Labour law aspects of employment of HIV positive persons Abstract This thesis describes and analyses problematics of employment of HIV positive persons. The main focus is on the labour law aspects which are specific or problematic regarding HIV positive persons. The text is divided into three chapters. First chapter provides general information about HIV and AIDS and creates a basis for the whole thesis. The description is focused mainly on the medicinal aspects of HIV and AIDS (its progression, treatment, its spreading, means of contagion). Information about perception of the disease in society is also provided. Second chapter revolves around aspects of employment relationships and agreements on work performed outside an employment relationship with HIV positive persons, as well as with employment of HIV positives in security and armed forces. One of the main themes of this chapter is assessment of medical fitness of job applicants and employees in relation with their HIV positivity. Other discussed topics are termination of employment relationships on grounds of employees state of health and personal data protection regarding HIV status of employees. Bachelor thesis focuses attention to individual municipal authorities, mainly to municipal council members and their liability in the scope of political law, private law and criminal law also associated with new legal norms about personal data protection (GDPR) in the scope of independent and delegated competence. The research compares municipality with commissioned local authority and municipality with extended competence in conjunction with other legal norms, such as the Municipalities Act, the Civil Code and the Penal Code. An important part of this thesis is a questionnaire, which is used for the research and it illustrates legal liability of local authorities elected in compared municipalities and an interview with an elected member of municipal council after elections. The results of the research present subjective points of view of municipal council members on their own liability.

The position of the data protection officer in the light of labour law Abstract The data protection officer is a specialist in law and practices in the area of data protection. His task is to help to controller and processor to fulfil their obligations associated with data processing. He can perform his function as an employee of a controller or a processor or on the basis of a service contract. His status has certain specifications that the character of some labour law provisions doesn't count with. Although uncertainty about the possibility to give him a dismissal or ask him for damages does not cause problems due to only recent changes of legal regulation yet, disputes that may arise in the future will be expected not only before the Czech courts. The main problem of the issue is, whether the labour law regulation can be extended without further delay to the employed data protection officer in the light of his specific independent position, which is guaranteed him by data protection law. Personal data protection under the law of European Union ABSTRACT The diploma thesis discusses the legal regulation of personal data protection under the European Union law with focus on the rights of data subjects, i.e. natural persons whose personal data are being processed. The aim of the thesis is to compare the current legal regulation of the rights of data subjects (directive on the protection of individuals with regard to the processing of personal data and on the free movement of such data) with the legal regulation with forthcoming effectiveness (GDPR) with focus on the issue how the new legal regulation dealt with the problems for which the Directive has been criticised and how it dealt with problematic parts of the regulation of the rights of data subjects. The diploma thesis consists of five parts including the introduction, the conclusion and three chapters of the own text. The chapter one contains the introduction to the field of personal data protection, including the brief history of the development of personal data protection, and it is further divided into the sub-chapters where the primary and secondary law concerning personal data protection in the European Union and its development are introduced. This diploma thesis solves the proposal for personal data protection according to the Regulation (EU) 2016/679 of 27 April 2016 (generally known under the abbreviation GDPR) in a chosen company. The thesis begins with a theoretical background followed by the part devoted to the analysis of the company. These results are further confronted with the own solution which is presenting the proposals and recommendations to bring the selected company into line with the GDPR.

This diploma thesis deals with the proposal of a personal data protection system according to the General Data Protection Regulation in the organization Dentalife s.r.o.. The proposal was implemented on the basis of an analysis of the current situation which revealed serious shortcomings in line with the General Data Protection Regulation. Based on the identified deficiencies, a recommendation has been drawn up which, in the event of its subsequent implementation, will put the current situation into line with this Regulation. The theme of the diploma thesis was selected primarily because of its up-to-date and missing materials that would describe and explain the individual steps of the whole process of analysis and implementation.

PERSONAL DATA PROTECTION IN LABOUR LAW RELATIONSHIP JUDr. Jakub Morávek The thesis is concerned with personnel data protection in connection with labour-law relationships. Personnel data protection issue is approached completely here and explanation of it is organically interconnected with cases of its use in labour-law relationships. Factually the thesis is output of grant-aided project GAUK No. 121009 "Personnel data protection in labour-law relationships" researcher of which the author was in the years 2009 - 2012. By no chance the name of above mentioned grant-aided project is identical with the name of the thesis. From the very beginning of the research of the project a monograph dealing with personnel data protection in the context of labour-law relationships, or more precisely thesis dealing with this topic that would be published, was planned as its output. Within four years of intense engagement in personnel data protection in labour-law relationships, in three of which the author worked on above mentioned project, almost thirty articles and papers in professional periodicals and collections,monograph anda rigorous thesis focused on personnel data protection in the process of employment relationship commencement, monograph focused on personnel data protection in the process of personnel...
