Resolving Business Disputes over Contractual Obligations at the EU level.

The master thesis first deals with definition of business contractual relationship (sources, formation, freedom of contract) and indicates ways of resolving disputes arising from it within the Czech legal code. Through defining the concept of cross-border element the master thesis attains on how to resolve business disputes over contractual obligations at the EU level. Core topic of thesis deals with jurisdiction in commercial matters, the law applicable to contractual obligations, alternative dispute resolution as well as the recognition and enforcement of judgements or of different rulings. The last part of the thesis deals with a practical procedure which shows how to resolve dispute between domestic businessman and foreign businessman via legal proceedings.

Web applications testing

This diploma thesis matter is explanation of web application testing problems mainly to potential testers. That is why the thesis confides information gathered from different sources in intelligible way and it results from three years of testing and one year of teaching new testers mainly in Unicorn Corporation. The first part is dedicated to introduction to web testing; basic principles and history of internet, development process and methodologies are mentioned there. The second part deals with core aspects of testing and how they are viewed by various experienced testers from Czech Republic or foreign countries. In the third part there are chosen and introduced some techniques and tools suitable for web application. The fourth part contains practical example of some testing documents.

Horizontal liberalisation of free movement of services in the European Union

The area of interest of the thesis is the horizontal liberalisation of the free movement of services based on Directives No. 2006/123/EC on services in the internal market, No. 2005/36/EC on the recognition of professional qualifications, No. 96/71/EC concerning the posting of workers in the framework of the provision of services and No. 2000/31/EC on electronic commerce. More precisely the main subject matter can be defined as the shift in the basic legal regime of free movement of services achieved through these four directives compared to the original state, i.e. the general regime under EU primary law as interpreted by the ECJ. The main objective is to analyze and critically assess the extent and significance of this shift. The basic questions are: To what extent is the resulting legal framework formed by the four horizontal directives different from the original situation? Is it merely a codification of the case law of the ECJ or a result of legislator's efforts to liberalise further the regime? To what extent does the liberalised regime enable or support abuse of free movement of services in order to circumvent the national law of the host state? Determinants of Austrian International Trade: Econometric Analysis Based on the Gravity Model

The purpose of this thesis is to examine Austrian foreign trade and estimate this country's export function. The analysis is based on the gravity model in trade in log-log form, augmented by additional variables (adjacency, REER, institutional indices, etc.). Our panel dataset consists of 3396 observations of Austrian exports to 211 countries over the period of 1995-2011. First, we examine main export partners and SITC articles and we come to a conclusion that Austria is heavily oriented to Germany and SITC 7 (machinery and transport equipment). We employ FE and RE as estimation techniques and distinguish between them according to the Hausman test. We emphasise that panel data structure does matter and estimate the gravity equation twice - once as 17 cross sections and then as 211 time series. The most important determinants appear to be domestic and partner's GDP, bilateral distance, adjacency and a country being landlocked. Subsequently, we give different techniques to deal with zero and missing observations, and calculate relative trade potential realisation for year 2011. Most of the top-ten export partners seem to be over their potential.

Au-Au collisions at RHIC energies exhibit features suggesting that the system has undergone evolution through a stage of partonic matter. The hot and dense system created in the collision builds up substantial collectivity leading to rapid transverse expansion. In particular recent measurements show that Ξ and Ω baryons develop substantial elliptic flow. Properties of the induced flow strongly depend on whether the collectivity is achieved on partonic or hadronic level. Multi-strange baryons may be, due to their presumably small hadronic cross- sections, mainly sensitive to the early (possibly partonic) stage. The main objective of this thesis is to study femtoscopic π−Ξ correlations in Au+Au collisions at √ sNN =200 GeV and √ sNN =62 GeV recorded by the STAR experiment at RHIC. Measurements of momentum correlations of particles at small relative velocities are used to extract information about space-time extension of the particle-emitting source at the time of kinetic freeze-out. Non-identical particle measurements are sensitive not only to the size of the system, but also to an emission asymmetry between different particle species. Activation the deep stabilization of the spine in women after gynecologic operations

The theme of this bachelor work is the deep stabilizing spinal system activation of women after undergone gynecological operations. The deep stabilizing spinal system is the system which involves muscles participating in spinal stabilization in all daily life movements. The participation of these muscles is automatical,unconscious.Right coactivation is responsible for high quality setting and optimal pressure in particular spinal joints. Deep stabilizing system dysfunction is one of possible causes of vertebraegenic problems or wrong posture. We speak about pelvis bottom muscles,diaphragm,nucha deep ones,m.mulitifidii and m.transversus abdomonis. In spite of the fact that gynecological operations are carried out very carefully (abdominal way), they leave some changes on musculoskeletal system. I have chosen two most carried gynecological operations for my bachelor work/abdominal hysterectomy and Caesarean section. I have divided my work into two parts. The theoretical one is aimed at mapping available information about deep stabilizing system and gynecological operations. The research one is the core of the work. It is about practical research of deep stabilizing spinal system activation of women after gynecological operations and their profound analysis. The aim of the theoretical part of my bachelor work was mapping of available information about mentioned matter and the description of deep stabilizing spinal system. You can find there the description of particular parts of deep stabilizing system from the point of view anatomy and their function. Then there are described the possibilities of its examination and the last but least the methods used in activation. After the explanation what the deep stabilizing system is the theoretical part follows which is aimed at gynecological operations. I have tried to describe their indications, course and their possible complications. One part is about female sexual organs anatomy. The main aim of the bachelor work research part was brief description of the musculoskeletal system changes during therapy. I have applied the qualitative research method. Two women of different age and diagnosis have been chosen for my research. Therapy was carried out at their home environment in the period of 5 and 8 weeks. The research results were worked out in the casuistry forms which contain input and output kinesiological analysis, therapy course, short-term and long-term rehabilitation plan. The therapy was carried out once a week under the therapist supervision. Then the patients were instructed and trained in the right exercise set and they were given exercise plan for every day. After gynecological operations there were some changes in musculoskeletal system particularly in abdomen area exactly in the location of the cut. This area was not active entirely. There was not abdominal breathing. Activity of abdominal muscles was taken over by musculus rectus abdominis. Lateral groups of abdominal muscles (musculus obliquus internus abdominis,musculus obliquus externus abdominis and musculus transversus abdominis) were not activated entirely. Both patients learnt the right breathing sterotype and their deep stabilizing system was activated. Realizing their own body and how to operate with it was the result of the therapy. The therapy was finished with the form of output kinesiological analysis containing appropriate examination. The research proved the efficiency of activating deep stabilizing spinal system after gynecological operations not only from the point of view physiology, but from the point of view psychic too.

Legal regime of transboundary shipments of waste The aim of my thesis titled "Legal regime of transboundary shipments of waste" is to deliver a comprehensive analysis of legal aspects of cross-border shipments of waste. The thesis aspires to describe and interpret the various regulations and norms that govern this area, regardless of whether they are of international, European or national origin; it also evaluates whether the legislation provides sufficient tools for protection of the environment and whether the cross-border shipments of waste are desirable from the perspective of environmental protection. The thesis consists of eleven chapters. The first three chapters provide a theoretical introduction to the topic - chapter one contains the basic objectives and definition of the legal regulation of cross-border shipments of waste; chapter two outlines the fundamental principles of the environmental law and their applicability to the shipments of waste; and chapter three introduces the reader to the historical development of the subject matter in question. Contemporary Iroquois and their identity

This doctoral thesis deals with problems of identification of people who 1) consider themselves as Iroquois, or 2) are considered as Iroquois. The Iroquois are original inhabitants of North America living predominantly in the northeastern part of the U.S.A. (namely the State of New York) and in adjacent parts of Canada (provinces Ontario and Quebec). The thesis concentrates mainly on the process of identity or identities formation in the context of policies of the U.S. (and individual union states) and Canada (and individual Canadian provinces) which stipulate the legal framework for definition of membership of the group, rules for border crossing and jurisdiction in the reserves. Further the thesis examines the selfidentification of the Iroquois on the basis of kinship, place of residence, recognition or rejection of own political representatives and consequently fractioning of communities, religions, native languages, symbols, oral traditions and specific matters such as the game of lacross. A special emphasis is laid on boarding schools which formed the part of assimilationist policies of the U.S. and Canadian governments and exerted enormous influence on the shape of identity of the Aboriginal peoples. Classical Traditions in the Work of John William Waterhouse

This thesis deals with the selected topics and themes in the work of John William Waterhouse and its aim is to define the influence of classical tradition in his work, which has not been independently scrutinised. The second and the third chapter discuss the history of research of the work of J. W. Waterhouse, the specific problems associated with research, the aim of the thesis and artist's curriculum vitae. The core of the thesis is in the fourth chapter and consists of selected topics and themes from the work of J. W. Waterhouse: scenes from everyday life, dolce far niente, historical painting, water myths and ancient love myths. Their selection is based on the fashion preferences of displaying the antique motives in the 19th and early 20th century. In particular subchapters of fourth chapter the artist's paintings are compared with the works of his contemporaries and successors in Victorian England and partly in continental Europe. Comparison shows the differences in processing of subject matter, in used techniques, in linkups to the trends in art and in other elements. The end of each subchapter contains the summary of the results obtained from the comparison with the emphasis on the J. W. Waterhouse's contribution to the topic.
