Death penalty
Pilát, Matěj ; Císařová, Dagmar (advisor) ; Novotný, Oto (referee)
Capital Punishment Abstract This paper is aimed at the capital punishment and its usage in modern society. The basic question examined is, whether death penalty can ever be justified as a tool to fight the most heinous crimes. In order to determine the answer this question, I am examining the capital punishment from the point of view of possible functions it can have and weighting it against inherent risks and harms created by it. The first chapter of this thesis is based on description. Firstly it shows the history of using the capital punishment in the area of Czech Republic; secondly I describe the usage around the world - mainly in USA, China and Middle East. Lastly I analyze international law concerned with capital punishment - namely International Covenant on Civil and Political rights and European Charter of Human rights, optional protocols to them and of course court decisions regarding these treaties. The second chapter is aimed at evaluating the possible benefits that using of capital punishment can have - especially when compared to life imprisonment. It is divided according to these functions, which are deterrence of potential criminals, protection of the society from sentenced criminals and the retribution for the crimes committed. In the end I find no clear benefit that executing of felons...
Contentious issues of self-defence in Czech case law
Korál, Petr ; Herczeg, Jiří (advisor) ; Gřivna, Tomáš (referee)
55 10 Abstract Controversial Issues of Necessary Defence in Case Law In this thesis I focus on the problematic issues of necessary defence (self- defence) both from the point of view of case law (where available) and law theory (in areas that have yet to be decided by courts). The second chapter describes the position of necessary defence in the systematic of Czech criminal law and defines the legal institute of necessary defence itself. Necessary defence is one of circumstances that exclude criminal liability (excuses and justifications). The substance of necessary defence is the repulsion of an imminent or pending attack on interests protected by the Criminal Code. The attack must be unlawful and harmful to the interests of society. The action of the defender must not be utterly apparently inadequate to the manner of the attack. Also the action of the defender must be intensive enough to otherwise constitute a crime. The third chapter addresses the issues of basic components of necessary defence, that is, the attack and the defensive action. The harmfulness of an attack must be at least discernible. In regards to the unlawfulness of an attack, the criterion is objective unlawfulness, that is, behaviour is unlawful if it unduly threatens interests of others, without taking into consideration of the...

The Rhethoric of Justification of Political Parties in South Africa
Bílá, Lucie ; Císař, Ondřej (advisor) ; Slačálek, Ondřej (referee)
The aim of the bachelor thesis is mainly to make an analysis of political speeches and oficial documents of two South African political parties, National Party and Economic Freedom Fighters, with a discoursive analysis as a methodology. The focus of the thesis is on the discourse of justification which concentrates on justification of own existence and claim on representation. This claim on representation is then analysed with regards to a declared group which the party claims to represent and to which, at least, these politics are supposed to serve. The part of the analysis is also a matter of consistence of the rhetoric.

Parenting in the context of cultural inequalities: how parents justify their child-rearing strategies
Šulcová, Zuzana ; Frantová, Veronika (advisor) ; Hájek, Martin (referee)
This thesis is written from the perspective of cultural sociology and focuses on middle-class parents and justification of their child-rearing decisions. It describes how parents choose and evaluate the institutions their children spend time at, how they "other" parents with different values and how they relate to concerted cultivation - a type of parenting style which currently dominates the middle-class context. This parenting style (or ideal) puts a great deal of pressure on middle-class parents and it causes a symbolic war among them: a war for acknowledgment and a certain position in the cultural space. This thesis describes who the participants "other", which child-rearing strategies participants approve of, what values are crucial for them and what problems they deal with. Furthermore, four main differences between the participants' approach and the concerted cultivation approach were identified: emphasis on friendship, emphasis on balance between activities and rest, emphasis on fitting in with the majority and emphasis on approval of certain authoritarian methods such as imposing punishments, applying restrictions and issuing directives.
Argumentation in mathematics teachers' beliefs and practices in the context of the Czech Republic
Žalská, Jana ; Vondrová, Naďa (advisor) ; Hejný, Milan (referee) ; Kaenders, Rainer (referee)
I aim to describe how teachers' beliefs and practices influence the way mathematical argumentation is conducted in lower secondary mathematics classroom within the Czech curricular context. I present results of two studies: the first one characterises the Czech curricular context, namely, the national curricular document and aspects of justification of mathematical statements in selected series of mathematics textbooks. The second study reports on characteristics of teachers' beliefs and practices as related to argumentation on an example of six purposefully selected teachers, via interviews and observations of their lessons. Finally, I select three teachers with differing approaches to teaching and describe specific observed instances in their practices in relation to classroom norms regarding argumentation, justification of general mathematical truths, and aspects of arguments. I show how teachers' beliefs, a textbook and pupils may influence the observed arguments. The studies show that a teachers' emphasis on efficiency (fulfilling school curriculum demands) on one hand and on sense-making on the other lead to distinct implemented curricula. The curricular context and teachers' practice analysis suggest that justification of general truths is generally seen as important but without clear cognitive aims...
