Development of Business Activities by Introducing an e-shop

Bachelor thesis deals with the development of business activities with the help of an e-shop in the company Truhlářství Berka. Thesis is developed on the basis of theoretical background, which serves as a basis of the analysis for the external and internal environment, which we then sumarize in the SWOT analysis. Based on the results of this analysis, we will propose a solution that will lead to the development fo business activities.
Specific aspects of using trusts in business relations

The main aim of this thesis is at examining and describing the legal conditions and limits of the use of trusts in commercial relations, primarily the advantages that trusts can offer to commercial relations and the possible difficulties of their legal regulation. The thesis is based on the fact that the current legislation does not contain special provisions regulating the specifics related to the existence and activities of a commercial trust. It is the absence of explicit regulation and relevant case law, as well as the lack of Czech legal literature focused on commercial trusts, that lead the author of this thesis to use foreign literature, not only to describe and answer some of the uncertainties associated with the current legal regulation of trusts, which are most evident in their involvement in commercial relations. The first part of the thesis contains a brief description of the history of the institute of trust, which originally developed as an institute for the preservation and maintenance of family property and as a more flexible alternative to the inheritance law. The history of the trust helps to understand why the use of trusts in commercial relations is not particularly developed in the Czech legal environment, in contrast to the renewed use of this institute in family relations....
China's Accession to the World Trade Organization: Case study of U.S.- China trade disputes

The subject of this bachelor thesis is the case study of U.S-China trade disputes under the World Trade Organization (WTO) after China's accession to the WTO. Firstly I will briefly outline the US-China relations from 1949 to 2001. I will then focus on China's incentives of becoming a part of the multilateral system and the impact of China's accession to the WTO on US-China trade. Second part concentrates on the development of foreign trade between the US and China as well as on the structural problems of Chinese economy that prevents China from doing smooth business with the US. Appreciation of China's currency renminbi, huge trade deficit of the US, complicated access to the Chinese market and many others are all among the problematic areas. Even though China has pledged to fulfill a whole range of commitments, it doesn't always abide by the rules. Some of the cases mentioned often cause friction between China and its trading partners, including the US, which are often brought to the Dispute Settlement (DS) under the WTO. - Jiri Holecek - Roman imports in South Asia Diploma thesis sums up the development of the maritime trade between the Mediterranean, especially Rome, and South Asia, especially India, in the time period between the first century BC and the fourth century CE. Emphasis is put mostly on the archeological proof of the trade in the both directions, such as coins or traded goods, and their relevance and conclusiveness. Furthermore, the works of ancient historians are used to obtain more precise context in the terms of geography and economy. Thesis will compare the development of the maritime trade and the trade using the overland routes, especially so-called Silk Road. In conclussion, the thesis summarizes relevant proofs, and with their help defines the extent of the influence of the Mediterranean in South Asia and compare it with the influence of the overland routes, and finally describes the reasons of this economical development.
Arbitration procedure in international business transactions

The purpose of the diploma thesis is to summarize the most important and basic attributes of arbitration in international business transactions. Further, the thesis assesses the biggest pros and cons of the arbitration. Emphasis is placed on opinions of economical entities as users of the arbitration to settle their mutual disputes. The first chapter aims on definition of three basic terms including the arbitration as the corner stone of the whole topic, then the meaning of international and definition of business relations. The two latter terms distinguish the respective category of arbitration from other categories such as arbitration in consumers or labour relations or arbitration conducted between states and individuals arising from investments. The second chapter enumerates the most important sources of law governing the arbitration. The thesis aims on both material and formal sources. Reasons for creation and historical development of arbitration are shortly outlined as material sources. Comparison of the EU economic relations with India and the PRC from the nineties to the year 2006

Diploma thesis "Comparison of the EU economic relations with India and the PRC from the nineties to the year 2006" is seeks to compare approach of the European Union to the two most populated countries of the World. It observes development of these two relations - their parallel points and differences - by the analysis of documents published by the EU and economic indicators. At the same time it tries to answer the question, why these relations are different, eventually why they are in some areas similar. The author also seeks to find out whether the mutual economic relations have been derived just from the economic level of India and the PRC or whether and how the economic relations with the EU have been influenced by their political organization. This work is concerned with these relations only on a level of the EU and monitored countries and its aim is not to watch policies of individual member states of the EU and their disputes about this topic. The author also seeks to predict possible development in the future from the recognized facts.

The international contract of purchase is a contract governed by private law and the form is not exactly given by any law. It gives a chance to companies to make with the contractual partner their own satisfactory conditions on domestic and international level too. With the option to choose the form of agreement comes advantages, disadvantages and risks for entrepreneurs who can't quite adapt to threats in foreign markets. It is necessary to know contracting partners and also the environment in which they work in international trade. The text of the purchase agreement fundamentally affects the possible resolution of disputes, so the content is important part which should not be underestimated. The aim of this bachelor’s thesis is to evaluate the pros, cons and risks related to sales contracts concluded by the selected companies with foreign entrepreneurs and suggest improvements in connection with international sales contracts, that would be for entrepreneurs the most economically advantageous.

Commercial terms and clauses in business transactions Abstract The master thesis is focused on the topic of commercial (standard) terms and clauses in business transactions. With respect to increased demands on the entrepreneur, the relevant provisions will be interpreted differently in the business relationship than in the case of a consumer relationship. Standard terms standardize the contracting process and reduce costs. Legislation of commercial terms remains concise but it contains some news. Significant change is the express regulation of the knock-out rule, which is used to determine the final content of a contract in the case of conflict between standard terms. Section 1752 newly contains express regulation for unilateral change of standard terms. A major novelty is specific content/formal control of standard terms which is regulated section 1753. Party is protected against the terms with which that party would scarcely have accepted had it been aware of them. Surprising terms are ineffective. The Specifics of Use of Trusts in Business Relations This thesis deals with possibilities brought by trusts (in Czech: svěřenský fond) to business relations. It analyses the key features of a trust, thanks to which it has a unique and often irreplaceable position in number of financial transactions. Selected financial transaction are described in detail and the importance of trusts in these transactions is explained. The main objective of this thesis is to show that trusts have benefits far beyond the governance of personal property and its intergenerational transfers. By this I want to prompt interest in further research of the use of trusts in business relations in the Czech legal environment. After the introduction, the first chapter of this thesis briefly introduces the history of the trust. It is outlined which role the trust played in different legal systems and what were the motives for its development. The second part describes trust as an institute of civil law. There is also described the implementation of the trust into the legal system of the Canadian province Québec, because this regulation served as a model for the Czech lawmakers.
