Criminal, criminological and criminalistic aspects of injured person's interrogation

This thesis is dealing with the criminal interrogation of injured person from criminal, criminalistic and criminological aspect and emphasizes the issue of secondary victimization. It contains an examination of the terms injured person, victim of crime and criminal interrogation, then is dealing with methods and tactics of questioning with specific issues involved in injured person's matter. The thesis describes changes in Czech system of law caused by the Statute of victims of crime. On particular cases based on author's research the thesis shows how can wrongly managed questiong leads to secondary victimization of victim, and offers solutions of particular problems involved in criminal interrogation of injured person.
The interrogation practice and solution methods of child abuse investigators

This diploma thesis is comprised of a theoretical section and a practical section. The first theoretical subchapter introduces the CAN syndrome. The second theoretical subchapter focuses on the relevant international and national child protection legislation. The third subchapter "Child Interrogation" deals with the issue of the historical development of child interrogation techniques and methods, and the currently recommended interrogation techniques used to interrogate children in keeping with the Act on Criminal Judicial Procedure No. 141/1961 in the Czech Republic. The third subchapter also concerns with the character traits of the investigator, the qualification requirements of this profession and the fundamental methodology used to prevent a child's secondary victimisation. The fourth theoretical subchapter focuses on the specially designed interrogation room used, among others, for child interrogation. Úvod Ve své bakalářské práci se věnuji sociální práci s účastníky domácího násilí. Je výsledkem mé studijní praxe a dlouholetého zaměření, kde jsem poznala, jak důležité je vnímat všechny strany konfliktních vztahů v rámci rodinného systému. Vzhledem k tomu, že oběti domácího násilí často nedokážou od svého partnera, či jiného příbuzného z mnoha důvodů odejít, nemůžeme opomíjet na práci s násilnou osobou, skrze kterou lze změnit kvalitu života nejen jí samotné, ale především jejímu blízkému okolí. V minulosti bylo domácí násilí tolerováno, či tabuizováno, ale dnes je bráno jako sociální a právní problém. Zaměřit pozornost jen na oběť není vždy řešením a mnohdy sociální pracovníci sledují, jak jejich dlouhodobá práce s obětí nemá žádné výsledky. Setkala jsem se mnohokrát s ohroženou osobou, která dlouhodobě využívala služeb krizového centra, ale v jejím životě se nic neměnilo. Pomoc zaměřená na oběť nedokáže vyřešit situaci klienta, který je ohrožen domácím násilím, ale nechce nebo nemůže z násilného vztahu odejít. Faktory, které nedovolují klientovi odejít z násilného vztahu jsou například citová závislost, finanční závislost, strach nebo péče o děti a sociální pracovník musí tolerovat klientovu vůli setrvat v tomto vztahu. Interaction investigator with selected participants of criminal proceedings and its impact on based recognition

(in English): The thesis "Interaction of police investigators with selected participants of criminal proceedings and its impact on recognition" is studies the interaction and communication of criminal proceeding participants and its influence on the quality of those proceedings on recognition. The theoretical part deals with criminal proceedings such as all the trial requirements and factors which affect police investigation. Rights and responsibilities of all participants of trials are defined. Furthermore, communication, its types and categories and -most of all -its impact on successful police interrogation is examined. We also mention interpersonal perception. In the theoretical part of the thesis a lot of attention is devoted to the personality of police investigators and to significant characteristics which form the foundation of police profession. In conclusion of the theoretical part we describe the aspects which control the investigation and potential offender recognition. Selected issues of the status of injured parties and victims in the Czech legal order

The subject of this dissertation is the analysis of the position of an injured party and a victim in the Czech criminal legal environment. The aim of this thesis is also identification and practical analysis of particular procedural rights of injured parties and victims guaranteed to them by the Czech legislation. The dissertation has four main chapters. The first chapter is describing not only the general concept of an injured party but also particular claims that injured parties may exercises in the criminal proceedings. The second chapter contains not only description and analysis of adhesion proceedings, but also conditions under which claims of injured parties may be considered and decided by the Czech courts. The third chapter is devoted to the most problematic procedural rights of injured parties. The last chapter of this dissertation deals with the general concept of a victim and particular procedural rights of victims - mainly in the light of the "relatively young" law concerning victims of crimes.
Methodology of investigation of rape (specific issues)

Resume This thesis called Methodology of rape investigation (specific issues) is focused on problems with rape investigations, special attention is paid to treatment of authorities (and other persons) with victims in criminal proceedings. The reason for my choice of this theme is the lack of attention given to this topic (particularly handling with victims). Although in the last few years the situation is getting better, the specific investigating problems remain. The thesis is divided into five chapters, first two of them are more theoretical, other sections are rather practical and are based on my own empirical research from court cases which I have studied. Chapter One deals with the criminal view of rape, especially history of rape and legal definitions in Czech statutes. The next part of the chapter is focused on criminological aspects of this crime, i.e. possible causes of rape, typology of offenders and victims, definition of secondary victimisation etc. Chapter Two is about methodology of rape investigation, and is specialized on the most frequent investigating acts connected with rape, i.e. interrogation, examination of victim's body, crime scene examination, genetic expert opinion, psychiatric expert opinion etc. The end of the chapter reveals myths associated with rape. Rights of the victims of crimes and options of their employment during the criminal proceedings Abstract This master's thesis inquires into crime victims' rights, their status in the criminal proceedings and actual employability of their guaranteed rights. It contains a brief history of development of the legislative concerning the topic. My thesis comes to a conclusion that especially in the last fifty years, the status and range of crime victims' rights has been constantly improving. Crime victim is becoming less and less just a bearer of evidence of the crime and is more and more becoming an active subject of the criminal proceedings, on which they also have their interest. With the passing of the new Crime Victims' Rights Act, the Czech legal system was enriched by a wide array of victims' rights that provides special care and approach from the state and its authorities. In the heart of the new act is the victim as a target of an undeserved attack in the form of a crime and as such is entitled to help. THE CRIME OF RAPE - CRIMINAL AND CRIMINOLOGICAL ASPECTS The thesis is composed of six chapters and is focused on criminal and criminological aspects of the crime of rape. I decided to write about this topic especially because of severity of the consequences caused by this crime to the victim and because of the dangerousness of the offender. Chapter One is subdivided into six parts and it contains the introduction to the topic, in particular the outline of the historical development in this area and analysis of the current legislation with focus on terms which could be difficult to interpret. This chapter ends with presentation of static data regarding to the crime of rape and their graphical representation. Next chapter consists of three parts and is focused on the offender of the crime of rape, particularly on his personality, typology and prediction of his future development. Práce poskytuje přehled o problematice znásilněných obětí. Stěžejní část je zaměřena na oblast viktimizace, především na sekundární viktimizaci, kdy se oběť musí znovu vyrovnávat s emocionálními ranami, které vznikají zveřejněním trestného činu znásilnění.V práci nalezneme psychologické aspekty této problematiky, poznatky o způsobu jednání s obětí znásilnění, faktory ovlivňující oběť při komunikaci a kontaktu se zdroji sekundární viktimizace, především s orgány činnými v trestním řízení. Součástí práce jsou také kazuistické případy dokreslující teoretické poznatky.
