Effect of amendments to the Civil Code on the real estate practice

On 1 January 2014 the new Civil Code no. 89/2012 Coll., which affected many areas, came into force. This thesis deals with the changes that have an impact on real estate activities. To the change of the Civil Code no. 40/1964 Coll. an introduction of new Cadastral law no. 256/2013 Coll. is closely related. Influence of this Cadastral law on a real estate practice is also described in this work. The conclusion summary of this work is a mapping of changes and an assessment of the extent to which they affect a real estate practice.

Main Legal Issues in the Real Estate Practice

When after 1989 in our country have discovered the first real estate brokers and agents, were more or less a new professions, at times of socialism not existing. Since then have more than 2 decades passed, it will be interesting to compare the current state of the neighboring countries. First I will focus on the close one, Slovakia and then Austria, which belongs to the developed property market. I will look at various options of real estate agents and their functioning in all 3 states. The issue of legal liability of real estate activities will be submitted to the critical analysis and all the lessons learned will bring into mutual comparisons. I will also address the association of Realtors and appraise their position and function in different countries. An interesting part of this work will be determination of public opinion on public awareness of the importance of real estate services, I have made this research through polls.

1 Insurance Agent Abstract The topic of this thesis is the insurance agent, as one of the types of insurance intermediaries pursuant to Act No. 38/2004 Coll., On Insurance Intermediaries and Independent Claims Loss Adjusters. Insurance mediation is a relatively current issue, which is presently under discussion, especially regarding to the Insurance Distribution Directive (IDD) and its implementation into Czech law. In this work the existing legislation is not only described, but also my professional experience with the examined issues is applied and provided commentary where relevant. The thesis is divided into nine chapters, including the introduction and the conclusion. The introduction is followed by historical development of legal regulations, both in Czech Republic and within the European Union. Then the thesis is focused on the insurance agent itself, first by defining him and the conditions for being registered as an insurance intermediary. Subsequently specific conditions of the insurance agent's activity are dealt with, having a special focus on the obligation of the insurance agent to act with professional care. Public law aspects of providing credits for consumers

This paper deals with legal regulation of providing and mediation of credits for consumers with respect to public law. The most important goal of this regulation is to protect consumers. This thesis analyses an act, which came into effect about 1 year ago transposing a directive regulating credit agreements for consumers relating to residential immovable property and a directive regulating other credit agreements for consumers, evaluates its suitability, considers its imperfection and proposes appropriate changes. The paper is divided into 4 chapters according to the structure of the Act No. 257/2016 Coll. on consumer`s credit. The first chapter analyses what exactly shall be considered as the consumer`s credit and defines four essential features of a credit for consumers as it is construed in this Act. The second chapter deals with requirements for obtaining permission for those entities who apply for permission for providing or mediation consumer`s credits, describes possible structures of representation of these entities and potential offence liability, which can be imputed to the represented entity. Verification of the Kuhlthau's Information Search Process Model in the Environment of the Czech Republic

The thesis focuses on Kuhlthau's Information Search Process Model. Firstly, the author explains Kuhlthau's model of information retrieval and seeking meaning of information from user's perspective. Results of the model are the uncertainty principle and mediation - findings which change our view of library services. In the second part of the thesis, the author introduces other research texts and manuals about writing a scientific text. She pays special attention to Jadwiga Šanderová's comprehensive manual which is called How to read and write a scientific text in social sciences, and to stylistics research text by Světla Čmejrková et al. called How to write down a scientific text. Thirdly, the author evaluates the survey which verifies Kuhlthau's model in the environment of the Czech Republic. Affiliate marketing - introduction and actual trends

Thesis "Affiliate Marketing: introduction and current trends," aims to inform about the possibilities of using this marketing tool and demonstrates its high efficiency. It is divided into three main parts: theoretical (basic information about affiliate marketing), practical (Affiliate marketing practice) and exhaustive (known affiliate programs and aggregators). There is the emphasis at the beginning on explaining what makes the concept of commission sales on the Internet so unique and why its use is becoming increasingly popular. The most important part is focused on the practical use of affiliate marketing nowadays. It discusses its potential use in many ways (in terms of the operators, partners and other options). Those interested in affiliate marketing should be after reading this thesis better in orienting and selecting the most appropriate manner of its use. The conclusion describes the most popular affiliate programs and aggregators in the Czech Republic and abroad.

Between monologue and dialogue: An interpretation of Buber's book I and Thou

This paper is devoted to a critical analysis of the book I and Thou in the attempt to identify the main points of the dialogical philosophy as presented by Martin Buber. The introductory passages present the background of the book in terms of time (the era after WWI), cultural background (the influence of Hasidism), or the history of philosophy (an opposition to immanentism, monism, idealism, transcendental philosophy etc.). The main goal of the following interpretation is to try to understand man as a person in his complex existential situation, i.e. through his potential relationships or objectifying attitudes to the world. Being is described as a dual structure either of the basic pair of words I-Thou or of the basic pair of words I-It. As opposed to the usual use of the term, dialogue is defined as a specific interaction of man and the remaining world metaphorically expressible by the structure of addressing-responding. By this scheme, the characteristic reciprocity and direct continuity is expressed. The dialogue is also placed in the area "between" I and Thou, which mediates the genuine, immediate and transcendental knowledge constituting the reality.
