Legal regulation of expropriation

77 Abstract The aim of this work is to give readers a treatise on the legal regulation of expropriation together with its causes and starting points. Expropriation, as an inter-sectoral dynamic institute, has undergone long-term development. The current regulation was adopted relatively recently, and only practical application will show, whether the revolutionary or just cosmetic changes are necessary. Expropriation is a forced intervention to property rights on the basis of an individual administrative act, its main object are lands and then other objects. We need to realize, that the change in legislation can not address all the problems and ambiguities that may arise in the process of expropriation. Legal conditions and procedures are based on the constitutional limits, which have to be always respected. Although the meaning of this work is to create a treatise of applicable legislation of expropriation and make its evaluation, the first chapter contains a treatise on the concept of expropriation. The functionality of the Police of the Czech Republic as part of the integrated rescue system in the performance of duties related to emergency and crisis planning

The topic of the thesis was mainly chosen, because in recent years many areas of the Czech Republic were repeatedly affected by floods of varying intensity and the police were forced to coordinate rescue and relief work with other units of the integrated rescue system (IRS). In practice performance-related police tasks were influenced by the quality of preparations (especially planning documentation) and decisions of the persons, who are entrusted with the rights and duties of coordinating the intervening units activities. At the same time no document, that deals with the issue, has been processed so far. The thesis is divided into theoretical and practical parts. The theoretical part is divided into three subsections. The first one aims to familiarize the reader with basic tasks, history, organizational breakdown and legislation governing the activities of the police. The second one examines ispecially the role of the integrated rescue system, its components, process and the role of emergency planning and related legislation. The last subchapter is devoted to crisis management, its bodies, related legislation and crisis planning. The practical part consists of a list of basic police tasks, which was created by analyzing documents prepared in the emergency and crisis planning for the capital city of Prague district. The police competences determined by the applicable effective legislation were subsequently applied to tasks of the list. The result of the above process was the finfing, which specific rules regulate the various police tasks, what specific permissions are officers abble to use to accomplish the task and where are the limits of their options. The aim of this thesis is to create a comprehensive document, that would contain the legal powers of the police and was especially useful in the practice of entities involved in the processing of emergency and crisis plans (including practical examples of the application of individual rights). In this context, there were formulated the following research questions: Suffers legislation of competencies of the Police of the Czech Republic from fragmentation (are the rights and obligations scattered in a number of legal norms)? Are police powers sufficient to perform all the tasks, which are imposed to this unit of the IRS by emergency and crisis plans processed for the capital city of Prague? The results of the thesis have shown that the legislation of the police activities is based on the amount of generally binding legal regulations, which are supplemented by internal regulations of the Ministry of Interior and the police themselves. Although the internal regulations don't have general applicability, they affect the performance of police tasks in practice as well. The fragmentation of legislation may cause an incorrect assessment of the police competencies by the bodies that are involved in emergency and crisis planning. By the coordination of the integrated rescue system activities, this documentation becomes one of the sources for decisions of incident commander or crisis management authority, resp. person standing at the head (especially the mayor or governor). In most cases these persons will not be experts in all relevant spheres and they will logically follow the documentation of the integrated rescue system, or documentation of crisis management. The quality of this documentation (or, conversely, lack thereof) will have practical impact on the success of the management of emergency events or crisis situations. Analysis of current documentation processed in the emergency and crisis planning for the capital city of Prague has shown, that most of the tasks assigned to the police corresponds to their competencies. There were also recorded some tasks that do not belong to the police competences. It involves the sorting of injured people by the START method and their transport to medical facilities by police vehicles.

Application of demographic methods in evaluation of bank top management and its influence on economical success Abstract The thesis presents the possibility of demographic analysis as a tool for assessing the impact of the demographic structure of the governing boards on the economic prosperity of banking institutions. The aim is to confirm or refuse the justification of regulatory proposals by the European Commission issued after analyzing the causes of financial crisis, which require the sufficient diversity (gender, age, etc.) and adequate experience of governing boards of banks. Analyzed banking institutions were divided into three groups according to economic performance, within these groups the boards structures were assessed using demographic and statistical indicators. Application of correlation analysis confirmed the relationship of economic performance and some used indicators. Life tables were utilized as the next analytical tool which allows to express the expected time spent in the governing bodies and the expected time of gaining experience in banking before joining the board of directors. Financial Crisis In View Of Czech Public - March & April 2009

According to April survey 58 % of Czechs are concerned with the situation regarding present world financial crisis, 40 % do not care about it. 83 % expect negative impact of crisis to economic development in the Czech Republic, 62 % of Czechs are convinced the financial crisis will affect their personal situation or the situation of their households. 57 % see the reaction of Czech government to present situation as bad, 24 % expressed opposite meaning.

Limits of Cooperative Federalism: Role of Federal Government and Individual States in the United States Immigration Policy

The bachelor thesis "Limits of Cooperative Federalism: Role of Federal Government and Individual States in the United States Immigration Policy" examines the separation of powers between the federal government and individual states of the United States immigration policy. The onset describes the particular characteristics of American federal system and its two main concepts: dual and cooperative federalism. It then addresses the issue of immigration policy which is traditionally one of the areas in which the principles of dual federalism are applied. The paper aims to show, that the federal government is not capable of effectively solving the problems arising both form legal and illegal immigration and that it is therefore necessary to adopt an immigration reform based on the principles of cooperative federalism. Only better cooperation between both levels of government (federal and state) can help to solve the issue. Adoption of such a reform is however currently highly difficult - this paper strives to explain why and propose possible solution.

Metodiky řízení informatických procesů - implementace ISO 20000

Increasing amount of consulting companies offering support for implementation of norm ISO/IEC 20000 and their assurance that this norm is suitable for any type of organization is bringing a question if it is in reality true. The text is considering methodologies of information processes management in MSP and is highlighting problems that can arise in this segment. The work consists of theoretical outputs as well as experience from planning the implementation of ISO 20000 in a small Business Intelligence company. In the first part of this work are methodologies put in general frame of informatics management (IT Governance) and is discussed their purpose and impacts of standardization of management processes to which their use is leading. The main attention is paid to ITIL and ISO 20000 and their mutual relationship. In both methodologies is apprised suitability for segment MSP. In scope of the practical part are defined conditions that need to be fulfilled in order to achieve successful implementation of ISO 20000 in MSP. The main output of this part is concrete methodology of implementation of ISO 20000 in a small company.

Zusammenfassung Die Diplomarbeit "Die Protektoratsregierungen und ihren legislativen Tätigkeiten" zielt darauf ab, den Leser mit den Aktivitäten der einzelnen Protektoratsregierungen im zeitgenössischen Kontext und mit deren Gesetzgebungstätigkeit zwischen 15. 3. 1939 und 5.5.1945 vertraut zu machen. Die Arbeit ist in drei Teile gegliedert. Der erste Teil trägt den Titel "Historische Pfad zum Protektorat Böhmen und Mähren". Dieses Kapitel ist in zwei Teile geteilt. Der erste Teil beschäftigt sich mit dem Ende der zwanzigjährigen Existenz der Tschechoslowakei auf der Grundlage von Verhandlungen von vier europäischen Mächten auf der Münchner Konferenz. Das zweite Kapitel beschreibt die Entwicklung und die Wende in der Politik der neuen Regierung mit Orientierung auf Nazi-Deutschland. Im zweiten Kapitel "Anfang des Protektorats" werden in ihrem ersten Teil die Nachtverhandlungen von Emil Hácha in Berlin und die gleichzeitige Sitzung der Regierung in frühen Stunden des 15. The Comparative Analysis of the Mapping of Deprived Urban Areas

The dissertation is a comparative analysis focussing on the issue of deprived urban areas in two EU member states - the Great Britain and the Czech Republic. The common link is the mapping of these areas. The dissertation is structured into two main parts - Theoretical and Empirical. The Theoretical part is divided into four main parts, called the thematic blocks. The first block is devoted to the terminology and definitions concerning the deprived areas. The second block focuses on an European-wide project concerning the deprived areas and their mapping, called the European Learning Network (LNet). third block where the mapping of deprived urban areas, the government policy and the examples of good practices are described, is devoted to the Great Britain. The fourth block is aimed on the Czech republic, with the same structure as the chapter before - mapping of deprived urban areas, government policy on this issue, good practice examples and finally the survey carried out among the relevant institutions and its outputs are presented. The Empirical part is the comparison of the Great Britain and the Czech Republic approaches to the issue of deprived urban areas.

With the regard for the demographic trend and for the system of old age pension scheme reform proposal, this work brings the comprehensive view of financial products granted by government and the recommendation how to make the best of these products by concrete natural person.

The Incidence of Consumption Taxation on Developement Consumption Expenditures of Consumer Sector

In my graduation theses I focus on charge of consumption taxes of consumer sector´s spending. Indirect taxes are imposed onto selected economic goods and increase their costs. Herewith they cause decrease of consumers´ available pension. Howsoever the available pension of different income groups is reduced depends at indirect taxes only on the level of consumption and which economic goods are used by these groups. Indirect taxes are on the contrary to direct taxes less conspicuous, because they are included in the prices of the wares and services. The consumer pays the tax by paying each purchase without any administrative acts and in doing so they do not know how much they paid in taxes to the government. The tax paid by an entity (natural or legal person) can be basically relocated in two ways. Onward to the buyer on the product market by increase of economic goods´ price or of a factor; backward to the seller. This relocation can be partial, i.e. the tax in new price will be partial; hundred-per-cent and in case of certain conditions it can be even higher than the height of tax is. The relocation doesn´t need to occur at all. For assesment of consumer sector tax charege level from consumption I chose a method which uses accessible agregate dates about consumption of social income group. In calculations I arised from dates from year 2006 published by Czech Statistical Office. From the analysys results of consumer sector´s consumption spending charge of consumer tax in 2006 result that the tax burden, which the consumer sector has, represents 13,15 {--} 14,90 % of their total average consumption spending. 11% of tax burden constitutes a value added tax and 3% constitutes a consumer tax. This means that if their consumption spending is 100 000 Kč, then the tax burdern would be 13 150 {--} 14 900 Kč. Consumer sector of employees and self-employers have a bigger tax burden than consumer sector of unemloyed and retirees. The reason is a bigger part of economic goods usage charged by 19% VAT rate.
