Relations of the EU with Montenegro and with Albania and Their Development in the Period from the Montenegro's independence to the end of 2007

This thesis deals with the transformation of the relations between the European Union and Montenegro and between the European Union and Albania. Due to the effort of the EU to create programs that help the whole region of post-Yugoslavian republics, which are not the EU members, the thesis also takes into consideration the other countries in Western Balkans. The thesis aims to describe mainly the period of years 2006-2017 but there are also chapters which monitor the development in parts of the region during the 1990s. The thesis studies official reports of the institutions of the European Union, primarily the Progress Reports by the European Commission. Beside other things the thesis describes the method of accessing a country to the EU and explains the process of accession negotiations with the candidate member countries. The thesis monitors the amendments to the Albanian and Montenegrin laws. These changes were made based on the recommendations of the European Union with a view of aligning with the laws of the member states of the EU.
Copyright in the European Union: Influence of Interest Groups during the Creation of the Collective Rights Management Directive

The master's thesis focuses on the influence of interest groups during the creation of the 2012 Proposal for a Directive on collective rights management. In particular, the thesis deals with the pre-legislative phase of the legislative process, which began in April 2004. The theoretical framework includes conceptualization of interest groups, lobbying and influence. The mechanisms of influence are analysed using two theories - rational choice theory and rational choice institutionalism. The thesis utilizes process tracing - theory testing as a main methodological approach. Empirical evidence is investigated by analysing primary sources. The main subjects of the analysis are the most relevant documents from the European Commission concerning the pre-legislative phase. Four semi-structured interviews with selected relevant actors were also conducted. The thesis concludes by confirming/ disproving of the main hypothesis: Specific interest groups succeeded in influencing the text of the proposal for a directive on the collective management of copyright.
Leniency Program in Czech, European and World Competition Law

This thesis aims to describe the evolution of the leniency program as the key tool to uncover national and International cartels. It begins with a general overview of competition law and the area of cartel Cooperation and focuses on leniency program. This program is for the sake of completeness described not just from the legal point of view but also using theory of games and prisoner's dilemma because both these phenomenon are surprisingly similar to the leniency program. For the first time there is the issue of a deterrence gap, being some kind of indicator of incentives for the cartel members to betray such cartel and uncover its existence to the authorities. Cartels are also described using tables so it is clear how much (uncovered) cartels are there each year, what is the average amount of imposed fines and how many percent of turnover of such companies usually makes the fine. Leniency programs of various states are described in detail, focusing on differences in their complexity and efficiency and some of them are described back to the past, with the Description of the evolution of such leniency program, making it more useful. European Commission as a Guardian of the Treaties

This bachelor thesis focuses on the behavior of the European Commission in the infringement of proceedings based on article Article 258 et seq. TFEU. The paper seeks to look behind the borders of mere legal framework of infringement proceeding and deals primarily with the political influences, which can affect the Commission's decision on how to act, as well as the theories, which try to explain and predict its reaction on the violation of Treaties by a Member State or different actors. The structure of the paper is as follows. Firstly, this thesis deals with the Commission's position in the system of the EU, with basic information about the Commission, then raises the question of whether the Commission is independent and impartial, or whether it is under some external or internal political pressures. Secondly, the thesis studies the infringement proceedings and the possibilities, procedures and tools available to the Commission to enforce the law and also how the Commission uses these options in practice. Of course, the paper will also cover the limits of this procedure. The Commission's main limitation of its ability to enforce the law is the lack of resources. Politicization of the European Commission

The thesis deals with the concept of politicization of the European Commission. It stems from the assumption that the new election procedure of the President of the Commission which is connected to the nomination of so-called Spitzenkandidaten, i.e. the lead candidates of the political parties before the elections to the European Parliament, led to the strengthening of the Parliament and subsequent politicization of the Commission. The new President of the Commission thus comes from the strongest political party which ran the elections with his candidature. The thesis formulates four hypotheses while focusing on three main areas which might be influenced by politicization: public opinion awareness, strengthening of the political affiliation of the commissioners as well as of the whole College of commissioners, and change of its inner composition - the political experience should become more prominent when choosing the suitable candidates for the commissioners. The analysis shows that it is possible to trace a positive trend in public opinion awareness from the side of the European Commission. Implementation of immigration policy by European Comission in period 1999 - 2014

The thesis examines immigration politic of European commission, respectively its implementation, on the basis of three programmes of European council (Tampere, Hague and Stockholm). It tries to show, whether can the theory of failed policy, which states that countries are not able to control immigration, be applied also for the European union. From the programmes are earmared individual goals, which should European commission start to implement in the next quinquennial period. On their basis then runs the research itself, divided into two parts. First of them tries to answer, whether European commission did fulfill the goals of individual programmes through its regulations, directives and recommendations. The second part reasearches, how were selected legislative proposals implemented in practise and if they served to their purpose. Both parts are interconnected, so that they correspond to individual programmes.
European Commission and High Representative of the Union for Foreign Affairs and Security Policy Joint Proposal

Lisbon Treaty introduced a new office - High representative of the Union for Foreign Affairs and Security Policy, who shall become the face of European union's foreign policy. One of the tools High representative can use is European Commission and High representative joint act. There are several types of joint act. All the joint acts submitted between 2010 and 2015 were analysed. The outcome is that most of them have been accepted by the Council of the European Union. One particular type of joint acts, joint proposal for a council regulation, is required for the EU to be able to impose sanctions on a third party. The author analysed deeply two specific proposals for a council regulation concerning restrictive measures in view of the situation in Syria. As the result, it appears that during decision making process within the Council of the European Union individual states have a preference for their own national interests over reaching a general agreement and even over compliance with policies previously agreed. The phenomenon of Spitzenkandidaten and its impact on the interinstitutional dynamics of the EU

The bachelor thesis describes the process of the enforcement of the Spitzenkandidaten procedure into the EU political system. An ambiguous definition of the relation between the Commission Presidential Candidacy and European election results, which emerged in the Lisbon treaty, led to the creation of a new political precedent that has real chances to remain for good among the EU procedures. This thesis will nevertheless show that suggestions that the victorious party should name its candidate for the Commission President are not new. Moreover, it will highlight that the process of the EP and the Commission getting ever closer is a result of a much longer process. The arguments for and against the new procedure will be presented and evaluated. A detailed insight into the European elections 2014 campaign, which had a partially different shape due to the Spitzenkandidaten process, will provide the reader with an answer to which extent the outcomes of the elections were actually influenced by this exact procedure. The same objective is borne in mind when the candidacy of Jean-Claude Juncker is evaluated, proving him to be, although elected not traditionally, a candidate-as-usual.
