Czech migration law within the context of EU law

The goal of this diploma thesis is to define, analyze and evaluate the most relevant areas related to the topic of European migration law and politics. Although the subject is quite broad, I try to focus on legal migration. Free movement of EU citizens could not be left out, however I concentrate mainly on position of migrating three country nationals within the EU. I compare the Czech legal system against the European legal system. The thesis has been divided into four chapters, which are further subdivided. In the first chapter the thesis brings a brief definition of the concept of migration in general, including a chronological historical excursion of the European norms connected to the migration law and a description of migration law, politics and the necessity of a suitable integration approach. The second chapter is devoted to create a characterization of the European migration legislation, competences in the field and a definition of fundamental human rights standards. This section also deals with theoretical and practical issues of European citizenship and the associated right of free movement. Theory and Practise of Temporary Agency Work

Temporary agency work - it's legislation as well as its practise is the main topic of this thesis. It aims not only legal, but also economical and some other aspects. The issue is becoming more and more important in relation with unexpected changes at employment market. Number of temporary agency workers is expected to rise in near future. This is resulting from expectations for high-standard legislation providing efficient protection especially for temporary agency workers. The first aim is to summarize contemporary legislation in the Czech Republic, European Union and International Labour Organization. Next purpose is to point out its main problems and interpretation difficulties. Selected chapters illustrate the approach of temporary work agencies to some disputable provisions of a statute. The thesis is composed of fourteen chapters, each of them dealing with different aspects of temporary agency work. Chapter One is introductory and defines concept of temporary agency work, focuses on situation on employment market and describes the development of legislation. Transfer of the Employment Obligations under Legal Transfer and Merger

The thesis focuses on the issue of transfer of undertaking as recognized by the Acquired Rights Directive 2001/23/EC under the EU and Czech law. The first chapter "general introduction" offers an overview of the basic relationships that arise in the course of employment, and the basics of European law. The second chapter considers the rules of the transfer of undertaking under the Acquired Rights Directive and in light of ECJ case law. It defines the terms legal transfer and merger, economic entity which retains its identity, employee, transferor and transferee. Further, it considers the transferred rights of employees and the corresponding duties of employers, encompassing the right for information and consultation, protection against dismissal on the grounds of the transfer and the right for the same work conditions after the transfer. It covers a special case of transfer of undertaking in the case of transferor's insolvency. The third chapter deals with the regulation of transfer of undertaking under Czech law. Ecological evaluation of streams in protected area Křivoklátsko in Directive 2000/60/ES

This thesis deals with the monitoring of water quality and aquatic sediments analysis in the protected area Křivoklátsko. Monitoring was carried out at 16 locations and there were determined 14 physico-chemical parameters . Sediment samples were collected once for the whole period at 14 locations in which was determine the content of metals. In each sediment sample there was analyzed content of selected metals. The results of analysis, water and sediment samples were evaluated according to the Directives and regulations giving limits for water and sediment. Due to the Czech Republic is a member state of the European Union, the state was also evaluated according to Water Framework Directive. Theoretical part of thesis decribes characteristics of metals, their forms in water and soils. This section also contain some informations about water framework directive 2000/60/EC as a great step in a water policy. Moreover there is a short history about development water quality in the Czech Republic. Experimental section contains standards for determining water quality, but indicating in particular the processing of sediment samples from sampling to determine concentrations. Information on the environment

Although these days, we can perceive the right for environmental information as something automated and quite natural in a democratic society, we must realize that it was far from it in the past. Hand in hand with the principle of secretiveness of state administration, the public had virtually no possibility to obtain information concerning not only the state of the environment but also general information concerning almost anything. It is not surprising after all because before 1989, neither the general right for information nor the right for environmental information were protected by law, less alone by the constitution. Nevertheless, the democratic changes which took place after the Velvet Revolution produced changes also in the field of the right for information and this right was, both generally - as a right for information, and specifically - as a right for environmental information, included in the legal regulation of the greatest legal force, the Charter of Fundamental Rights and Freedoms, which became a part of the constitutional order of the Czech Republic on the basis of the resolution of the Czech National Council presidium No. 2/1993 Coll. The role of agriculture in the process of Spain's entry into the EC

Spain sent its application for EC membership in 1977, but was admitted only in 1986 after complicated entry negotiations. One of the most disputed topics concerning the Spain's application to the EC was agriculture. This bachelor thesis examines the importance of agricultural sector in the process of integration of Spain in the EC, namely expectations of membership in EC for agricultural sector, the attitude of older EC member countries during negotiations and eventually the changes in Spain's agricultural sector after the entry into the EC. The thesis strives to verify the assumption that a good deal of motivation for the EC membership came from expectations that the entry into the EU would bring intense capital investment and would open new markets for Spanish agricultural produce, meanwhile southern EC's feared high competition of the Spanish agriculture and their consent with further enlargement was contingent on either concessions by Spain in other fields or structural changes in EC's policies. A part of the hypothesis is also the assumption that even though Spain was faced with long transition periods, Spanish agriculture mostly benefitted from the entry into the EC and experienced further modernization. Basic Qualifying Requirements in Public Tenders The purpose of this thesis is to analyse the Basic Qualifying Requirements in the public tenders, as enacted in the Section 53 of the Act no. 137/2006 Coll., on Public Procurement, as amended. The initial reasons for my research are constantly changing legal rules in this branch of law that often do not reflect the European enactment in the Directive 2004/18/EC. The thesis is composed of an Introduction, 3 separate Chapters and a Conclusion. The Introduction outlines the aim of the thesis, its structure and arrangement of the Chapters are shown in this part as well. The Introduction is than followed by the first Chapter called Qualification, in which the topic of criteria for qualitative selection is discussed in the context of the general provisions concerning qualification in the public tenders. This Chapter is subdivided into two parts separately dealing with the requirements of the bodies governed by public law and entities operating in the water, energy, transport and postal services sectors. Financial mechanism EEA/Norway and Swiss Contribution and their using in the Czech Republic

ANNOTATION The topic of this thesis is Financial Mechanisms of the European Economic Area and Norwegian Financial Mechanism and their using in the Czech Republic. In the introductory part there is described evolvement of these mechanisms since the foundation of the European Free Trade Association and the European Communities to their bilateral cooperation. This cooperation resulted in the creation of the European Economic Area. These Financial Mechanisms existence is based on creation EEA. The goal of this thesis is to present possibilities of the financial mechanisms and to show potential applicants for a financial support, how they could apply for the supporting finance and what they could expect. Furthermore the thesis contains analysis concerning use of the mechanisms in five years period 2004 -2009 and evaluation of results from questionnaire survey focused on one of the grants - Fund for Non-governmental Non-profit Organization. A general goal of this thesis is to provide to general and professional public compact information relating to the topic.
