Determination of parenthood

Determination of Parenthood Determination of parenthood is very actual topic due to the constant changes of the traditional understanding of the family and family relationships. It is primarily the development of modern medical science, biology or genetics that has brought new concepts into the issue of determination of parenthood. For example surrogacy, assisted reproduction or baby boxes. The legislation must responds to these changes in order to stabilized family relationships and to ensure their protection. The aim of this thesis is to describe and to analyze Czech legal regulation of determination of parenthood and to compare it with not only European but also global legislation. The analyse of valid legal regulation highlights questionable passages that may cause difficulties in its interpretation or practical application. The thesis is composed of nine chapters, each of them dealing with different aspects of determination of parenthood. Opening chapter introduces the historical development of relationships between parents and children in Roman and European law. It focuses on legal standards applicable in our country during the period of time from the establishment of the Czechoslovak Republic to the present times. Legal and ethical aspects of the protection of the beginning and end of human life and its dignity

The subject of the following dissertation, as the title states, is to explore legal and ethical aspects of the protection of human life and its dignity. Its aim is not merely to attempt to map the present legal situation regarding the protection of human life in the legal system of the Czech Republic, but also to outline some philosophical and anthropological implications which could have considerable influence on the practical consequences of some legal measures, including general aspects of the protection of human life and the legal regulation of two areas of study chosen by the author, namely assisted reproduction and euthanasia. In this sense the following work does not simply describe the various philosophical- anthropological conceptions in a neutral way, but offers to the reader a possible model which, in the view of the author, best corresponds to the degree of protection that human life and dignity can claim in early and terminal phases, taking a neoscholastic and personalistic view of man and his ontological status, in order to try to deduce from this model ethical implications both in a general sense and in relation to the two above-mentioned areas of application. Surrogacy in the Czech Republic

The Bachelor theses is focused on actual situation of Surrogacy in the Czech Republic. The theoretical part is divided into several chapters. In the first part family is defined with the main function and the fundamental form of family is described. Further the bachelor theses deals with surrogacy, especially forms and types of realization, history of surrogate motherhood and artificial insemination, in which the methods of assisted reproduction are explained. The second part is focused on process and risks of a surrogacy and law in the Czech Republic and abroad. The practical part is divided into two sections. In the first one questionnaires were filled in by public. The second part contains interviews with surrogate mothers who offers surrogacy.

The Bachelor thesis deals with the issues of surrogate motherhood. It focuses on the legislation of the Czech Republic and its development. It also includes legislation in foreign countries. It discusses the ethical issues connected with the issue of surrogate motherhood from the perspective of medicine, psychology, sociology, law and Christianity as well. Mothers for Sale: Advantages and Disadvantages of Paid Surrogacy

The work focuses on the issues of the market solving the human organ shortage. The market solution faces the same criticism as the commercial surrogacy. The main purpose of the work is to evaluate the commercial surrogacy system efficiency. Within the solution of this question, the work focuses first on the analysis of the arguments against a market in human organs and consequently theise objections applies to the surrogate motherhood with emphasis on the problem of adverse selection, which from an economic point of view appears to be the most serious. In the applied part the paper tests the existence of the signs of the adverse selection in the countries where payment for the surrogacy is legal. The paper leads to the conclusions, despite some specifics of the market, this solution is efficient and the market itself creates sufficient mechanisms to prevent adverse selection
The Questions of the Beginning and the End of Human Life

This work deals with the problems of conception, gravidity and abortion in the first part and in the second part than deals with problems of death and dying. It concerns two cut-off points, which are component parts of human life. The first part surveis the biginning of human life and tries to find answers for questions, which have a connection with the conception, artifical insemination, surrogative maternity and abortion. It describes paradoxes, which comes from such situations. It appreciates this paradoxes in the wiev of medicin, ethics, psychology and law. The second part describes the end of the human life in several forms. It broods killing, suicide and euthansia in aspects of the psychology, medicine, law and ethics. In the end it describes the palliative care as an alternativ to euthansia.
Some Ethical Aspects of Assisted Reproduction

This work deals with ethical aspects of surrogacy. The first part is an overview of the issues of infertility, its causes and methods of treatment. To the end of this chapter the definition and the types of surrogacy are given. The following section references to the ethical and the legal issues connected with it. Then follows the part where differently motivated stories of people whose lives have been affected by the replacement of motherhood are listed. The last section is devoted to the results of a questionnaire completed anonymously in order to seek public opinion on surrogacy. Responses obtained through questionnaires reflect the extent to which the public is informed about the replacement of surrogacy and what is the opinion on the possible legalization.
