Sources optimization for public construction investments

This bachelor thesis deals with the optimization of sources for public building investments. The thesis is divided into the theoretical and practical part. The theoretical part deals with public procurement, possibilities of financing public procurement, municipality and the budgetary system of the Czech Republic. In the practical part, the development strategy of the municipality of Červenka is analyzed using SWOT analysis, problem analysis and their solution and long-term investment outlook. Based on these analyzes, the public construction investment of the sokolovna building reconstruction is selected. For this investment, several funding options are proposed. At the end of the thesis, these variants are evaluated and the most suitable one is selected.
Tactics of construction companies in preparing bid prices for public works contracts

Diploma thesis deals with the analysis of the approach of construction companies to the preparation of price offers. The theoretical part contains an explanation of the basic concepts of the issue and possible ways to determine the price of the construction work. In the practical part, this topic is researched in practice using a questionnaire survey. The results of the questionnaire survey are followed by two interviews with representatives from practice. After evaluating these data, the established hypotheses are verified and recommendations are expressed.
Investment project in the municipality

The bachelor’s thesis is devoted to explaining keynotes of the investment in public sector. The first part of the thesis is theoretical. There are defined the concepts of public investment, public contact and posibilities financing of these investments. Municipalities management, municipal budgets and regional development are further solved topics in this section. The practical part describes the financing and influence of the investment on the development of the municipality. As a speific investment, I choose a project called „New building of kindergarten in Dolní Loučky“.

Inadequate legitimization of public tenders: The case of PID uniform vehicle paint design

This bachelor thesis deals with insufficient legitimization of public tenders. As the main case, the design competition for the new coloring of vehicles falling under the Prague Integrated Transport is analyzed here. In the theoretical part, the general theory about public policies as public processes will be presented with the help of professional literature. Specific theories will concern the theory of legitimation. The main interest will also be the presentation of the ideal model of public competition from the point of view of public administration theory. In the practical part, primarily qualitative methods will be used, which should bring the opinions of all interested parties. This would be a single case study. One tool will be interviews with actors. Others will be media analysis, especially articles that relate to this topic. An analysis of official documents related to this topic, which were issued by the authorities for the competition, will also be carried out. Protection Against Incorrect Conduct of a Contracting Authority in the Public Procurement Process

This diploma thesis deals with the protection of the supplier and the company in general in the process of awarding public contracts by the contracting authority. The aim of the work is to analyze the possibilities of means of protection that can be used against procedure of contracting authority this way. The work is divided into two parts, theoretical, which contains the definition of public contract and the procedure for their award, a description of the basic principles of procurement act, analysis of individual means of protection of the contracting authority, overview of individual offenses and proposals de lege ferenda. The second part is a practical part, which analyzes specific examples of practice in, in order to approach and clarify some public contracts that were awarded in various types of procurement procedures. Whereas that this is protection against illegitimate procedures in public procurement, there are chosen that cases in which the inaccuracy confirmed and where there was an authoritative action by the Office for the Protection of Competition, or related bodies within justice the following examples are selected, for which incorrect confirmations were made and where there was authoritative action by the Office for the Protection of Competition, or related bodies within judiciary. The main element for the elaboration of the whole work became by the Act No. 134/2016 Coll., the Public Procurement Act, which was interpreted using selected case law, professional periodicals and commentary literature.
Protection of a supplier against conduct of the contracting agency in public tenders

Protection of a supplier against conduct of the contracting agency in public tenders The aim of this thesis is to analyze the legal instruments by which suppliers can defend against unlawful practises of contracting entity. The reason of choosing this theme is my deep interest in this sphere. Ever year, more than eight thousand tenders are announced in the Czech Republic. There are more than fifteen thousand contracting authorities. The public sector expends more than 600 billion Czech crowns on public procurement every year. The acting of subjects involved in the procurement proces is often unlawful. It is therefore necessary to set the legal framework of competition for public contracts so that it will be ensured prevention the unlawful procedures of subjects affecting the procurement process and ensure the most efficient spending of public funds. This thesis consists of four chapters. The first concerns the most important principles associated with public procurement. There are also examples of practical reflection of these principles to various statutory provisions. Bid Protests in Public Procurement: Czech Case

Bid protest mechanisms provide supervision over public procurement processes. If set up properly, these mechanisms improve both ex-ante and ex-post e - ciency of public procurement. However, decentralisation of the oversight can create opportunities for bidders to strategically abuse the system at the soci- ety's expense. In order to assess e ciency of the Czech bid protest mechanism, an empirical policy analysis of was conducted using a unique combined dataset of all bid protest rulings of the Czech supervising authority linked to a com- plete dataset of public contracts procured between 2007 and 2014. Econometric methods for panel data analysis were employed in order to estimate e↵ects of bid protesting on returns in form of awarded contracts. The selected approach made it possible to focus on individual relationships between contracting au- thorities and their suppliers. The results show significant di↵erences between returns of protest against EU co-funded and EU unfunded contracts. Moreover signs of strategical system abuse related to public works contracts were found.
