SUMMARY: Linguistic interpretation of a legal text in philosophical contexts Keywords: philosophy of law, interpretation of law, language interpretation The thesis deals in a broader sense of the word with interpretation of legal texts and in the strict sense of the word with language interpretation itself. At the beginning of my thesis I explain why this is so particularly topical and problematic issue in the contemporary law. The reason is mainly the fact that because of many changes and events the modern law is more complex and extensive than in the past. This naturally leads to the question how to interpret such law. The aim of the thesis was to compare the relationship of law and language in the context of analytical philosophy, which was one of the most influential intellectual movements of the 20th century. The language is a paradigm of many scientific theories nowadays and as such deserves more intention of lawyers. I focused mainly on the role of meaning of words used for interpretation. In particular, I discussed the issue whether a legal term can name a thing. Mass digitization projects of printed documents

The bachelor thesis introduces the issue of mass digitization and its projects, which currently affect many digitizing activities all over the world and which have an impact on various areas of librarianship, such as access to information, roles of libraries and books or copyright relations. The introductory part is devoted to the definition of mass digitization and its placement in the context of digitization efforts. The second part briefly describes the advantages and disadvantages of mass digitization projects and its particular aspects, such as copyrights, OCR technology, metadata, finance, long-term preservation of documents etc., which largely affect those projects. Mass digitization projects are divided by types of financing in the next part. Particular projects are characterized in the context with the situation that prevails in Asia and Europe with mentioned examples from particular countries, and the situation in the Czech Republic. The final part compares the projects Google Book Search and Open Content Alliance with the Norwegian National Digital Library, as a representative of mass digitization among national digital libraries. Evaluation of results of comparison and the effects of mass digitization are stated at the end of the bachelor thesis.

Liability for the infringement of copyright on the Internet

Závěr Na závěr této práce lze vzhledem k výše uvedeným zjištěním konstatovat, že Česká republika má moderní autorskoprávní kodex, který flexibilně reaguje na nové rozvíjející se technologie a v souladu s příslušnými mezinárodními smlouvami a komunitární úpravou poskytuje ochranu osobám, jejichž autorská práva byla na internetu zneužita. Vzhledem k tomu, že česká právní úprava týkající se zejména odpovědnosti providerů je poměrně mladá, chybí zde významná judikatura, která by (byť nezávazně) umožnila orientaci v příslušných zákonech tam, kde lze výkladem dojít k více řešením. Dle mého názoru je třeba do budoucna v rámci autorského zákona vyřešit problematiku osiřelých děl, aby bylo možné buď co nejefektivněji zjistit autora díla nebo dílo prohlásit za osiřelé a tím umožnit jeho zákonné šíření v digitální podobě na internetu. Touto problematikou se již, jak bylo uvedeno v této práci, zabývají orgány Evropské unie. Vzhledem k potřebě sjednocování legislativy členských států EU i v této souvislosti pravděpodobně Česká republika převezme "evropské" řešení. S tímto tématem je spojena i problematika správy autorských práv. Aby nadále nebylo nutné (jak je tomu dnes) při udělování licencí k užití díla kontaktovat jednotlivé národní kolektivní správce, nýbrž se v rámci EU obrátit pouze na jednu pověřenou osobu, je...

Resumé v anglickém jazyce - English Summary Peer to Peer Networks and Copyright Law Peer to peer networks are used to share various types of content within the environment of the Internet. The content shared via peer to peer networks comprises in a vast majority of copyrighted materials such as music, movies and computer programs. The aim of this thesis is to assess the behaviour of peer to peer network users and other subjects who are involved from the perspective of copyright law. In the Czech Republic, no special legal regulation exists on the use of copyrighted works on the Internet. Therefore, this assessment of the legal conformity of behaviour of all involved subjects shall be based on the general legal regulation of copyrights, particularly Act no. 121/2000 Coll., the Copyright Act, as amended. A fundamental feature of peer to peer networks is that its users simultaneously operate both as providers as well as receivers of content. Tématem diplomové práce je analýza situace v oblasti autorského práva a půjčování zvukových a audiovizuálních dokumentů v členských zemích Evropské unie a v České republice. Předkládá postupy řešení této problematiky v mezinárodních právních normách a dokumentech a v legislativních dokumentech Evropské unie, které jsou pro jednotlivé členské státy závazné. Práce se snaží zhodnotit přístupy jednotlivých členských států k této problematice především z hlediska uplatnění legislativy Evropské unie v národních legislativních normách. Popisuje situaci, která nastala v České republice v 90. letech 20. století a její řešení a obdobnou situaci na začátku nového tisíciletí. Porovnává řešení této problematiky v jednotlivých členských státech se situací, která nastala v České republice po schválení nového autorského zákona.

European audiovisual politics: public service broadcasting and the competition rules of European

For the broad problematic of European public broadcasting service (PBS), we chose a rather narrow view point of its financing. The competition law in EU, which is called by many an economic constitution for its force and prime role in the process of European integration, has much larger impacts than solely economic ones. The respect of competition rules in PBS financing can also indicate a good level of political end economical media independence. This thesis consists of three main parts. The first part treats PBS as a fraction of a far larger field of general economic interest services. Those services, essential in European social model, are represented on EU level legislation mainly as exceptions of strict competition rules. Regarding this topic, we follow the development in practice of the European court of justice. We follow the struggle between two conceptions - the "compensatory" and the "state aid" conception which ended in compromise Altmark judgment of the European court of justice in 2003. The problems of services of general economic interest and its place in European national societies represent a strong social dimension, to which PBS add also the cultural and national one.
