payments law harmonization. Thus, with both the EU and U.S. focusing primarily on internal issues, debate on global payments law reform is markedly absent. This Master's degree thesis aimed to fill such absence by the following means. Firstly, in Chapter 2, the author provided a general overview of current terminology of international payments law. Furthermore, a limited outline of current legislation (i.e. Uniform Commercial Code Article 4A - Funds Transfers ("Article 4A"), UNCITRAL Model Law on International Credit Transfers ("Model Law") and the PSD was provided. Chapter 2 contains a useful comparison of credit and debit transactions. Globalization and regionalization: how profoundly are they interconnected?

Observing current stage of political and economic decision-making in Europe, leads me to conclusion that the governments have been weakening at the expense of increasing importance of other actors and are rather being overshadowed by a certain kind of governance that has been gradually replacing the government as an old-fashioned mode of political decision-making. The long-term liberalisation of the world trade and constant development of global market have strongly affected ways of how governments behave in terms of economy and law-making. The national governments have been loosing their powers over economic management and they are getting to become more and more dependent on decisions of multinational corporations recently turning into roles of the most important actors of the economic development. In regard to these changes the national governments have been trying to not forfeit all its influence over the traditional fields of governmental management and they are turning themselves to supranational organizations such as the European Union supposing to it will help them to respond effectively to the emergiong challenges the globalisation brings. The master thesis describes social security of families with children in chosen European countries - in United Kingdom, Italy and Greece. The thesis is divided into six chapters. The first one deals with the development of social politics and the next one concerns international organizations which act also in the social security field. International documents of international organizations which till now form social rights and social state politics are defined. The next chapters describe social security of families with children of individual states together with their basic description and way of funding. Following, the benefits mostly designated for families with children are explained. In conclusion, all the information presented is summarised and compared.
