Comparison of the state of Public Affairs in the Czech Republic and Great Britain

This bachelor thesis follows the very first research on the state of public affairs in Czech environment and its comparison to neighbouring countries and so brings the comparison of the state of public affairs in the Czech Republic with Western style democracy on the example of the United Kingdom. The comparison is conducted on the basis of state regulations. Regulatory framework is then also completed with insight into self- regulation. Based on such method, number of dissimilarities and similarities between the states of public affairs in both countries are indentified - amongst the most significant of the latter falls: both countries (1) pursued establishment of separate law intensively only in very recent years; (2) decided to address the issue of unsatisfactory level of transparency within the industry by suggesting introduction of mandatory register that should be available to the public online; (3) aside from regulating actions of those in the public affairs industry, both countries emphasize the importance of regulating the ones who are lobbied; (4) highlight as potential problem the ‚revolving door effect'; (5) failed to achieve to approve the legislation in the way it was originally designed and both countries (6) still lack effective statutory regulation of the public affairs industry....
Czech prison system and its ability to meet the public interest

Diploma thesis "The Czech prison system and its ability to meet the public interest" deals with the public interest in the selected area from the perspective of key stakeholders, election programmes, policy statements of governments and (changes in) legislation between 2000-2013. For determination of what is the public interest has been used as a tool a scheme of four dimensions of definition of public interest. First, there is the public interest as defined by experts, which is determined on the basis of content analysis of the journal the České vězeňství published by Prison Service of the Czech Republic. Second, the public interest determined by the preferences of citizens, which are collected from content analysis of articles from Newton Media Search and from reproduced findings of public opinion polls. To analyze the third dimension of public interests, which are generated by functional needs of the community, content analysis of election programmes of the parliamentary parties of the period is used as well as policy statements of the government and also the study of changes in legislation. Public Benefit as a Tool to Improve Civil Society

The dissertation deals with problematics of public benefit as a tool for providing services in the public interest, more concretely in relation to implementation of public benefit status to new Czech Civil Code. From the beginning the process recodification of new Civil Code the question of public benefit stirs up heated discussions. It's questioned what effects can the implementation of public benefit status have on non-profit sector. Besides development of this discussion dissertation deals with public benefit, public services and other terms from civic sector theories, as well with public benefit status in new Civil Code and in law systems in other countries and with draft law on public benefit. Protection of environment and ownership The diploma thesis deals with relationship between protection of environment and ownership in legal system of Czech Republic. The thesis is based on complex approach to this matter and tries to cover all aspects of this relationship. Because typical for the relationship between protection of environment and ownership is a mutual collision, the thesis focuses on expressions of the collision in Czech legislation, among them various types of restrictions of the ownership in favour of protection of environment prevail. The diploma thesis analyses restrictions of ownership in the area of protection of wood, nature and landscape, agricultural land and water. In relation to the restrictions of ownership the diploma thesis deals with compensations for these restrictions. At the same time the diploma thesis introduces the ownership as a legal institute that can help to the protection of environment in many ways. Rights and obligations of the agricultural land ownership

This master degree thesis is focused on the rights and obligations of agricultural land owner from the perspective of right. Land belongs to most important sources of planet. Human being cannot alive and exist without agricultural land and cultivation of agricultural land helped to developed modern human civilization. Soil has been threatened on area and as well as quality especially by human, therefore is needed effective legal regulation with a balanced respect for property rights and the public interest in protecting of agriculture land and the environment. The main goal of thesis should be critically analyze on legislation (especially Laws, but also Government Regulations and Notices), regulating the ownerships of agricultural land. After general part of thesis, analyzing ownerships in general follows the interpretation of the ownership of land parcels, supplemented by the system and the development of land registration. The main part of thesis consists of a chapter entitled the rights and obligations of agriculture land owner, which is divided into modes of protection of agricultural land (in terms of area and quality), protection of larger area under Act on the protection of nature and landscape and other laws. Enactment of so-called "muzzle act" and its impact on czech media

This thesis deals with the Act no. 52/2009 Coll., which amends the Act no. 141/1961 Coll. (Penal Procedure Code), as amended by latter Acts, and some other Acts. Because of its alleged censorial character, it was often referred to as the "Muzzle Act" by local media. The thesis is composed of five parts. The first one describes methods used in the rest of the text, the second one explains main theoretical concepts and essential topics that are important for understanding the other parts - right to privacy, right to information, publication of transcripts obtained by eavesdropping devices etc. It also describes contents of the "Muzzle Act" and its amendment. The third part reviews how the Act passed the legislative process in both chambers of the Parliament, including protests of media and some scholars against it. All the main reasons why protestors considered the Act censorial or even unconstitutional are drawn up in the fourth part of the thesis. It also sums up thoughts and confronts thoughts of people who argued in favour of the Act. In the fifth part, journalists from Czech News Agency (ČTK), daily newspaper Mladá fronta DNES, weekly magazine Respekt and news website Aktuálně.cz describe how the Act influenced their working habits and contents of their media. OF THE DISSERTATION ON "PUBLIC INTEREST IN ENVIRONMENTAL LAW" Zdeněk Horáček, 2011 The dissertation examines public interest in environmental law. Due to the lack of professional resources dealing with the very concept of public interest, the dissertation offers its basic definition and relevant connections, but always in relation to the institutes of the environmental law. Interpretive and historical aspects of public interest are analyzed and basic definition features, classification and process of the formulation of public interest, including correction of the improper process, are established. The dissertation specifies public interest in environmental law as a legally defined value of environmental protection shared by whole society. Such a public interest is promoted in all the phases of evaluation and authorization of a project that may be harmful to the environment, in the extent always depending on the specific situation. The dissertation concludes that environmental protection is a worldwide shared value and public interest. In addition, public interest in environmental protection is a criterion for a decision making process carried out by public authorities, and the resulting public interest (adopted solution) depends on the specific circumstances of the situation.
Real estate expropriation

This thesis would like to describe expropriation as an institute of contemporary legal regulation. I decided to write about the expropriation from the view of the land law, because of the object of expropriation. My thesis is focuses on expropriation as interference of power in which the state agency issuing the constitutive act establishing the property right to the person completely different from the previous owner. I started my thesis with the short division of the constitutional bases of the institute property concentrating on land and expropriation, its legal conditions and emphasize differences from the others interferences with the property right in history. The purpose of my thesis is to define expropriation, try to interpret the law provisions, its position in the legal system of the Czech Republic and make a small confrontation by the legal regulations of foreign countries.
Sports aktivities and nature protection

Mountain climbing is a leisure activity being performed mainly in a natural environment. In our country can be found preponderance of convenient places for doing this kind of sport in the Specially Protected Areas. The basic legal regulation governing the performance of climbing in the Czech republic is the Act of Nature and Landscape Protection. This paper investigates opinions of Administration of Protected landscape Areas employees on climbers and on mountain climbing generally. It also investigates possible effects of mountain climbing according to the view of particular employees. For this investigation I have chosen a qualitative strategy of sociological research.
