Vobořilová, Tereza ; Smolík, Petr (advisor) ; Zoulík, František (referee)
62 The Examination of a Witness in Civil Proceeding RESUMÉ The theme of my paper is an examination of a witness in civil proceedings. This institute is quite common in trial by court, during the process of evidence. During the process of evidence past events are being reconstructed and means of evidence, which number isn't definite, are used. One of the means of evidence, quite a frequent one, is the mentioned examination of a witness. I chose this theme because of the branch of law which it refers to and also because this institute appears to be multispecial, as it is applied not only in civil law, but also in other fields such as psychology or sociology. Study of this issue therefore enabled me to look into these branches and so in my paper I tried to partly cover other fields as well. At the beginning of my paper I deal with development of this means of evidence, as its' usage was common long time ago. This institute was highly regarded in the old Roman law because of its' verbality. Subsequently, the written form predominated and therefore the testimony of a witness was not of such significance as documents. Over time when verbal testimony was more often used, it was again brought to the fore and by gradual historical development it gained its' current form. The witness person itself is the focal issue...

Kalandra, Jan ; Kalivodová, Eva (advisor)
This thesis analyzes Czech translations of Walt Whitman's poetry, especially of his central poem, Song of Myself. The main aim of the paper is to provide translation analyses of all four complete Czech translations. Some fragmentary translations are also mentioned, and a basic overview of Czech secondary literature on Whitman's work is provided. The main body of the thesis is divided into three chapters. Chapter One describes Whitman's life and work in the context of his time, as portrayed in secondary literature. It concentrates on features reflected in the text of Song of Myself, including literary influences and censorship that influenced the work. It also sets out a hypothesis of possible censorship influences on the single translations. Chapter One continues with a detailed analysis of main structural features of Whitman's poetry, as reflected in Song of Myself. The features are contextualized with the main literary theories of the time and with Whitman's individual aesthetics. The structural features are sorted according to linguistic levels they belong to. In 1847, when Charlotte Brontë was writing Jane Eyre in Haworth parsonage and secretly dreaming of her literary career, not even in her wildest dreams could she have imagined what a life and what a variety of meanings female critics would once give to her first novel, and that one day she would be even studied as one of the female writers who helped to spark the women's literary rebellion and her Jane Eyre would be celebrated as a feminist classic. After all, this is what the fascinating story of this unusual romance has turned out to be. As my thesis has revealed, ever since its publication Jane Eyre has always drawn the attention of female critics. The first woman whose opinion about the novel was publicly heard was the Victorian reviewer Elisabeth Rigby. Interestingly, unlike female critics who came after her, she was not delighted by the appearance of this novel but on the contrary, she felt fully alarmed by it. She condemned it on both moral and religious grounds, disliking Jane's rebellion against the established order, as well as her sympathy towards the poor and the oppressed. Her opinion was nothing unusual concerning the fact that she was both a member of the upper class and a conservative. Yet, what was rather astounding was that as a woman allowed to write, she questioned the propriety of female...
