Pre-conditions for adjudication of bankruptcy

in English The thesis is composed of seven chapters. The first one is an introduction. In the second chapter I summarize the reasons, why a new regulation of insolvency law was needed. The third chapter is about pre-conditions for adjudication of bankruptcy in general and about the sources of their regulation. The fourth chapter is about the pre-conditions that are based in the material law and especially about all aspects of bankruptcy. The chapter No. 5 describes the conditions of civil and insolvency proceeding. Separately in chapter No. 6 is a describtion of moratorium. The thesis ends with conclusions.

Comparison of legal regulation of basic institutions of a residential cooperative in Poland and the Czech Republic

THE COLLATION A REGULATION OF FUNDAMENTAL INSTITUTES OF HOUSING COOPERATIVES IN POLAND AND THE CZECH REPUBLIC This work aims to capture qualities and shortcomings of the legislation in one of the important sectors of housing, the cooperative sector, in the context of a comparison of the two national legislations - in the Czech Republic and Poland. In both compared legislations, cooperative has its special character and long-standing tradition, which was introduced immediately in the introductory sections. The cooperative sector is the merit of this work. The issue of housing is always up to date, moreover, in practice we many time encounter with the uncertainties associated with the housing issue. Cooperative law in the area of housing is interesting in particular, with regard to incompleteness, and, in some cases, to insufficiency of Czech legislation, distinguish it from, more or less, consistent realization of housing cooperatives in Poland. Although both legislations have similar sources and traditions, and their characteristic developments, in the field of the law the willingness of legislators to adapt an important part of ensuring significantly differs from the housing requirements of the population. Reversed discrimination in the Community contexts

Reverse Discrimination in the Community Law Context Gabriela Machačkova The final thesis discusses the issue of reverse discrimination, which arises when nationals/products of a Member State are disadvantaged because they are subject to a national regulatory measure, while foreign (EU) nationals/products are protected from that national measure by virtue of European Community (EC) law. It examines the question of scope of EC Law, specifically focusing on the extent to which nationals of a Member State who have never exercised their Community rights can claim their rights by applying the Treaty establishing the European Community. It addresses the question of extension of the scope of EC law to cover purely internal situations in which no inter-State element is present, and to which the fundamental freedoms (free movement of goods, services, persons and capital) do not apply. First, it reviews the development of European Court of Justice case-law on reverse discrimination and situations which can be regarded as purely internal. The time frame discussed in the thesis ranges from the late 1970s until the present. Reverse discrimination and purely internal situations are analysed in terms of the examples of the Court's jurisprudence. Comparison of hedging instruments in international trade

The thesis is divided into two parts -- theoretical and practical. In first part hedging instruments, namely the Letter of Credit, Documentary Collection, Bill of Exchange, Factoring, Forfaiting and Bank Guarantee are analyzed. The aim of analysis is to describe the basic characteristics of instruments and course of these instruments. Subsequently, the instruments are compared to each other on the basis of the advantages and disadvatages they bring to participants. The next part is devoted to an analysis of charges associated with the use of particular hedging instruments in selected banks and the comparison of instruments based on selected criteria. The specific use of the hedging instrument is shown in the case study.

Accounting Frauds in Russia

The subject of this thesis is the characteristics and detailed classification of accounting frauds in Russia. The whole work is based on current government regulations, expert articles and statistical data related to the issue of accounting frauds. This bachelor thesis is divided into two parts: theoretical and practical. Theoretical part focuses on characteristics of the system of accounting frauds in Russia from the perspective of government regulations, indicates historical assumptions and current tendencies and presents classification of accounting frauds based on several parameters. The practical part illustrates the issue with examples of accounting frauds in two different companies and assesses their impact on economic situation in each company.

Current issues of adoption and education of children in homoparenting families

Bachelor thesis, "Current issues of adoption and education of children in homoparenting families" deals with the issue of homosexuality, a registered partnership, the possibilities of parenthood homosexual couples and the education of children in homoparenting families. In the beginning of my work I deal with the definition of homosexuality, causes of its origin, history and contemporary perspective on homosexuality and gay live opinions. Next there is a chapter about registered partnership, particularly brief contents of the act on the registered partnership, compare institute of registered partnership with the institute of marriage and the situation in the Czech Republic after the legalization of registered partnership. In the next chapter I summarized the possibilities of creation homoparenting families. The last chapter is about the topic of homoparenting families. The professional findings in the education of children in these families as well as education aspects of the enviroment resulting these families. Finaly a summary of the arguments for and against the education of children in homoparenting families.

Public awareness of drug problems in České Budějovice district

ABSTRACT Addictive drugs are all around us and they have become a part of our lives. The issue of drug abuse is of critical importance, global, and difficult to solve. Typically, drugs are categorized as tolerated or not tolerated by society, and more or less risky. It is vital, therefore, to know the attitude of public to the issue. Lots of drug abuse causes have already been revealed, just like the reasons why some users develop addiction while others do not. In all probability the abuse of drugs or the addiction development cannot be put down to a single background factor. Everything will depend on personality traits of the individual, on his or her environmental conditions, and on specific effects of the drug. Since I take much interest in these issues, I have chosen for my thesis the subject of Public awareness of drug abuse issues in the District of České Budějovice. I investigated what people knew about drug abuse at the District where I live; their opinions of drug abuse; whether they believed that drug abuse deteriorated social position of an individual; whether they believed it boosted the rate of crime; if people were informed about facilities assisting recovery from drug addiction within the District of České Budějovice; and, last but not least, whether they suspected what drugs could come in their way here. The thesis aimed to examine what people knew about the drug abuse issues in the České Budějovice District. This objective has been met. Fifty three percent of respondents were found well informed on the subject, while the remaining 47% lacked the information. The survey was to prove or disprove hypothesis that the public was unaware of organizations providing help to drug addicts - the hypothesis was not confirmed since 51% of respondents were informed about the relevant organizations and 49% were not. Another hypothesis predicted that the public could not tell the illegal drugs from the legal ones - it was not confirmed as the public was found sufficiently informed. The hypotheses expecting the public to believe that drug abuse drives crime and deteriorates the addict's social position were confirmed by the bulk of respondents living in the District of České Budějovice. Ninety nine percent of the respondents believed the drug abuse pushed up the crime rate and 95% were of the opinion that it affected the addict's social position. As follows from the survey, the public in the České Budějovice District was relatively well informed of the drug abuse issues, though the differences encountered between awareness and unawareness of the subject were just minor. I intend to release the thesis as an information source for the general public(in the form of brochures, internet publications or periodicals); moreover, I want to offer the results to organizations engaged in the drug abuse treatment and to students of the University of South Bohemia to serve as training material. The public will find a wealth of important drug-related information in the paper, while the addiction treating organizations will be prompted to fill the gaps still existing in information available to the general public.

Private limited liability company according to Business Corporations Act compared to private limited liability company in Danish law

Private limited liability company is a type of limited liability company used especially by small and medium-size enterprises. This form of company is very popular in and outside of Czech republic. In the last few years many countries have adopted new laws regulating private limited liability companies. In Czech republic it was Business Corporations Act in 2012 although many provisions were included in other acts. In Denmark this form of company is regulated in Danish Companies Act adopted in 2009. This thesis describes legal regulations on private limited liability companies in both Czech republic and Denmark. Description of Danish regulations is rather thorough since there is limited amount of other sources on this matter in Czech language. The aim of the thesis is to compare these regulations and their positive and negative aspects.

The comparison of the administrative justice system in the Czech Republic and selected European countries

This thesis analyses the administrative justice system, which represents one of the key control mechanisms of the public administration in The Czech Republic. The aim of this thesis is to compare the administrative justice system of The Czech Republic with selected European models of the administrative justice system such as the French and German justice systems. The result of this comparison highlights the differences in justice systems and considers the possibility of implementing these models in The Czech legal system.The administrative justice system in The Czech Republic has been developing since 2003, when The Act N. 150/2002 came into effect. The operating administrative justice system in The Czech Republic is characterized by the following criteria: statutory framework, power and jurisdiction of the administrative court, organization of the administrative justice system and the course of the judicial administrative proceedings. The following chapters discuss the French and German models of the administrative justice system and analyze the similarities with the Czech system.The final chapter compares the individual administrative justice systems and their most important differences.
