Selected issues of proving in criminal proceedings

1 Abstract This thesis deals in particular with the analysis of the process of presentation of evidence in penal proceedings, its basic principles, as well as the constitutional limitations within which the evidence-making process should be carried out. However, some other questions, especially legal and philosophical ones that are directly related to the presentation of evidence in the penal or legal proceedings cannot be ignored. The chosen topic can undoubtedly be considered to be very topical. This is because the presentation of evidence in penal proceedings is, besides the decision-making process itself, the most important procedural activity carried out by the bodies responsible for penal proceedings and participated by other entities involved in the penal proceedings. The aim of this thesis is to give a brief and comprehensive overview of some specifically selected problems of presentation of evidence in penal proceedings. Naturally, with regard to the chosen topic and its scope, it is not possible to comprehensively process all the areas that are related to the issue of presentation of evidence. Legally Philosophical Aspects of Searching for Truth in Civil Procedure DIPLOMA THESIS Viktor Gazda Abstract The aim of this thesis is to discuss certain legally philosophical aspects of fact- findings in civil procedure. In a simplified way, this work is focused on exploring the possibility of determining the value of truthfulness of quaestio facti when applying law. The six chapters of the work include three basic themes. The first one examines the reflection of the philosophical concepts of truth in the process of determining the facts of a case, the second one clarifies the nature of the ideological aims of fact-findings in the form of principles of formal and substantive legal truth and the third topic deals with the nature of a judge's beliefs in the truthfulness of factual claims and the role of probability in the judge's belief At first I briefly present the phenomenon of truth in a wider philosophical context so that I can then proceed to outline the selected theories of truth. After explaining the basic essence of the legal procedural principles which have the greatest impact on the process of finding the facts, I pass, in another part of the thesis, to the very analysis of these principles through the prism of selected theories of truth. I perceive the thesis as a result of long-term considerations of forms of lies and manipulation and their importance in today's society. Based on the research of these forms and the environments in which they occur, I try to detect the effect of the lie on both individuals and society. Philosophical Writings on Art and the Truth

The aim of this thesis is to study the subject of art (especially music) and its connection to the truth. The effort is also to determine what is meant by the truth. But all this reveals the real and noble goal of this thesis: to try to capture all the questions that arise in connection with art and the truth and trying to search their proper philosophical answers. All this takes place within Friedrich Nietzsche's early philosophy, with his inspirations: Arthur Schopenhauer (we will touch the influence of Kant's philosophy on Schopenhauer's philosophy, too) and the composer and at certain time Nietzsche's personal friend - Richard Wagner, whose lesser known writings will be also introduced. It turns out that these arising questions touch on such topics as: abstract rationality and language in contrast to artistic creativity and direct experience, subjectivity or objectivity in art, the special nature of philosophy, existential issues, and issues of a higher sense of human life.
