This thesis deals with the issue of equal treatment and prohibition of discrimination in labour relations. The principle of equal treatment and non-discrimination is one of the essential principles of labour law. Therefore, this principle is part of labour law at all levels - international labour law, labour law of the European union and national law. The author of this thesis chose this topic for its increasing social significance. The principle of equal treatment and non-discrimination is slowly becoming important social topic even in the Czech Republic. The thesis consists of four main chapters, which are further divided into subchapters. The first chapter briefly describes some of the essential concepts such as equality, discrimination, gender etc. Although these terms are commonly used, their description is important for better understanding of the topic. The other chapters deal with the law currently applicable in the Czech Republic. This thesis deals with the prohibition of discrimination in labor law relations on grounds of gender. Discrimination in labor law relations is only part of the broad issue of discrimination, but the importance of labor relations in the society makes this issue it very important. Discrimination on grounds of gender is specific in that it covers a wide range of social groups, and despite the long development and changes in society, which was achieved with great effort of many organizations and individuals, is still the subject to date. The objective of this thesis is to provide a comprehensive view on the issue by analysis of the evolution of sex discrimination in the historical context, analysis of current legislation and isolating social phenomena that have influence on this issue. RESUMÉ This thesis is concerned with equal treatment and prohibition of employment discrimination. I deal with international, European and Czech antidiscrimination law. The text is divided into an introduction, four main chapters, divided into subchapters, and a conclusion. The first chapter defines the fundamental terms, which are equality and discrimination. At first, I distinguish formal and substantive equality. In context of substantive equality, I explain the concepts of equal opportunity and equality of outcome. In the following part of the chapter I deal with the concept of discrimination. I describe the basic forms of discrimination: Direct and indirect discrimination. I also briefly discuss the issue of multiple discrimination. The second chapter concerns the most important international conventions that are related to my thesis topic. Those are the conventions of United Nations, Council of Europe and International Labour Organization. The third chapter focuses on the European Union law. In my thesis I concentrate on the topic of the equal treatment and the prohibition of discrimination. The reason why I have chosen this subject matter is for its topicality and constantly increasing significance. The equal treatment, as well as the prohibition of discrimination, has to be respected in labour relations to create respectable conditions for employees and equal opportunities for job applicants. In practice, these principles support also better productivity in a workplace, because the work environment, where the law is maintained, is the healthy and prosperous one. However, the reality is different and these principles are not always enforced. That is the reason why discrimination or unequal treatment still exist today and it is not phenomenon, which would be typical only for relations between employers and employees or job applicants. Therefore, the international, European and interstate legislation is evolving constantly in this area and it is changing in an effort to reach more efficient application in practice. Employment discrimination against foreign workers focused on the polish community in the Czech Republic

The subject of this thesis is the Employment discrimination against foreign workers, focused on the Polish community in the Czech Republic. It contains basic terms and definitions (equality, equal treatment, direct discrimination, indirect discrimination, harassment, sexual harassment, victimization, indirect or direct instruction to discriminate). The thesis also deals with the legislation of equal treatment and prohibition of discrimination on both European and local level. Subsequently, it attends to specific area of unequal treatment - employment discrimination against foreigners and discusses selected international studies that have addressed this issue in detail. The thesis is based on a qualitative and quantitative research of the discrimination against Polish community in their workplace. A questionnaire survey itself is followed by semi-structured interviews. The acquired data is analyzed and the specific aspects of behavior that the Polish workers deem discriminatory are identified. Resumé " The equal treatment and prohibition of discrimination in Labour law" This thesis deals with the principles of equal treatment and prohibition of discrimination, which belong to the most substantial principles of European and international law as well as in todays Czech law. These principles are dealt with in many international treaties, in the legislation of the European Union and also in the so called Czech Antidiscrimination Act 2009. Special emphasis is placed particularly on equal treatment between men and women and on the prohibition of discrimination on grounds of gender. The purpose of my thesis is to provide a comprehensive view on the issue of discrimination based on sex in labour-law relations. The aim of my thesis is to investigate why discrimination is still present in society despite all the effort made by the international organisations, legislators and non-governmental organizations. Therefore, the main objective of this work is to analyse the current position of women in society, the causes of why discrimination based on sex is emerging and to find out whether the status of women has improved over the decades and in which direction it is developing. The thesis is composed of seven chapters, each discussing different aspects of gender discrimination. The first chapter is an introductory part providing a brief look at the historical developments of the issue in the Czech Republic and abroad. My thesis is focused on the prohibition of discrimination in labor relations. This topic is very large and in future its content will continue to expand. Resume v Aj The purpose of my thesis is to analyse the issue of gender discrimination in labor relations and its prohibition, enumerate the ways of legislation and compare legislation with the actual situation in the society. The thesis is composed of two parts divided into nine chapters, each of them dealing with diferent aspects of the issue in question. The first part is a sort of general parts, including introduction, historical development and sources of law. The second part, which could also be called special parts, then contains individual aspects of the right to equal treatment, demonstrated in specific cases, particularly judgments of the European Court of Justice. The first and second chapter deal with the history and development of anti- discrimination issues and define the basic concepts. Resumé Equal treatment and non-discrimination are rules that are essential in international law, European law and national law. They are regulated in many international documents, in terms of European law, especially, in the regulations and directives. Czech Republic, as one of the member States of the European Union is obliged to ensure compliance of national law with European law. It was therefore necessary in order to ensure compliance with requirements of the EC / EU in the field of equal treatment and non-discrimination of employees that are regulated in anti-discrimination directives with our national law. This happened by adoption of Act No. 198/2009 Coll., Anti-Discrimination Act, which as a general law governing these principles. In my works I deal with treatment of these principles in the documents of international law and international organizations active in this area in the primary and secondary law of the EC/EU and also the current modification in our legal system.
