Title and Abstract: The Application of the Charter of Fundamental Rights of the European Union by Administrative Courts in France and in the Czech Republic: Comparative Analysis This thesis contributes to filling the gap in empirical research on the application of the EU Charter of Fundamental Rights by ordinary national courts, choosing Czech and French administrative courts as its focus. It builds on and goes beyond the existing literature by developing a coherent narrative centred around three key themes in the decision-making of Czech and French administrative courts: the Charter's applicability, its role in the reasoning and its interactions with other legal rules, such as EU secondary legislation, the ECHR and national constitutions. The primary aim is to gather data on when and how these courts give effect to the Charter in their decision-making and to evaluate this data from the three perspectives mentioned. The evaluation is made from two complementary angles. First, and unsurprisingly, it will concern itself with the extent to which national courts comply with the obligations imposed on them by the Charter and EU law. The present report, the principal output of the TAČR project No TL04000052, critically analyses the possibilities for an EU response to contagious diseases, as they stem from existing EU law and, also, from the new legislative drafts, in particular those related to the European Health Union project. On the grounds of this analysis, further steps are recommended that would be appropriate in the light of the experience of the Covid-19 pandemic, in particular in the area of the division of competences between the EU and the Member States, in the area of early warning and response, in the area of building strategic autonomy, in the area of movement of people at the EU's internal and external borders and in the area of movement of goods.
The Right to the Protection of Personal Data in Article 8 of the Charter of Fundamental Rights of the European Union

This thesis deals with the fundamental right to the protection of personal data as enshrined in Article 8 of the Charter of Fundamental Rights of the European Union ('the Charter'). An analysis of the case law of the Court of Justice of the European Union (CJEU) on Article 8 of the Charter reveals an intriguing paradox: although this provision has been repeatedly invoked in order to enhance protection of personal data and has featured prominently in several far-reaching judgments (Digital Rights Ireland, Google Spain or Schrems), there is considerable uncertainty as to the substantive scope of the right to the protection of personal data. The relationship between the right to privacy and the right to data protection has proved difficult to untangle, and the autonomous nature of Article 8 of the Charter has not always been respected. The aim of the thesis is to analyse the purpose and content of this fundamental right with reference to the CJEU's case law and recent academic debate. This thesis is divided into four chapters. Refugees: the problem of Second Republic

This paper deals with the issue of refugees who had to leave boarder regions of Czechoslovakia in 1938 after Germans occupied them as a result of the Munich Conference. It analyzes their numbers, motivations, professions etc. and then focuses on the management of refugee care. It tries to characterize the basic attributes of the care and especially concentrates on their feeding, clothing, employment, emigration and medical service. From September 1938 to March 1939 almost 200 thousand refugees escaped to reduced Czechoslovakia (so called "Second Republic") which caused serious problems. There was confusion in the country but authorities in cooperation with NGOs and private companies managed to provide refugees with basic accommodation, clothing and feeding. However, their employment and permanent settlement remained, due to the economic problems of the state and winter season, which made seasonal works impossible, unsolved till German occupation in March 1939.
