Protection of personal rights in continental system and common law

With the increased global infringement of personal rights, it is necessary to be aware of the protection in the different legal systems, especially Anglo-American. Even if the consequences are to be felt in the domestic legal order, the enforceability is recognized under the foreign legal order. The protection is worldwide and through the case law from the European Court of Human Rights the two legal systems - Common law and the Civil Law are penetrating the legislation and the case law in respect of the institute of the protection of personal rights. The doctorate thesis presents the complex introduction to the area of protection of personal rights in the Common law, especially in English law, Commonwealth countries and USA that has not been presented yet for the Czech legal professionals. The thesis explains theoretical concept of the Common law and its background for the purpose of explanation of differences of examined legal orders. The institute is explained on the key historical case law that led to establish the Common law principles. The thesis uses the current and topical legal cases and problems that the orders face in the 21st Century.

Radoslav P a s s i a Aesthetics of Periphery and Border (To Selected Aspects of Periphery and Border Phenomenon in Slovak Literature of the 20th Century in Central European Context) Abstract The dissertation deals with selected aspects of periphery and border phenomenon in Slovak literature of the 20th century in Central European context. In the preliminary chapter Border the author focuses particularly on selected texts by Central European writers which are thematically set in the Eastern Carpathians. This radically multiethnic region is considered to be one of the relatively independent cultural areas of Central Europe by the author. Narrative perspectives of a stranger, outcast, migrant in combination with the themes of border and conflict between vernacular and alien are characteristic for the literary image of the Eastern Carpathian border area in the 20th century. The author looks at the way the literary appearance of this area is ideologically deformed in the works of individual authors. The writers (mainly Czech and Polish) who do not come from the Eastern Carpathian border area use characters of strangers to reflect on the relationship between the modern and the traditional. The Avant-Postman: James Joyce, the Avant-Garde, and Postmodernism

The thesis, entitled "The Avant-Postman: James Joyce, the Avant-Garde and Postmodernism," attempts to construct a post-Joycean literary genealogy centred around the notions of a Joycean avant-garde and literary experimentation written in its wake. It considers the last two works by Joyce, Ulysses and Finnegans Wake, as points of departure for the post-war literary avant-gardes in Great Britain, the USA, and France, in a period generally called "postmodern." The introduction bases the notion of a Joycean avant-garde upon Joyce's sustained exploration of the materiality of language and upon the appropriation of his last work, his "Work in Progress," for the cause of the "Revolution of the word" conducted by Eugene Jolas in his transition magazine. The Joycean exploration of the materiality of language is considered as comprising three stimuli: the conception of writing as concrete trace, susceptible to distortion or effacement; the understanding of literary language as a forgery of the words of others; and the project of creating a personal idiom as an "autonomous" language for a truly modern literature. Magic fairytale and its metamorphoses in works of 17th to 19th century

Abstact This bachelor thesis focuses on examining the development of fairytales with an emphasis on literary adaptations of magic fairytales of the 17th to the 19th century. It consists of theoretical and practical parts. The first chapter discusses the basic characteristics of fairytales, its definition, features, classification. Furthermore, the work deals with theories about the origin of folktales and ways of their analysis from a scientific point of view. At the end of the this part fairytales are analysed as a literary genre. The second part represents writers Charles Perrault, Brothers Grimm, Karel Jaromír Erben Božena Němcová. Each of these authors approaches to their fairytale works in a different way, which is described in this section. In chapters of each writer, we first learn about their biography, as well as the time in which they lived, along with its historical and social background and last but not least, with their literary production with an emphasis on fairytale work. The last chapter contains a practical part of thesis. There is comparison of two magic fairytales, that appear in the works of authors from the second chapter. Karel Krejčí's Comparative Approaches in his Understanding of Czech and Polish Literature

The thesis documents and interprets the conflict between the literary discourses of the time on the one hand, and the specific approach of Karel Krejčí (1904-1979), comparatist, Slavist and Czech studies scholar, on the other hand. Based on the Krejčí's studies on literary history and comparative literature, as well as his participation in the methodological debates of his time, the thesis analyses the impact of this conflict on the author's literary theory method, and his work of a literary historian and comparatist in general. The analysis is based on the ambiguous reception of Krejčí's scientific work: while he is recognised as a great personality in the field of Slavic studies, he is considered an outsider in the general context of Czech literary science. The thesis describes how the author, with his methodological approach, was in opposition to the prevailing trend. As a Slavic studies scholar he criticised the 'influence science' and positivist methods employed in the field. In the period between the two world wars he inclined towards the sociology of literature, although this discipline did not become popular. Three stories between East and West: "Virtuous young man", "Divine lover", "Sacrifice of a child"

The thesis deals with the realization of three narratives -"Virtuous Young Man", "Divine Lover", and "Sacrifice of a Child"- in diverse literatures of East and West. Basic form, characters/(arche)types, and motifs and their possible variations depending on cultural, literary, and religious/mythological setting are presented for each plot. Using historical and comparative poetics, each plot is analysed from the first extant adaptations in European and non-European literatures to the modern ones. The thesis puts an emphasis on specification and configuration of particular motifs, variations depending on the religious-mythological context, and tension between the same and different, general pattern and specific realization, type and character.

Narratologic research of folk tales

The thesis focuses on the investigation of selected world fairy-tale analyzing the topics of psychology and cultural anthropology. The subject of the thesis is literarily-theoretical meta-analysis of narrative structures and their relative comparison. Theoretical part of the thesis includes four major chapters, in which there are more specific descriptions of fairy-tale dilemmas and also the analysis of several European fairy-tales. The practical part then specifically analyses Australian, Japanese, Chinese, Gypsy, and Indian fairy-tales.

Multimedial Reading-book of Folktales

The thesis involves the usage and definition of folktale in theory and practice. The thesis consists of theoretic and practical parts. The theoretic part briefly deals with comparative law that used the folktale as one of the suitable material to study. It also compares different attitudes of defining and classifying folktales. Afterwards in the theoretic part there is introduced the influence of folktales on the pre-school and middle-school children. One part is devoted to narratology as a theory of narration and to particular kinds of folktales. The practical part introduces the preparation of worldwide folktale reading-book. It contains the way of selection of the literature, the structure of particular chapters of reading-book and creation of CD. Further there is the chapter Methods of active teaching, where the methods, responding to the trends of nowadays education, are introduced. The practical part ends with two chapters from the prepared reading-book, devoted to Italian and Greece folktales. The chapters fully correspond to the structure of the prepared reading-book. They also contain worksheets using some methods of active teaching.
