Victims of Domestic Violence, Particularly Criminological and Criminal Law Aspects

The aim of the thesis was to summarize the issue of the victims of domestic violence in the Czech Republic, including the legal development of the recent years, concerning particularly the criminological aspects of the issue as well as the criminal law aspects. The opening part deals with defining concepts such as domestic violence, victims, aggressors, their personal psychological aspects and legal terms - endangered person ("ohrožená osoba") and violent person ("násilná osoba"). The second main section of the thesis pays attention to the legislation on the help and support given to the victims of domestic violence in the Czech Republic, not only dealing with the immediate help given by the police and the judiciary in the form of the order-out decision of the aggressors from the common home, but dealing with the longterm psychological and social support offered by the intervention centers as well. The third basic part of the work focuses on the criminal law aspects of the domestic violence phenomenon, particularly current practice of the courts and rights of the victims as the aggrieved parties in the criminal procedure. Domestic violence and its prevention My Master's degree thesis is titled "Domestic violence and its prevention". The purpose of my thesis is to present the domestic violence as an important phenomenon which our society contends with. The domestic violence represents a problem which has an essential influence on its victims, it causes substantial effects on their private live, family relationships and also their health. The thesis is composed of eleven chapters, each of them is subdivided into several subchapters. Opening chapters deal with the criminological aspects of the domestic violence, subsequent chapters concern the legal matters regarding the domestic violence. Final chapters attend to the prevention of the domestic violence and analyze the occurrence of the domestic violence in the Czech Republic. Chapter One is introductory and raises basic issues connected with the topic of the domestic violence. Resumé (Aj) Domestic violence - in particular, criminological and criminal aspects The domestic violence is a significant societal problem which requires the attention of every state. But this opinion did not prevail in history. Although the domestic violence appeared across all social strata and historical periods, it was viewed as private problem of the family. In the Czech Republic the domestic violence has started to be considered as a public affair in last years. Nowadays the state guarantees especially a protection to victims of domestic violence. The legal order of the Czech Republic contains several acts affecting the domestic violence. The regulation of this phenomenon can be found in both private and public law. The aim of my thesis is to provide an integrated view to the domestic violence issue focusing on criminological and criminal aspects. This thesis is divided into eight chapters. First I tried to define a fundamental characteristics of domestic violence, then I turned my attention to the victimilogy and mainly to victims of domestic violence and impacts of the violence on their psyche. 1 Summary The topic of the diploma thesis is "Domestic violence and its prevention". The thesis is therefore divided into two parts - the first part dealing with the phenomenon of domestic violence and the second one focused on possibilities of prevention de lege lata and de lege ferenda. The main aim of the diploma thesis was to provide a general overview of this matter, analyze chosen aspects of domestic violence, emphasize related actual or controversial issues and after comparison with the foreign legal orders to suggest possible regulation of the issues not regulated. The presented diploma thesis consists of six chapters, each one dealing with another aspect of domestic violence. The first chapter should provide an introduction to the topic, define the scope of domestic violence and its features, explain principle of the cycle of violence and concentrate as well on the victimology. The second chapter scrutinizes the types and forms of domestic violence. English abstract Domestic violence in society This thesis is divided into two parts to reflect the definition of domestic violence as a very broad social (gender) and legal term. The opening chapter provides an introduction to the theory of domestic violence along with en explanation of its elementary features and concepts. The chapter describes domestic violence as a societal problem which - in the light of statistically proven (and surprisingly frequent) occurrence and presumptive high latency - cannot be put aside as a marginal pathological phenomenon. Such (erroneous) conclusion, however, is tempting since there are many myths around intimate violence, as is a general misapprehension that both victims of domestic violence as well as persons abusing their close relatives can be unmistakably identified. The author of this work aspires to refute such conclusions by pointing to criminological as well as victimological specifics of a person that is the victim or perpetrator of domestic violence. Resume Main goal of this bachelor thesis is to create interpretation and deep literary analysis of two-thread novel Kobold. Author of the novel is Radka Denemark, one of the most respected Czech writers. In chapter Autorka are summarized biographical data relevant for the novel or important for understanding of Denemark's value and her ability of writing. Next chapter is Kontext vzniku díla. This chapter describes background of the Kobold's creation and factors which affected its origins as well as final form. The feminism and woman-oriented literature are the main topics of the chapter. Following parts are about genre of the two-thread novel and define its title and subtitles. Next two chapters have the same composition and analyse each of two storylines. Name of the first is Přebytky něhy. (O vodě.) and name of the second is Přebytky lidí. (O ohni.). Concern of both is in storyteller, characters and direction of storyline as well as analysis of cultural and geographical background of it. v anglickém jazyce Criminal aspects of domestic violence The subject-matter of this thesis are criminal law aspects of domestic violence that is why the focal point of my work is in an analysis of criminal law regulation of domestic violence and criminal offences committed in connection with it. Beside that I have tried to provide a general review of a phenomenon called domestic violence, of its character, basic attributes, types, effects and controversial issues. One chapter is about the regulation of criminal procedure, particularly about a victim's right of disposition and the new Victims of criminal offences Act. In the last chapter I have tried to analyse a few cases and show the most important criminal aspects of this issue.

Domestic violence and its prevention The thesis is concerned with the problematics of domestic violence and its prevention. The aim of the thesis is to analyze the legal institutes that are provided by the Czech legislation for protection against domestic violence. The thesis is divided into six chapters each of which adresses special aspects of the problematics. The first chapter introduces the phenomenon of domestic violence. It tries to define the notion of domestic violence, describe its features and forms so that these pieces of information can be used in further parts of the thesis. Subsequently, it deals with theories that try to explain the causes of domestic violence. The second chapter is concerned general characteristics and personal traits of the perpetrator. Attention is also dedicated to gender aspects. The third chapter concentrates on general characteristics of the victim and adresses the process of victimization, i.e. the transformation of a potential victim into a real one. Primary, secondary and tertiary victimization are to be distinguished. The next part describes the mental consequences of the victim of domestic violence.
