Registered partnership - actual situation in Europe Abstract This thesis deals with the registered partnership and cohabitation of two persons of the same sex in the same-sex marriage. The thesis deals not only with the Czech legal system, but also with other european countries. The aim of the thesis is to compare the individual legal regulations and to review the actual tendencies of the european states in this respect. The text focuses mainly on the current situation in individual countries, the facts as concerning the establishment and termination of registered partnerships and partners' property relations are described. The subject of homoparentality and the possibility of adopting homosexual children is also discussed. The thesis is divided into 6 chapters, which gradually describe sub-areas related to this civil law institut. The first chapter defines the basic concepts and briefly describes the historical development of homosexual perceptions and the view of homosexuality. The next chapter describes the gradual legalization of a registered partnership in Europe, focusing on legislative processes in the Czech Republic. This thesis defines the basic terms concerning not only the homosexual minority but also other sexual minorities, and maps the historical and social development of primarily Czech gays and lesbians from the late 19th century to the present. Based on the study of selected Czech literature dealing with the history of homosexuality, the author presents the first preserved mention of people with minority sexual orientation in the territory of the Czech lands, describing their situation during the First Republic, World War II and Totalitarianism. The author devotes substantial part to the associations and movements that could be legally founded after 1989 and also presents a list of various radio and television programs and printed periodicals. At the same time, the thesis illustrates the efforts of this sexual minority to improve its social acceptance and its rights. It also describes specific milestones that led to the removal of homosexuality from the list of diseases in Czechoslovakia and subsequently the Czech Republic, through the adoption of the registered partnership act to the same-sex marriage campaign. Legislation registered partnership and its social aspect

This Bachelor thesis on the topic of "registered partnership legislation and its social aspect" describes how the society looked at homosexuality throughout history, and how it is perceived nowadays. The opinion of the society in this matter has developed gradually and is continuously evolving. I see the meaning of this work in extending informations for persons who preffers persons of the same sex. Additional value is that the general public awareness of the issue would be wider. Addaptation of registered partnership or same sex marriages may not be in certain countries enacted, no one can give this country order to do so. Therefore, there are still countries where registred partnership is not allowed in the legal order of the country. Bachelor's thesis concentrates on two aspects. The main aspect is to summarize the law of registered partnerships and its social aspect in selected countries of the European Union, when was the legislation of registered partnership described in the Czech Republic and, eventually, in selected countries of the European Union. Through the additional aspect was compared the adjustments of registered partnership between selected States. Due to the fact, that the thesis is only theoretical and research was not carried out, I used analytical-descriptive method.
Differences in legal status of same-sex marriage between selected US states: California, Texas, Florida

This thesis deals with the issue of same-sex marriage in California, Texas and Florida. Gay marriages is a very hot topic nowadays in the US. After the Supreme Court decision in June 2013, which struck down a law that explicitly defined marriage as a union only between a man and a woman, ensued a wave of states legalizing gay marriages. After another Supreme Court decision in October 2014 on the issue, it became legal in the majority of US states to wed couples of the same gender. Texas and Florida did not join these states. California on the contrary legalized same-sex marriages. The thesis searches for reasons of this disparity in legal status of gay marriages between the three states. Particularly it looks at political aspects of the issue. The thesis describes the political situation in the examined states and approach of the politicians to the question of same-sex marriages. It also deals with relevant court cases which are essential to the issue. From the researched outcomes it finds reasons for differences in legal status of same-sex marriages between California, Texas and Florida before the October 2014 Supreme Court decision.
Proposition 8 on Same-Sex Marriages in California in 2008: Campaign and Opinion Polls

This bachelor thesis deals with same-sex marriage in California. In November 2008 Californian voters approved with small margin constitutional amendment called Proposition 8. This amendment defined marriage as union of one man and one woman. There was very intensive campaign by both opponents and supporters of this ballot initiative. In the first part this thesis analyzes the arguments used in the campaign and tries to clarify them using the previous court decisions and valid laws. The most important and used arguments are about upbringing and education of children, religion, civil rights and traditional marriage. The analysis shows that almost all the arguments that opponents of same-sex marriage are using, were rejected by courts in previous cases or the statements don't rely on facts and existing laws. The second part deals with public opinion polls before voting day and hypotheses, why Proposition 8 succeeded even though the polls indicated otherwise. The most probable explanation appears to be that majority of voters still opposed same-sex marriage. Only some of them didn't realized that if they are against same-sex marriage, they should vote for Proposition 8.
Extramarital unions (a comparative study of the Czech Republic and France)

The topic of this thesis is the legislation of cohabitation outside of marriage. The thesis focuses on the treatment of registered partnership in the Czech legal system and its equivalent in the French legal system - Pacte Civile de Solidarité. The thesis describes the historical development and current legal regulation of this issue, discussing the terms of formation of the partnership, the rights and obligations arising from this partnership and circumstances of termination of the partnerships in both Czech and French legislation. In the conclusion, both legislations are compared.
