The effect of bailiff territoriality on the reclamation of receivables, the length of debt recovery and other aspects of court-ordered distraints

The area of individual reclamation of receivables in the form of court-ordered distraints has undergone significant changes since the year 2000. The initial practice, when the claims used to be enforced directly by judicial officers, proved to be largely ineffective and with difficult to apply. The Ministry of Justice has responded by adopting an amendment to the Act (Act no. 120/2001 Coll., on bailiffs and executor activities), which introduced the independent bailiff offices. Then, the law itself understood the bailiff authorities as a separate entrepreneurs. Currently, in the Czech Republic, there can be seen the distribution of the market with distraints according to the Pareto rule. Approximately 20% of bailiff offices manage over 80% of distraints. It is obvious that this is an unsatisfactory condition for the majority of bailiff offices. In response to this fact, the Czech Chamber of Bailiff offices calls for the introduction of territoriality, which would eliminate by law the market environment from the market with distraints and every single bailiff office would have a stable allocation of distraint proceedings. The analysis carried out clearly shows that there are significant differences between bailiff offices in terms of speed and in success of the debt recovery. The actual demand for the introduction of territoriality would not merely be a reallocation of the market with distraints. Putting it into a practice would greatly influence the transactional costs of business and non-business entities in the Czech economy. The thesis comprehensively describes the issue of territoriality and quantifies how much the debt collection will decrease in case of its introduction. In the conclusion, an alternative draft is formulated, which might, according to the author, allow effective regulation and supervision of the activities of bailiffs' offices without compromising the inherent efficiency of the reclamation of receivables in terms of market environment.

THE LATEST TRENDS IN PUBLIC PROCUREMENT LAW

This thesis deals with public procurement law in the Czech Republic. It captures the latest trends in public procurement law, together with the amendment to the Public Procurement Act, which entered into force on 1 April 2012. The opening chapter introduces the concepts that are closely related to the issue of public procurement and corruption. There are explained key institutional control mechanisms in the Czech Republic and criminal liability of corruption. The analytical part of this thesis describes the changes, which the amendment brought into the Public Procurement Law. These changes are mainly assessed in terms of impact on the suppression of corruption. This thesis presents and analyzes the arguments of proponents and opponents of the amendment. The analysis is accompanied by a brief look at the development of legislation on public procurement in the European Union in general and in two selected countries of the European Union. The conclusion contains a summary assessment of the issue along with an outlook for a possible further developments in the legal regulation of public procurement. Based on the analysis, the thesis leads to the conclusion that the amendment of public contracts, despite some shortcomings, is leading to a more transparent procurement environment.

Specifics of international road freight transport in specific area

The aim of the thesis is to analyse the German Act on the Regulation of a Minimum Wage, which affects Czech hauliers operating in Germany. First of all, macroeconomic and microeconomic issues in the field of road transport and of course the specifics of German Act (MILOG) are described. Secondly, the main effects of the law on business are analysed in case of the Czech haulier ¨Dítě Spedition s.r.o.¨ In the following, an increase in operating costs of the company according to the MILOG is calculated. Moreover, there is a prediction of potential scenarios in case of confirmation of legality of MILOG applying to the international road freight transport. In conclusion, the main arguments why the act is contrary to the basic principles of the single European market are explained.

Inbound marketing of Nestlé in the area of infant formula

This master's thesis deals with inbound marketing of Nestlé in the area of infant formula. Its aim is to determine whether inbound marketing is a suitable tool for infant formula promotion which is strongly regulated. The thesis is based on a comprehensive analysis of the area of infant formula and analysis of inbound marketing strategy of one of the most dominant companies on the market, Nestlé. In the beginning, attention is focused on important milestones of the development of infant formula and on a case which caused an important change in the promotion of infant formula, Nestlé boycott. The following section deals with the supervision and marketing regulation both in international and the European law. The final chapter of the first part emphasizes on philosophy of inbound marketing. The second part is introduced by outlining the current situation both on global and the Czech market of infant formula. Then, attention is focused on Nestlé. Its introduction is followed by analysis of company's inbound marketing strategy which is then evaluated. For this purpose, analysis of the effectiveness of marketing tools is made with regard to strategic goals of the company.

Business Plan

The main objective of this thesis is to determine the essential aspects of business formation, on the basis of which the real feasibility of the business plan is then evalu-ated. The backgroud research concentrates on the structure of the business plan's requi-rements. It deals in detail with the analysis necessary to determine the correct business strategy of the company. It contains the external environment analysis as well as the internal financial analysis. The subsequent section shows how the obtained information is applied to the particular business plan. The data needed to perform the analysis was obtained from statistical outputs, laws and regulations of the Czech Republic, from in-terviews with local residents, and also from my own personal calulations. The results were used for designing the company strategy and for the business plan feasibili-ty evaluation.

Transfer pricing and the Arm's length principle

The Diploma Thesis is devoted to the Transfer pricing problematic, whereby the Transfer Pricing and the Arm's length principle as such are defined, further the Czech and Slovak transfer pricing law is presented and the different transfer pricing together with their possible usage are described. The work is divided into 7 sections, section 1 - 5 is basically a theoretical description of the topics stated above. Section 6 comments the actual situation and development in the transfer pricing area around the world and finally section 7 demonstrates o an example the practical transfer pricing analysis with all its relevant aspects. The aim of the analysis was to present the possible ways of determining the appropriate transfer pricing method and the evaluation of the financial data when applying the selected method. The presented case study was based on an analysis of a group of 3 companies and was in general oriented on two different kinds of transactions. Crimes relatring to the abuse of addictive substances

Crime Related to Substance Abuse The topic of my thesis is Crime Related to Substance Abuse which is focused on drug- related crime. The main aim of this work is to explain drug problematic in penal law consequences to the reader. First Chapter introduces the reader to drug problematic and drug addiction issue including drug crimes, defining health, social, psychological and economic risks and dangers which may be caused by drugs. The drug crimes are divided into few basic categories because of different rational motives why those crimes are committed. Then, several essential terms connected to drug abuse are explained. Second Chapter deals with classifying drugs into several categories and analyzing their different characteristics. Third Chapter concerns with international cooperation, including its history and current international law treaty's on drugs passed within the United Nations. Three essentials applicable and effective treaties are following: Single Convention on Narcotic Drugs (1961), Convention on Psychotropic Substances (1971) and United Nations Convention against Illicit Traffic in Narcotic Drugs and Psychotropic Substances (1988). Male and Female Identity in Contemporary Society Focusing on the Labor Market

The aim of the master's thesis is to describe male and female identity in today's society. The first chapter includes basic expressions connected with key terms gender and gender stereotypes. This thesis is focusing on equality of genders and the enshrinement of equality rights in law. This thesis also includes the analysis of the current status of women in the European Union based on data from the Eurobarometer and the Czech Statistical Office survey. The aim of the graduation thesis is to analyse the perception of men and women in today's society, to determine how strongly are stereotypical perceptions rooted in society, how is perceived the equality of men and women in labour market and how opinions on this issue differ among Czech Republic citizens and among European Union citizens.

Comparison of women's rights in the USA and the Czech Republic

The Master's Thesis deals with women's rights in the Czech Republic and in the United States of America. The aim of the study is to compare women's rights and opportunities in education, labour market and family life. The theoretical part of the thesis deals with the role of women in society in terms of education, voting rights and employment on labour market. Special attention is focused on family law, mainly on benefits for mothers in different life situations. The practical part of the thesis consists of two parts, a primary empirical research in the form of individual personal interviews and an interpretation of secondary statistical data. In the end of the thesis there is a comparison of both countries based on the theoretical information and the results of the empirical research.
