The Orphan's Administration at the Manor of Jindřichův Hradec in 1693-1699

The Bachelor thesis deals with orphans and their position in the legal system at the Manor of Jindřichův Hradec in 16931699. The first part is concerned with the administration of orphan's matters in the set period which came under competences of nobility and the king of Kingdom of Bohemia who was perceived as the supreme orphan guardian. Subsequently, there is a brief description of the dominion according to the period land registers, namely Berní rula and Teresian Land Registry. The history of the dominion and its nobility is also mentioned. The following part of this thesis aims at position of the orphans in the field of law. The problematics describes in detail e.g. definition of the term orphan, or guaranteeing their upbringing and management of their inherited property. This part is also devoted to the comparison of the Roman legal norms with the Czech urban and land law. The main part of the thesis offers the view on the orphan's problematics and their situation according to the extant orphan's registers. Based on their analysis, the author provides brief overview of the several orphans' living data and discloses their lives. Simultaneously, the author will concentrate on the examined orphan's registers as a specific type of an official document. All of the historical sources used in this thesis are included in the collection Manor Jindřichův Hradec, which is stored in the State Regional archive in Třeboň.

Tutorship (as type of guardianship). The thesis deals with a guardianship, with the most important historical milestones in a guardianship evolution and with the guardianship legislation in the Czech Republic taking into account guardianship legislation in the Federal Republic of Germany. Through the guardianship is provided alternative legal protection of legally incompetent minor lacking necessary legal protection. The aim of the guardianship is ensuring an appropriate alternative legal protection of ward's legal matters. The thesis is dividend into two parts and eight chapters. The first part is devoted to the most important codifications which in my opinion influenced the development of the guardianship on our territory the most. The first part deal with guardianship legislation in the Roman law, provincial and municipal law, in the General Civil Code and marginally about guardianship legislation contained in the Act of family law and in the Family Code. The second part of the thesis deal with guardianship legislation in the Czech Republic taking into account guardianship legislation in the Federal Republic of Germany. 7 Anotace v cizím jazyce Annotation This bachelor work deals with foster care in the Czech Republic. I tried to approach not only history itself but also performance of foster care nowadays. In the first part, the basic terms used in this field are explained as well as important historical moments regarding foster care. Description of different forms and kinds of foster care is also included. Second part describes mediation and fosterage itself. Duties and discretions of foster parents including outline of child care benefits are also implicated, as amended by Act no. 359/1999 Sb, social - legal child protection. Final part shows course of foster care itself in one family from my close connection who brought up 2 children. The final parts of this chapter evaluates the importance of foster care in the society including experience of real foster parents in application on valid legislation. Contacts of a Child in Foster Care with a Child's Biological Family

The diploma thesis deals with contacts of a child in foster care with a child's biological family. The aim of this work was to map the experiences of children in foster care with contacts with biological family. The diploma thesis is divided into theoretical and practical part. The theoretical part is focused on approaching the system of surrogate family care, further explains the differences between partial forms of surrogate family care. Attention is paid to the experiencing of children, child's identity and also to the subject of attachment. The work deals in detail with the biological family of a child in foster care and their subsequent contacts as one of the main topics. The practical part follows the qualitative processing of narrative interviews, where the effort is to describe how children in long-term foster care experience contact with a biological family. The work is focused on the experience of a child in foster care with contacts with a biological family from the perspective of nine young people growing up in a foster family who formed the research set. The method of simple intentional selection and the snowball method were used to select the participants. The obtained data were evaluated using the cluster method. The research showed 7 clusters common in the participants' statements. These are the following clusters: the child's contact with the biological family; obtaining information about the biological family; feelings connected with contact; child's attitude to the biological parent (relatives); foster parents' reaction to the contact; child-foster relationship; current view of the contact. Each participant looks at the course of contacts with the biological family individually, but the results of the research have shown that there are situations that informants and informatics have in common. For example, the desire to get to know their biological parents, although individuals need time to process the obtained information about the biological family before contacting the biological family. The thesis will help to raise awareness about foster care and may be useful for future foster parents.

1 RESUME This Honours Project has a character of comaparing theory. It is devided into six chapters. In the first chapter is specified The Office of the Public Guardian. The second chapter is focused on historical development and is devided into four sub- chapters. The special guardianship regulations from the times of Roman law all the way to the latest history are discussed in these four sub-chapters. The third chapter is comparing The special guardianship regulations of The family law number 94/1963 of Civil Code which was subsituted by new law 89/2012 of Civil Code valid from 1st January 2014. It is comparing the special The fourth chapter called The guardian ad litem and other forms of guardianship is describing the these forms by the valid Special guardianship regulations and comparing with The guardian ad litem. The fifth chapter is focusing on the guardian's allowance for the personal use of the minor. The last sixth chapter gives us the characteristics of current social and legal children protection system in Czech Republic. They include a closer specifiation of Divisions of the public sector effecting. The experience of foster parents and trustees in ensuring compulsory contact with the child's family of origin

These Bachelor Degree Theses describe facts connected with foster care and guardianship issues with emphasize on legal obligation to ensure a contact of the child with his original biological family. The theoretical part of my work starts with historical milestones of a foster family care in the world and in our country. Then I deal with the present state and I describe institutions that are engaged in the foster family care. The practical part of these theses is elaborated by the qualitative method using semistructured interviews with foster parents and guardians. I made a list of most frequently mentioned basic needs of foster parents and guardians as well as the children in the foster care and opinions of foster parents and guardians regarding the mentioned topic. These theses can be used as a material for work of intervention centres of the foster family care as well as for other specialists dealing with this area of the foster family care, eventually as an inspiration and motivating material for applicants for the foster family care.
