The Protectorate of Bohemia and Moravia: law as an instrument of Nazi expansion

The thesis deals with the role of the law in the Protectorate of Bohemia and Moravia (1939-1945) during its economic exploitation, Germanisation and categorisation of the population as a prerequisite for an end solution to the so-called Jewish and Czech question in the plans of the Nazis. It focuses on forming this "law of lawfulness", its content and enforceability and comes to the conclusion that rule-making at that time played an important, above all, organisation-related role in implementing occupation order, however if this was an obstacle to rapid and radical solutions, it became a burden which the Nazis replaced with injustices in the form of special treatment (Sonderbehandlung) of martial law, executions and deportation to concentration camps. An example of the instrumental abuse of the law on behalf of the Nazis to pursue their expansion plans leads us to the general conclusion that to safeguard against abusing the law to control others cannot rely on the law alone, but also requires a democratically functioning society and a conscious historical memory of nations. The developement of the body of public prosecution between 1848-1952

The history of the body of public prosecution on the Czech territory has its roots in the late middle age. First prosecutor was named by the king Zikmund in 1437 and his main task was to help the king to regain the property he had lost during the religious wars. As the time was passing by, the king's prosecutor's agenda was slowly expanding. Soon he became authorized to pursue the perpetrators who committed crimes such as manslaughter, murder, heresy, offence of the king or counterfeiting. However with the succession of Habsburg dynasty his role has weakened since the crime proceeding got back to the principle of inquisitorial process which accumulates the role of judge, advocate and prosecutor in one person. In the revolution year of 1848 the Habsburg monarchy was forced to reorganize the justice system due to massive political protests. At the very same year the first public prosecution offices were founded in order to pursue crimes committed in relation with press. In 1850 the competence of state prosecutor expanded - from now on he was authorized by the law to prosecute all crimes that were to be tried in front of the court of justice and to represent the indictment in front of it. The investigation of political delinquency of Czechoslovakian military personnel in the years 1948 - 1989 Abstract The primary objective of this dissertation is to reconstruct the investigation of political delinquency in the environment of military forces. The text is focused on the persecution of military personnel in the years 1948 - 1989. The key issue is described in the broader context of the socialistic legal system and contemporary structure of power and political development of the Czechoslovakian state. The author used methods of legal history, the roots of which are interdisciplinary and lie on the boundary of legal and historical science. The text is integrating the recent material and procedural criminal law, which is considered to be a part of public law. Moreover, this theses draws out of archival sources and files created by military investigating organs and organs of military prosecution. The author also used rare historical sources, which are typical for contemporary history. We are talking about film documents and memories of participant. Basic stated algorithm is bet in the context of Czechoslovakian political progress after events in February 1948. Development of the Prosecutor's Office in Trutnov district in years 1949 - 1993 Abstract Presented work deals with origin, development and activity of District Prosecutor's Office in Trutnov in years 1949 - 1993. Time frame of this work is defined by the beginning of the year 1949, when District Prosecutor's Offices were originated as whole new type of public prosecutor's offices, and by the end of the year 1993, when whole new legal regulation of public prosecutor's offices was accepted, which no longer had roots in communist Czechoslovakia. In the first part the work deals with organisation and position of public prosecutor's offices from historical and legal point of view, where belongs the origin of District Prosecutor's Office in Trutnov. Second part of the work deals with substantive jurisdiction of the Prosecutor's Office, main principles of its activity, qualification and ethics of the prosecutor. Court execution of immovable assets in the Czech in the age of 1918 - 1963 Abstract: The work deals mainly with executory proceedings and distrainments in the period of the First Czechoclovakian Republic and after the year 1950. It introduces procedural rules concerning exekutory proceedings in the 1890s which were juridical regulations of a big and detailed extent and which were accepted into the legal code of the First Czechoslovakian Republic and procedural rules issued after 1950 which already didn't know a whole range of exekutory institutes of the previous age. On the other hand, these laws introduced a number of new institutes of enforcement, such as an incidental dispute, debating the debtor's objections directly in the enforcement proceedings. In 1955, a new form of wage enforcement was introduced to enforce maintenance for minor children when the seizure of part of the wage obliged not only the original payer but also all the following to which the debtor eventually went. The work is also patterned on the period legal decisions of individual courts of the First Czechoslovakian Republic, particularly of the Supreme Court. Legal regulations regarding paved and unpaved roads in Czechoslovakia from 1918 to 1992

The aim of this thesis is to map and describe the law-history framework of legal regulations concerning paved and unpaved roads in the period from 1918 to 1992. The state of Czechoslovakia adopted the normative basis for the legal regulation of paved and unpaved roads from that of the Austro-Hungarian Empire in the year 1918. These Austro-Hungarian legal regulations were accepted into the legal framework of the state of Czechoslovakia by the receptional provisions of Law and Directive No 11/1918 Coll. of March 28th 1918 on the founding of the independant state of Czechoslovakia. This thesis draws from primary sources such as relevant legal regulations, as well as from specialist historical literature. An important source of information on the method of application of the laws focused upon is the jurisprudence of the law courts of the First Czechoslovak Republic. A surprising finding of this thesis is the fact that in 1938, the Ministry of Public Works put forward a so called Great Road Bill for approval by the National Assembly of the Republic of Czechoslovakia. 1 Abstract in english: The aim of this thesis is the particular legal act n. 143/1947 Sb., on the transfer of the assets of the Hluboka's branch of Schwarzenbergs to Czech country, also known as "Lex Schwarzenberg". The purpose of this work is to describe this unusual case (in Czech law an extraordinary case), especially from the point of view of the context of its creation. For this reason, the thesis deals with the political background in the time of adoption of this legal regulation and then wiith the predominant basis of legal theory. An important part of the thesis is also the analysis of the act itself. The basis for writing the presented work was mainly archival materials from the second half of the 1940s, for example from the Archives of the Office of the President of the Republic or from the private Schwarzenberg Archives in Murau. Some of the presented archive materials have been published in the past, others not. Another important source is specialized historical-legal and theoretical-legal literature. The thesis also try to describe what led to the adoption of this legislation, and try to theoretically enlighten the meaning of the issue of such a special expropriation law for our legal system. This diploma thesis deals with formation and activities of the Financial Guard of the Czechoslovak Republic. It was a paramilitary security authority whose primary purpose was to oversee and prevent smuggling in the border area of the Czechoslovak Republic, simultaneously the Financial Guard was tasked with protecting the state border from unauthorized crossing of foreign nationals. The Financial guard existed before the establishment of the independent Czechoslovak Republic, but as one of the many institutes of Austria-Hungary it was also taken over into a new political arrangement. The aim of this work was to get acquainted with the term of Financial Guard. Define its basic functions and activities, and separate it from purely military churches. This work, in its first part, briefly and clearly talks about the establishment and prehistory of the Financial Guard, and its subsequent development to a fully functioning state body of the Czechoslovak Republic. The aim of my thesis is a detailed analysis of the state finances and treasury in Czechoslovakia during the years 1918 - 1945. If we look at the structure of my thesis, the exordium of my thesis is focused on the general concept of the state finances and after that because the state finances consist of several parts, the chapters are devoted to legal development of these several parts of state finances during the years 1918 - 1938. I mean the area of state budgets, taxes and fees, currency and monetary reform, the formation and activities of the bank of issue, as well as the banking and treasury. The legal development of these individual areas is closed with the chapter devoted to the economic crisis (during the years 1929/30 - 1934), the ways and means of its solution and with next period in history of our state, i.e. the period of rearmament. The second part of my thesis is devoted not only to the common development of all areas of state finances during the Nazi occupation of Czechia, but also to comparison this development with the development of the state finances in Slovak State. The Legislation of Providing Health Care of Residents in the Czech Lands from 1918- 1966 Thesis deals with the development of the legislation of providing health care of residents in Czech Lands from 1918 to 1966, which was effective only in Bohemia. The introductory chapters are about the legislation since 1848 due to reception of the legislation from the Austria-Hungary (often referred to as the Austro-Hungarian Empire in English-language sources). This inherited legislation is mainly about the right of the domicile, health and social care and public health. The authoress divided this thesis into three main chapters about public health care according to timely periods. The main chapters contain subchapters specializing in specific legislation of the individual components of public health. First chapter is about reception of the health care legislation from the Austria- Hungary, about public health care legislation, health system from the perspective of the administrative law, the legislation of the medical service, about the rights and duties of doctors and patients, and finally about funeral legislation.
