The impact of Directive 2004/38 upon the free movement of nationals of the European Union with regard to relevant case-law of the European Court of Justice This diploma thesis deals with impact of Directive 2004/38/EC of the European Parliament and of the Council of 29 April 2004 on the right of citizens of the Union and their family members to move and reside freely within the territory of the Member States on the freedom of movement. The first chapter of thesis aims to cover main points of development of the right to free movement. From the right of workers as an economic factor to the general right of every citizen of Europe. As far as the introducing of the European Union Citizenship was very important point for the development of right to free movement, this chapter also concerns evaluation of this phenomenon. Further this chapter contains analysis of the most important cases rendered by the Court of Justice of the European Union which affected the right of free movement mainly since European Union Citizenship has been established. Political Debate about the Issue of Free Movement of People in the United Kingdom between the Years 2010 and 2016

This Bachelor thesis is concerning with the evolution of stances of four main British political parties, namely the Conservative Party, Labour Party, Liberal Democrats, and the United Kingdom Independence Party, towards the issue of free movement of people between the years 2010 and 2016. The thesis aims to analyse on the basis of chosen documents, mainly manifestos or speeches of the parties' leaders, how and why did the stance of each political party towards the freedom of movement changed over the chosen period and how the stances differed among the parties. Mostly two documents are analysed for every chosen milestone of the time period between the years 2010 and 2016. These milestones are general elections in the years 2010 and 2015, the end of the transitional period for Bulgaria and Romania at the turn of the year 2014 and the European Parliament elections in the year 2014. For showing a possible shift in the stances of individual parties towards the issue of free movement of people are their statements characterised on a six-level scale negative to positive, whereas the sixth level means the issue was not mentioned in the statement. Right of entry and residence on the territory of member states of the European Union

This thesis deals with analysis of EU rules on entry and residence on the territory of Member States. These rules are described from the perspective of different groups of people, EU citizens, citizens of EFTA Member States, family members or citizens of Turkey, and also from the perspective of Member States participating in the Schengen Border Area and Member States outside this Area. The core of this thesis consist is the analysis of four key EU rules in this field, namely the Border Code (Regulation 562/2002), the Visa Code (Regulation 810/2009), the 539/2001 Regulation and the 2004/38 Directive, as well as relevant case law of the Court of Justice, that influences the interpretation of the rules in hand significantly. The rules are also assessed from the point of view of principles of legal certainty and legitimacy.

Separatist tendencies in individual EU Member States and the potential impact on the free movement of persons in the EU This thesis deals with the separatist tendencies within the Member States of the European Union. It is therefore a case when a certain region within a Member State decides to secede from it. This needs to be distinguished from a situation when a whole Member State decides to withdraw from the Union. The aim of this thesis is to analyze the various possible scenarios in the case where there is a separation of that region from the Member State. It deals with it in the context of the regions potential continuity within the Union and furthermore it examines the differences between the two most important cases of possible internal secession in the EU of today: Catalonia and Scotland. The thesis evaluates the most probable scenarios in both cases and the consequent impact of such subjective secession of the regions on citizens and their rights in the EU context, in particular the free movement of persons. Beinlichová M. Czech labour market in relation to EU membership. Bachelor thesis. Brno: Mendel University, 2017. This bachelor thesis deals with the issue of international labour migration with the effect on the Czech labour market after the accession of the Czech Republic to the European Union. After the general introduction of basic concepts, this thesis provides an overview of the development of legislation concerning aliens on the territory of the Czech Republic and the Czech labour market. On the basic of statistical data, changes which have occurred in the development of the number of aliens on the Czech territory and in the labour market are identified here. Subsequently, the effects of these changes are evaluated. The findings are summarized at the end of this thesis.

Benefit tourism as a problematic aspect in the EU

Benefit tourism as a problematic aspect in the EU Benefit tourism is a topic which has gotten quite a lot of media attention lately, has influenced the lives of mobile EU citizens as well as the EU itself in connection with the brexit. The aim of this thesis is to provide the reader with a comprehensive portrait of the topic, and to explore how is this phenomenon reflected in the case-law of the Court of Justice of the EU. In addition to dealing with the political context and the notion of benefit tourism, this thesis explores the free movement of persons based on both, the economic and the non-economic basis. The focus of the thesis lays on the case-law of CJEU relative to the access of economically inactive EU citizens to the social assistance systems of the host Member States, particularly the judicial chain Brey - Dano - Alimanovic - García-Nieto. These judgments are revolutionary in a way, because for the first time, the Court took into account also the "public finances" argument which has been raised by the Member States for years and the CJEU has always been adamant on rejecting it in favour of wider interpretation of social rights.
