The crime of rape under s. 185 of the Criminal Code

The diploma thesis The crime of rape under s. 185 of the Criminal Code consists of two major parts, which are divided into further subsections - first part consists of four main chapters and second part consists of six main chapters. The first part of the thesis, dealing with the criminal-law point of view, starts with a brief discussion of the sources of criminal law. The chapter then presents a comprehensive description of the development of the offence of rape in the Czech territory since antiquity up to the 20th century. The changes of elements of a crime and the very perception of punishability of rape may serve as a demonstration of advancement of personal freedom. Subsequently, more attention is devoted to the analysis of the current version of rape in the Criminal Code, Act No. 40/2009 Sb., which is currently included in Title III of the special part of the Criminal Code called Criminal Offences against Human Dignity in Sexual Sphere. The criminal law part concludes with a brief summary of the basic features which discriminate rape from sexual coercion and sexual abuse. The second part of the thesis focuses on criminology. Thieves in law - post-soviet criminal world leaders (from "perestroica" until today)

The work deals with thieves in law as chiefs of Russian-language criminal organizations. On the basis of an analysis of available sources, and their historical, criminologically focused processing, there is examined a hypothesis that criminality represented by the thieves in law creates in its fight against the society a specific form of self-defence. Part of the work being also an answer to a question to what extent today's division into old and new vors is topical, and whether this world has modernized in permanent relation to the environment surrounding it. The author proceeds in his analysis from the role of the thief in law as the individuality acting in constant tension with the society to the characterization of the thieves in law and to relations by which they are connected. He also focuses on power structures to which the thieves in law are subordinated. Thus, the author pursues an overall picture of chiefs of the Vor world and its possible modernization. Criminological aspects of hate crime

The aim of this thesis, focusing on the Criminological Aspects of Hate Crime, is to provide a comprehensive analysis of this kind of criminality in the Czech Republic from the criminological point of view. The work is divided into six chapters. The first of which introduces the topic and presents the definition of this kind of criminality and its close connection with extremist criminality. This activity is characterised by hate motivation against a group or an individual because of their real or presumed race, colour, religion, national origin or ethnicity, gender, sexual orientation or disability. The chapter also deals with the development of the hate crime concept, typology of criminal activity based on the committed type of crime or motivation and particular criminal acts occurring in the Czech Republic. The second chapter is focused on extremism and illegal activities of the members of this scene which attack the democratic system and are capable of jeopardizing it. Criminological aspects of hate crime

The aim of this master's degree thesis on the topic of the Criminological Aspects of Hate Crime is to offer a comprehensive perspective on hate crime from the criminological point of view. The first chapter is introductory and concerns itself with the phenomenon of hate crime in general. It deals with the theoretical definition of hate crime, its specific characteristics that distinguish it from other types of crime and it also includes a typology of hate crimes. Subsequently, it focuses on the international, European and Czech substantive legal regulation. The second chapter concerns itself with the related term of extremism. It defines the main ideas and manifestations of right wing and left wing extremism and it also focuses on the current situation and extremist scene in the Czech Republic. During the examination of the right wing political extremism, the terms of racism, nationalism, ethnocentrism and xenophobia are explained. Then, religious extremism and terrorism are briefly described. Finally, the last subchapter deals with the etiology of extremism. (EN): Criminal Law and Criminological Aspects of the Rape Crime The rape crime is a very specific crime. Although it belongs to the most painful and traumatic crimes, the public does not often pay enough attention to it, which in practice leads to the fact that rape victims are sometimes overlooked, treated insensitively, or their trauma is often trivialized. We also cannot ignore the fact that the rape crime is accompanied by a number of prejudices, which are for many decades ingrained in our society. All these aspects result in the fact that this crime is characterized by very high latency rate. In my diploma thesis, I dealt with the criminal law and criminological aspects of the rape crime. I was also concerned with the progress in legal regulation of rape, which has changed a lot in past 50 years. My diploma thesis consists of two parts; the criminological part and the criminal law part. Criminology is a science dealing with the protection of citizens and state from infringement. Criminology uses mostly biological or genetic methods for crime detection. Forensic traces which are collected by forensic experts on the scene are the key items of those methods. Forensic genetics is among the most important forensic subdisciplines. Forensic genetics uses DNA analysis for identification. The main aims of this study are description and importance of biological, anthropological and genetic methods in criminology, different ways of forensic identification, division and collection of forensic traces, characterization and course of forensic DNA analysis and DNA profiling. Comparison of Juvenile Delinquency in the Czech Republic and Germany

This Master thesis explores delinquency of juvenile Czechs and Germans from seventh to ninth grade based on quantitative data. The data comes from an International Self-Report Delinquency study (ISRD-2), which is anchored primarily in the Social control theory (Hirschi, 1969/2002) and the General theory of crime (Gottfredson, Hirschi, 1990). Therefore, in the first section, attention is paid to these and other selected criminological theories; the other theories are mainly the strain theories and the cultural deviance theories. In the second section, the thesis deals briefly with the socio- cultural differences and similarities between the Czech Republic and Germany. The core of the thesis is the third, analytical section, which presents the findings of statistical analysis. A conclusion is reached that the theories studied are by far less contradictory than what the authors of the social control theory and the general theory of crime claimed them to be. It rather seems that the individual theories are complementary and often lead to the same predictions. Hypotheses are confirmed that some characteristics of the pupils` relation to their school are related to delinquency: Pupils who like going to school are somewhat less delinquent than pupils who do not. The aim of the thesis on the topic of Criminological aspects of hate crime is to comprehensively cover the issue of this particular crime in the Czech Republic, its specifics and differences from other types of crime. The work is divided into eight chapters. The first chapter is introductory and gives the explanation of the concept of hate crimes, its characteristics and division. This chapter also contains analysis of the crimes, where the motive consisting of racial, ethnic, religious and other hatred is a sign of a basic or skilled fact in issue. In the second chapter there are terms extremism, racism, xenophobia, anti-Semitism, nationalism, terrorism, their definition and division discussed in more detail. Chapter Three and Chapter Four are focused on the offenders and victims of hate crimes. They concentrate primarily on how are the offenders and victims of these crimes distinguished from the offenders and victims of "normal" crimes. The fifth chapter explains the most common form of commission, the most common objects and offenders of hate crimes. Police Identification of Persons in Czechoslovakia between 1918 and 1938

This thesis is focused on police techniques of identification of persons used in Czechoslovakia between 1918 and 1938. The goal of this thesis was to show, how the police identification of persons should look like, in other words which techniques were used by criminologists, how they described them, which accomplishments and negatives they saw in them, who had to be identified and for which purpose. To answer all these questions I deal with political and administrative context of Czechoslovakia, police structure in Czechoslovakia between 1918 and 1938 and development of criminology, "bertillonage" and documents of identification (especially passports) in the first part of the text, where I mainly use secondary literature. Then I focus on analysis of three main techniques of identification used between 1918 and 1938, namely dactyloscopy, graphology and photography. In this part of the thesis, I use criminology manuals, published in the twenties and thirties. Finally, I work with the fourth technique of identification of persons, namely the description of persons, where I mainly use forms, which are in the criminology manuals.
