Protection and support of foreign investments and investment disputes resolution

The year 1989 marked the beginning of major changes. The fundamental one represents the transformation of state economy into a market economy. Czechoslovakia according to a model experience of developed countries but also of states in transition used the greatest opportunity for its economic growth and opened up to foreign capital inflow. States, that had intended to attract foreign investors, had to eliminate the socialist label, left after the period of nationalization and political arbitrariness in the relations between state and private person. At the beginning of a new era, priority was to overcome mistrust and legal uncertainty, which the turn of the 90th had given rise to. The aim of efforts of former Czechoslovakia and afterwards of Czech Republic was particularly to create a favorable legal climate for foreign investment and to stir the frozen domestic economy. In this effort, and contrary to the past practice, Czech Republic decided to cooperate at international level and become part of developing, but already functioning system of protection and support of foreign investment. Protection of a human foetus The aim of this thesis is to deal with the protection of the human foetus in the scope of the Czech legal environment as well as in the relation with the international law. The work provides the insight into the specific law areas as constitutional law, criminal law and also private law and deals with the specific rules contended in the single act as the Interruption of the pregnancy act and the new Specific medical services act. The substantial part of the legal discussion is supported by examination of the decisions of the courts both international and national which reflect the protection of human foetus. The thesis focuses on the protection of human foetus in its complexity and shall provide the comparative material which compares the protection of the human foetus within the specific law disciplines. The analysis of single legal problems and issues of the protection of the human foetus is not exhaustive and focuses on the protection and state of the human foetus in specific statutes. Defence and protection of halls of justice against terrorist attacks

Summary Critical infrastructure is a new concept in protection of the state, people{\crq}s lives, health and property. This policy is being developed at EU level as well as in the Czech Republic. One of the most significant threats for critical infrastructure is terrorism. In the first part I describe the history of terrorism, its manifestations, strategy and tactics and also the weapons used in terrorist attacks. I give the reasons for protection of district court-houses as part of critical infrastructure. In the next part I examine measures taken to protect and guard the buildings of district court-houses against particular terrorist attacks. Based on these findings I then evaluate the readiness of these buildings in case of possible attacks. I conclude by offering possible solutions to improve security and protection of these buildings.

Reactive fluid flow and origin of the fracture-controlled greisens in the Horní Blatná granite pluton, Krušné hory Mts.

Magmatic intrusions emplaced in the shallow continental crust are often associated with hydrothermal alteration and mineralization systems. Alteration zones and their assemblages can be described by means of reaction progress and this variable then used to calculate the time-integrated fluid fluxes, responsible for the mineral formation, if gradients in fluid composition, temperature and pressure are known or estimated. Two limiting cases of this approach have been applied in previous numerical models: (i) infiltration of aqueous fluid that is out of equilibrium with the host rocks, thus producing an alteration sequence as the fluid flux increases, and (ii) fluid flow in local equilibrium with host rocks, where mineral changes are induced by pressure and temperature gradients along the flow path. These two models generally yield results that differ by several orders of magnitude but are both in use for estimating fluid fluxes and transport properties in the lithosphere. We propose a combined model that evaluates the disequilibrium fluid infiltration and the pressure-temperature gradients simultaneously, and apply it to the interpretation of fracture-controled greisen alteration in the Horní Blatná granite pluton in the Krušné hory Mts. Recovery rates and the absolute priority rule

Recovery Rates and the Absolute Priority Rule The paper analyses the relationship between expected recovery rates in bankruptcy and the claim's standing within the capital structure of the debtor. According to the absolute priority rule (APR), the claims in bankruptcy should be always repaid in certain order, i.e. each claim can be satisfied only if all relatively senior claims have been repaid in full. But since the APR is often violated in practice, the actual recoveries may differ significantly from the scenario based on the assumption of adherence to the APR. The extent of the APR violations depends highly on the creditors' position in the bankruptcy proceedings within each particular legal system. The paper investigates the characteristics of bankruptcy codes that allow APR violations as well as both ex-post and ex-ante effect of these violations. In this context, we also analyse the New Czech Insolvency Act which will enter into force on 1st January 2008. The paper aims to provide a step towards understanding the problematic relationship between the recovery rates and the creditors' rights protection within particular legal framework. Credit process and metohods of choice of approval level

This thesis analyses the credit process in banks. Specifically, it describes the credit process running from the very beginning when a client asks for a bank loan to the final moment when he/she pays the last installment. In addition, the author explains individual steps made by banks throughout the entire repayment period and their measures adopted at the moment when a client is unable to settle his/her loan. The thesis also includes calculations used in assessing the profitability of granted credits. Furthermore, it deals with methods of distributing credits to individual approval levels, i.e. if a credit can be approved directly in a client's branch or whether the approval must be given at a nationwide level. It offers a hypothesis that the standard method of determining these approval levels is ineffective and proposes a new distribution method. In the last part, both different methods are, at first theoretically, compared with each other to be later followed by an empiric analysis of effects of both methods based on an available data sample. Phenotypic and molecular approaches in the systematics of the Palearctic and Neotropic tree frogs, Hyla and Osteocephalus (Amphibia: Hylidae)

The systematics and taxonomy of tree frogs of the family Hylidae has undergone turbulent changes both at higher (subfamilies, genera) and lower (species) level during the last decades. The original approach used morphological characters to distinguish tree frogs. It has been completed by bioacoustics, since the advertisement calls of the males were in some cases found to represent an important behavioural reproductive barrier and therefore useful for systematic evaluations. However, a completely new impulse was given to systematics by the introduction of modern genetic methods. These methods have allowed to distinguish not only morphologically but even acoustically cryptic taxa. The most reliable method to distinguish tree frogs at present is a combination of data from the different disciplines. The present dissertation thesis aims to evaluate the systematics of tree frogs of the genus Hyla from Eastern Europe and the Middle East as well as the systematics of the Amazonian genus Osteocephalus using a combination of morphological, bioacoustic and molecular approaches. Media and society in Japan : the character and transformation of media, communication and mediapolitical complex in a non-western society

The general aim of this thesis is to contribute to a deeper understanding of the Japanese media and communication in contemporary society. It also hopes to widen the integrated and internationalized framework for understanding the universal dynamism and complexity of media and their audiences in context of global technological and cultural transformation. Our research is mostly a cross-disciplinary integration of media & communication studies and Japanese philology. The starting point of this thesis is focused on the summary of theoretical knowledge about the "de-westernization of media studies" which presents an attempt to step out of the originally Anglo-American media communication paradigm, where mainly American theories and approaches have been widely used to explain global media processes and communication patterns. Informed by the de-westernized perspective, we focus on the case of Japanese society, its reception of texts within everyday cultural practices and media routines, since these serve as platforms where ideological features are embedded, reproduced and maintained. Srovnavani vede zejmena k vedomemu i nevedomemu napodobovanf a pfenaseni mluvnickych struktur ulozenych v mysli do noveho jazyka. Timto zpusobem si ucenf na jedne strane usnadnfme v tech oblastech, kde analogie mezi konkretnfmi jazyky funguje, na druhe strane si vsak nikdy nemuzeme by! jisti, ze pravidla, jez si takto vytvaffme, budou platit ve vsech pfipadech. Pak vznikaji chyby typicke pro mluvCi jednotlivYch jazyku, napffklad takzvane "cechismy" apod. Assessment level of leanness in the automotive company

Lean management is an approach that has made a revolution in a several industries. The measurement of its approach usually deal with quantitative approaches. However, the expansion of this phenomena lacks of qualitative perspective. Therefore, this is new opportunity to explore new metric to determinate the level of leanness of the organisation. This thesis explores new approach to deal with measurement of leanness. Main goal is to analyse level of leanness in the company automotive industry through the ethnography research and propose improvement which increase current state in that company.
