THE RIGHT TO STRIKE AND LOCK-OUT ABSTRACT The content of this thesis is to outline the issue of strikes and lock-outs in the Czech republic, both in terms of current legislation, as well as in future ones. On previous pages I try to describe strike actions from the historical and economic points of view, but I also try to compare their individual characters within the EU countries and to accent their specific features and patterns, which are typical for the state or region. I spent an essentional part of my work by studying strikes not modified by acts and the questions of their legality. I gradually evolved into a full knowledge of complete state of freedom of association in our country because of Judicial decisions I didn't know before. I drew my conclusions primarily from literature, articles from distinguished academics and renowned experts and of course from court cases. The importace of legislative was relative because the lawmaker did not fully explore this area. I describe strikes and lockouts as a general phenomenon, whose presence is desirable in every developed community. But I also realized the individual typological aspects of employment law entities. Rigorózní práce Kolektivní vyjednávání Mgr. David Kavan Abstract The thesis deals with the collective bargaining as it is nowadays (the thesis reflects the status as of September 1, 2014) understood and regulated by the Czech law. This understanding and regulation has been compared to the understanding of the collective bargaining under the documents of the public international law. The thesis focuses on the legal regulation of the collective bargaining and of other legal issues that are of importance for the collective bargaining as they can be found in the Czech national law, in the public international law and in the sources of the European law. The author has been dealing with the persons and entities that are concerned by or involved in the collective bargaining and with the different levels the collective bargaining can take place at. He has been describing also the procedure of the collective bargaining and the proceedings that apply within its framework. The author has been concentrating on the collective agreement as well, as it is the typical and most important outcome of the collective bargaining. At the end the thesis focuses on the situation where the parties to the collective bargaining are not able to reach their consensus on the collective agreement and on the legal instruments they can use...

Resumé Das Ziel dieser Diplomarbeit war die Zusammenfassung der bestehenden Rechtsregelung von dem Tarifvertrag und zugleich die Entwicklung der Rechtsregelung von den Tarifverträgen. Ich habe gleichzeitig auf die bestehende Rechtsregelung des Tarifvertrags hingewiesen, wie diese Regelung in der Bundesrepublik Deutschland geregelt ist. In den ersten Teil meiner Arbeit habe ich mich mit der historischen Entwicklung von dem Kollektivarbeitsrecht zu der Analyse der bestehenden Rechtsregelung befasst. Der nächste Punkt war die Verankerung des Kollektivarbeitsrechts in der tschechischen Rechtsordnung, die von dem europäischen Recht und von den internationalen Verträgen, durch die die Tschechische Republik in diesem Gebiet gebunden ist, beeinflusst wird. Ich habe mich weiter mit dem einsamen Begriff von dem Tarifvertrag und mit den Begriffen befasst, die mit den Tarifvertrag zusammenhängen. Es geht vor allem über die Begriffe wie die Subjekte von den Tarifverträgen, was der Inhalt von Tarifvertrag sein kann, welche die gesetzliche Voraussetzungen für die Gültigkeit und Wirksamkeit des Tarifvertrags sind, die Speicherung des Tarifvertrags und die Bekanntmachung mit dem Inhalt der geschlossenen Tarifverträge. Vedoucí práce doc., JUDr. Jan Pichrt, Ph.D. The aim of the thesis is mainly to highlight the level of coverage by collective agreements in the CR and to analyze the impact of collective bargaining for employees and employers using available statistical data. By the evaluation of the processes of collective bargaining and focusing on its individual institutes I am looking for the perfect method of handling the collective bargaining so as to be beneficial for both parties involved, and try to present the method how the modern trade union should work in its interaction with the employer, different from the common practice of today's trade unions. I also point out the need for proper analysis of the situation prior to collective bargaining and the method of selecting strategy for negotiations. I chose the topic based on my personal experience with the representation of employees and involvement in the collective bargaining and also on the experience of participation in the EWC.

This Bachelor Thesis entitled ”Problems of the remuneration system of the Municipal office of the town of Jihlava employees” analyses current state of remuneration system of this subject of public administration and proposes its improvement. In the first theoretical part, important terms of remuneration are explained; the second practical part is focused on specific system of remuneration of the Municipal office of the town of Jihlava. The system was thoroughly analysed and evaluation of the employees’ satisfaction with this system was examined with opinion pool.
Position of trade unions in labour relations

The topic of my bachelor thesis is the position of trade unions in labor relations. In my work I deal with different powers of trade union, collective bargaining and concluding collective agreements. Further I define the notion of collective and individual disputes. Disputes arising from collective agreements and contract disputes shall be resolved by proceedings before the arbitrator and mediator. Unlike the disputes of collective agreements may be in dispute on the conclusion of collective agreements used as a last resort strike, but only if it was not brought before an arbitrator. The main task of trade unions is the protection of employees.

My bachelor's work is about the employment terminated by an employer. It describes the rights and duties of employees and employers in the process of employment. It tells the reader about the possibilities of terminating the employment. The bachelor's work also deals with the claim of the employee for compensation money, it also shows the advantages of collective agreement. It explains when the termination of the job is not valid. The legal regulation of the employment law in case of students, employees and employers has been identified by the means of survey.
Analysis of the employee Benefits in Specific Organization

The main subject of my Bachelor's Thesis called "Analysis of employee Benefits in Specific Organization" is to analyze system of employee benefits used in company RWE Transgas, a. s. in 2010. Theoretical part will specify basic terms in general, which are important to cope with this issue. There will be especially importance, division, risks and trends in benefits. In practical part the analysis of employee benefits in specific joint-stock company is made. Part of this analysis is survey done by questionnaire to verify preferences of employee benefits between selected employees. Results of research will be compared with current trend in provision benefits and nationwide research done by company Robert Half International. By results provided some new employee benefits will be suggested to organization to motivate employees and to give tax advantages to organization.
Relation between Co-operatives and Trade Unions

The aim of this bachelor thesis is to assess the current status of consumer cooperative in relation to the trade union. Furthermore, to establish the importance of the trade union within the cooperative, organization of the trade unions and cooperative involved in its structure, identification of the areas with the key role of the trade union (labour relations etc.) and the position of the trade union in the cooperative in comparison to the situation in multinational chains.

V teoretické části práce jsou specifikovány a charakterizovány klíčové oblasti problematiky kolektivního vyjednávání a kolektivní smlouvy vůbec. Praktická část analyzuje pomocí těchto tématických celků konkrétní skutečnosti a jevy ve společnosti GCE, s.r.o., kde působí příslušná odborová organizace.
