Methods of investigation of murders (selected issues)

The subject of this diploma thesis is "Methodology of Murder Investigation (Selected Problems)". Because this is a very wide subject, it is not within the diplomate's reach to cover the matter completely enough for a diploma thesis and the thesis therefore focuses on the methodology of the investigation of serial murders. The first chapter is devoted to defining the term "serial murder" and the differentiation between serial, mass and spree killers is explained. The legal classification of serial killing within Czech criminal law is briefly outlined. The second chapter focuses on criminal character. It examines the typical characteristics of serial killers, their biological and social preconditions, the psychology behind a first murder and the profile of the serial killer. Further, the separation of serial killers into the organized and unorganized is shown, including characteristic features. From the perspective of criminal characterization, the work further discusses victims of serial killings, with an emphasis on themes of the methods of perpetration. Within this, differences between the terms ‚modus operandi' and ‚signature' are explained. The individual phases of killing are determined. The Methodics of Investigation of the Sexual Crime Acts (chosen issues) Summary This submitted diploma thesis deals with procedures of investigation of crimes rape and sexual abuse, which are two most serious offences within sexual criminal acts. In this work I analyze only some of the most essential moments of investigation, because the theme as a whole exceeds the required extent of the diploma thesis. Most attention is paid to contacts of the prosecuting and adjudicating bodies with the victim and to the acts in which the victim is involved. The introductory part analyzes basic contemporary and previous legal regulation of all sexual criminal acts given in the present criminal codes. Offences of rape and sexual abuse are explicated in more detail. Then the work brings a criminalistic characteristics of these offences with basic statistical data. It points out the fixed detection rate of these crimes over the last nine years. Within the criminalistic characteristics, the thesis shows typical ways of committing these crimes, typical offenders, victims and typical traces. Methodology for investigation of sex crimes (selected issues) Summary This diploma thesis called Methodology for investigation of sex crimes (selected issues) is focused on making the united methodology for rape investigation, pointing out the most important factors that influence knowledge of crime of rape using my own research and comparison of secondary victimization before and after the new victim`s rights act. I chose this theme because of it`s relevancy. I also had a good access to the court and to files. The thesis is divided into eleven chapters. First ten chapters are more theorecital and the last one is focused on my own research and analysis of results. First chapter deals with the theoretical aspects of rape. First part is focused on the history of this crime, second part is focused on the current criminal aspects of rape and third part is focused on the criminological aspects of rape. Insurance fraud

This thesis is focused on theme of insurance´s fraud, primarily from the legal aspects. The thesis consist of legislative of insurance fraud according to the Criminal Code, also including a list of punishment. The following part dedicate to active insurers fight against cheats, their investigation and using more effective instruments and measures of their prevention. The thesis doesn´t forget statistical data and development in detection of insurance fraud in last 5 years. There is also the judicature of High Court and the examples of practise.
OLAF vs. GRECO - Fight against corruption in Europe

The thesis deals with the problematic around the fight against corruption in Europe. Specifically it focuses on two organizations: OLAF and GRECO. The aim of this thesis is to determine how intensively these two organizations have contributed in the fight against corruption in Europe. Historical description, analysis of institutional settings and comparative analysis were used as methods for the solution. The sub-questions, which focused on the organizational structure, the opportunity to influence the investigation, the possibility of setting up anti-corruption policies in Europe and the opportunity to influence the legislation in its Member States, helped to answer the main question. Carrying out this comparison, it was found that although OLAF can conduct its own investigation of financial fraud, it has not got the ability to set up anti-corruption policies in Europe, neither has it got the possibility to influence the legislation in its Member States. In contrast, GRECO does not investigate financial fraud, but it may, to some degree, have influence on setting up the anti-corruption policies in Europe. GRECO also has the power to influence the legislation of its Member States. The conclusion of this work delivers a report on the status and capability to fight against corruption in Europe (from an EU and European Council perspective). It also provides material about the work of OLAF and GRECO in the Czech language.
Possibilities of using the American standard NFPA 921 to create a complete Czech regulation on the fire supervision performed by the state in the fire causes identification sector.

Investigation of causes of fires (ZPP) is one part of the state fire inspection carried out in the Czech Republic. It is a specialized activity for which it is necessary to know a lot of specific information from different technical fields. This information is collected in methodological manuals for investigators. The aim of my thesis was to analyze the content of Czech materials for the ZPP implementation, to identify some unsolved or poorly solved issues in the ZPP and to determine whether the American norm NFPA 921 is suitable to be used to complete the solutions. I focused specifically on the contribution of the NFPA 921 in detection and analysis of marks in the fire area, leading to determining the cause of the fire. The conclusions I have come to by the analysis of Czech and foreign materials related to individual issues of the ZPP were consulted with experienced investigators and experts of the FRS (Fire Rescue Service), who are specialized in individual areas and are therefore able to expertly assess the practical applicability of my findings in Czech conditions. The hypothesis of the practical applicability of the NFPA 921 information which can be incorporated into the forthcoming Czech methodological guide has been confirmed. In the chapters of the American norm I have found a lot of well-sorted information not mentioned in the Czech materials. The articles suitable to be implemented into the new Czech methodological guidebook will be consulted, together with other results of my analysis, with the Working Group of the Ministry of Interior ? the General Directorate of the FRS, which is engaged in creating the new Czech methodology, and this will help to create the material that, for its comprehensiveness and practicality, will be used by the Czech Fire Rescue investigators.
A Set of Problems connected with Insurance Fraud in the Czech Republic

The insurance fraud is frequent type of criminality at the present time. The perpetrators of this crime cause heavy economic damages to insurance companies. Objective of the thesis called "The insurance fraud in the Czech Republic" is to evaluate the current state of the problem of insurance fraud in the Czech Republic from the perspective of insurance companies, law enforcement authorities and new legislation. As well to describe the way of detection and investigation, characterize the offender, analyze the most frequent cases, typical methods of committing insurance fraud and to evaluate the statistics and trends from previous years. In the thesis are explained the principles of detecting insurance fraud in insurance companies and the preventive measures. Part of the thesis is to identify weaknesses in the fight against the insurance fraud.

This graduation thesis is concerned with the role of a psychologist in the work team building. The organisation where I did the qualitative research work was Police of the Czech Republic. I wanted to confirm or rebut the assertion that the role of psychologist in police teams buliding is irreplaceable. I used methods of questioning, interview and observation. Police teams are created to solve some issues (e.g. drug-traffic) or a concrete crime (e.g. a murder). I found out that police teams are built by supervisors. They are choosing team members in accordance with their specialization, skills and experience. The police psychologists have no dealing with the team building. Police psychologists pick new policemen {--} they test their memory, reactions (this test examines functions of celebral cortex) and intelligence. New policemen also have to pass a test of personality. All these tests are necessary, because police work is extremely exacting. Next police psychologist´s task is policemen training. Psychologists teach them the assertivity, how to cope with stress and how to deal with a suicide. Very important part of police psychologists´ job is a consulting service, which can involve policemen, their wives and kids. Police psychologists offer the post-traumatic care as well. This care is established for policemen who used a gun, who are investigating death of a child or some grave murder. Police psychologists are working as investigation´s consultants, especially by investigation of self-murders, rapes, maltreatment with children. They help to ease the situation, to calm down the sufferer, they also help by the questioning and they instruct policemen how to behave to the sufferer.
Software piracy and the methodology of it's investigation

The main objective of this work is to critically evaluate a sufficient portion of the circuit problem of software piracy and to propose solutions of sub-problems, to use the interpretation of all relevant laws and all other available resources and create a comprehensive picture of the case. The practical part should be primarily a manual for ordinary computer users, which should help them. At the same time I present a preview of the methods of the executive law enforcement authority - Police of the Czech Republic, which deals with the investigation of software piracy. Range of the methods used in my work is not wide, which is partly due to reluctance of companies to cooperate because it is a relatively sensitive information, but it fully covers the needs of work and make it possible to have a final vision of the subject.
