Copyright legislation of the Czech republic

In this digital age we meet copyrighted contents on a daily basis and we often work with them and use them for different purposes. Lack of knowledge about the copyright legislation may often lead to complications, sanctions and sometimes may end up at court. The aim of this thesis is to describe the legislation of copyright in the Czech Republic. Main parts of this thesis are supposed to describe the development of copyright legislation (mainly twentieth century), including international treaties, which have influenced the copyright legislation and also to describe the current copyright legislation in the Czech Republic. Particularly with focus on author's work, author, copyright, exceptions and limitations to copyright, rights related to copyright and collective management of rights. For the purpose of both aims I have just described I have used the official legislation and appropriate publications about the topic. Another aim of this thesis is to mention the problematics of copyright regulation of copyrighted contents shared through the Internet, where I have used works of recognized professors, who had been focusing on this topic for years. Regulation of tobacco advertising and its impact on the selected media in the Czech republic

The thesis deals with regulation of tobacco products advertising and its impact on selected media houses in the Czech Republic. First part of the thesis is dedicated to the history of smoking, to tobacco advertising in general and to description of negative effects on human health. Major tobacco companies present in the Czech market since 1993 are introduced. Moreover legislative development in the area of tobacco advertising which took place in three phases between years 1995 - 2004 is described. Part of the thesis focuses also on the context of the ban on tobacco advertising on the EU level, which became effective as of July 2005. Second part of the thesis deals with impact analysis of increasing tobacco regulation on selected Czech media. As for the television broadcasters, the Czech Television and TV NOVA are analyzed. For printed media, the impact is depicted on the case of newspapers Mladá fronta Dnes and Lidové noviny. Significant part of the thesis is dedicated to analysis of advertising data and to the description of changes in the marketing and communication strategies of four biggest tobacco holdings, including the analysis of how they have addressed the issue of limited communication opportunities and how they have overcome the ban of tobacco products advertising. Media and criminal procedure

The theoretical part of the Bachelor thesis covers legal circumstances regarding a media activity of providing information about criminal procedures. First, it describes the principles of the constitutional law, specifically, the right of information, the prohibition of censorship, and freedom of speech. Then, it analyzes the concept of a criminal procedure and its basic principles. Mainly, it describes the public policy of the trial and the presumption of innocence. The main part of the thesis analyzes individual provisions of the Code of Criminal Procedure, which regulate the range of publishable information about criminal procedures, the offender and the victim. Separately, the same problem is described according to the Code of Judiciary with Youth. The practical part of this thesis uses quantitative and qualitative content analyses of the articles from two Czech magazines - Právo and Blesk. The quantitative analysis examines the topic of this thesis through statistical and mathematical methods. The qualitative analysis researches individual articles and focuses on compliance with the law.
Czech and Austrian media law with emphasis on austrian media act

As a result of current, historically unparalleled, media development, the states of European Union are forced to deal with new fundamental questions in the area of media regulation. Those questions are mainly; (i) can legislature of the EU member states react quickly enough to the technological development and (ii) how does the EU media legislative affect law of member states? In the presented work, answers to the above mentioned questions are based on a commented comparison between sources of the media law in Czech and Austrian constitutional systems. Besides the comparison, the work contains also an explanation of the basic concepts of the legal theory as well as a brief introduction to the historical development of the media law in both the countries. To the best of authors' knowledge, the present study is the first work aimed at comparing the media law of Czech Republic with another EU member state and it may be used as a basis for a discussion on a topic of Czech media law quality.
Legal regulation of the product placement a its utilization by the czech television

The main aspects of this thesis is the analysis of the legal regulation of the product placement and its utilization by the Czech television. Czech law comes from the Directive 2007/65/EC of the European Parliament and of the Council, therefore several chapters are dedicated to secondary law of the European Union. The last part of this thesis includes few ideas about the law de lege ferenda. The second part of this thesis consists of the application of the product placement by the Czech television and there is a comparative analysis with selected television shows from around the world. The comparison is made with the similar shows in regards to their format and style. The result is a recommendation how to apply product placement in the future and kind of mistakes could be prevented.
Case of Anna Janatková's murder in czech media with the emphasis on its objectivity

Thesis deals with media objectivity on the example of four Czech newspapers. Thesis in its theoretical part focuses on definition of media, journalist's role and their job which is influenced by many factors, socio-cultural context in which news production is implemented, outlines concept of media objectivity and describes media image of crime. Another part of thesis explains the terms concerning criminal procedure, qualifies rights and duties of criminal justice and a suspect person and finally concentrates on providing with information about offence by media and difficulties which can be appeared. Practical part of the thesis analyzes media objectivity through qualitative analysis of articles. Articles were chosen from four Czech newspapers (Aha!, Blesk, Mladá fronta Dnes, Právo) and two time periods: October-November 2010 and March-April 2011. Research question asks: Did chosen newspapers inform about a murder of Anna Janatková in an objective way? Objective way of informing is examined in relation to rights and duties of suspect and to protection of victims.
ACTA as an attempt for international law regulation of the internet.

This thesis deals with international Anti-Counterfeiting Trade Agreement, also known as ACTA. It came to attention of public and media in the beginning of 2012 and its ratification in the European parliament had been preceded by extensive protests. The thesis concentrates on the topic of Internet as a worldwide spread independent media and the way ACTA was supposed to interfere with it in the name of copyright defending. The aim of this work has been to create a comprehensive file about ACTA which could serve as an introduction to this issue and also as a minimum for further studying of this subject. The background of preparation of this agreement is described in the first part as well as its accepting in the EU - with emphasis on the Czech Republic - and also similar American bills PIPA and SOPA are mentioned. The second part is addressing the very content of the agreement. The meaning of chapters and sections of ACTA is briefly explained, described is the present law adjustment of the Internet, mainly the law protection of intellectual property on the Internet. The objections of public to ACTA and their evaluation in terms of validity are added in the thesis, too.
Enactment of so-called "muzzle act" and its impact on czech media

This thesis deals with the Act no. 52/2009 Coll., which amends the Act no. 141/1961 Coll. (Penal Procedure Code), as amended by latter Acts, and some other Acts. Because of its alleged censorial character, it was often referred to as the "Muzzle Act" by local media. The thesis is composed of five parts. The first one describes methods used in the rest of the text, the second one explains main theoretical concepts and essential topics that are important for understanding the other parts - right to privacy, right to information, publication of transcripts obtained by eavesdropping devices etc. It also describes contents of the "Muzzle Act" and its amendment. The third part reviews how the Act passed the legislative process in both chambers of the Parliament, including protests of media and some scholars against it. All the main reasons why protestors considered the Act censorial or even unconstitutional are drawn up in the fourth part of the thesis. It also sums up thoughts and confronts thoughts of people who argued in favour of the Act. In the fifth part, journalists from Czech News Agency (ČTK), daily newspaper Mladá fronta DNES, weekly magazine Respekt and news website Aktuálně.cz describe how the Act influenced their working habits and contents of their media. Protection of Crime Victims and the Media: Publishing of Mistreatrd Chidren Information before and after Passing the Law of Criminal Procedure Amendment in 2009

The thesis Protection of Crime Victims and the Media: Publishing of Mistreated Children Information before and after Passing the Law of Criminal Procedure Amendment in 2009 deals with the problem of secondary victimization caused by the media. More specifically, it focuses on the mistreated children and publishing that kind of information about them which enable their identification. It is concerned with the nationwide daily press and compares the situation before and after passing the Law of Criminal Procedure Amendment in 2009. This amendment introduced measures towards better privacy protection of crime victims with a special respect to underage victims and victims of some exceptionally serious crimes. The thesis compares the occurrence of information which enable identification of mistreated children in 2008 and 2011 in the three most popular nationwide dailies - Mlada fronta Dnes, Pravo and Blesk. It is interested in the following information: names and surnames of the victims and their family members, residence location, photos of the victims, their family members and their residence location. Legal Regulation of the Radio and Television Broadcast in the Czech Republic

The thesis Legal Regulation of the Radio and Television Broadcast in the Czech Republic deals with an analysis and description of relevant legal regulations applicable in the area of broadcasting and television in the Czech Republic and with a closer insight in the main legal institutes and entities. A theoretically-juridical opening is followed by an introduction of the Czech Republic and European Union legal systems. The core of the thesis is the main topic, which is the legal regulation of the radio and television broadcasting in the Czech Republic. This part is opened by a short historical abstract followed by chapters dedicated to particular legal regulations. The Broadcasting Act, the Act on Czech Television, the Czech Television Code, the Act on Czech Radio, the Czech Radio Code and the Act on Audio Visual Media Services upon Request are described in individual chapters. The closing part is dedicated to some of the legal regulations and their provisions that are more remotely related to the subject. Individual chapters describe relevant legal institutes of the Act on Advertising Regulation, the Advertising Council Code of Ethics, the Consumer Protection Act, the Commercial Code and the Civil Code.
