Inspection of work in the construction industry

The aim of the diploma thesis is to present the institute of work inspection with a focus on Civil Engineering. Another focus is to present health and safety coordinator in relation with the institute of work inspection. I would like to draw from practical experience gained at work so I will visit construction sites with a coordinator and an inspector from the institute and consequently I will try to evaluate these inspections. At the end of the thesis I will focus on risk precautions where I will apply one method with which I will solve a practical example.

This thesis deals with the Labour Inspection in construction industry. First, the basic concepts, legal norms and developlment of the Labour Inspection in the Czech republic are summarized. Then follows description of the Labour Inspection authorities, which are the State Labour Inspectorate and the Regional inspectorates. The area of safety and health protection in the construction industry, concept of Safe enterprise and "Švarc" systém are processed separately. Finally, analysis of the Labour Inspection activities in construction between 2006 - 2011 is performed, with a detailed focus on the year 2011.
The Social and Political Regulation of Labour Migration: The Case of the Czech Republic

This dissertation is about the changes in the regulation of labour migration in the Czech Republic, specifically between the period of economic boom in 2007 and 2008 and the beginning of the global economic and financial crisis. The developments of labour migration processes and policies were studied in relation to the political economy of foreign direct investment and the rise of the competition state in the Czech Republic. The materialisation of these developments resulted in the Czech Republic's further integration into the global labour market. Labour migration policy changes in the case of the Green Card project, however, did not confirm the thesis that the Czech Republic's migration policy eventually became subordinated to the competition state project. Not only did the Ministry of Industry and Trade lack bureaucratic capital in the field of migration regulation but also, there were tensions between different notions of the competition state project while 'migration management' was reorganised in the interest of the Ministry of the Interior. Closely following struggles over the regulation of labour migration in the administrative and political fields, this dissertation contributes to literature on the labour migration perspective of the competition state. Monitoring of employees in the decision-making practice of Labour inspectorates Abstract The theme of the thesis is employee monitoring conducted by employers. The applicable law permits the employee monitoring but imposes restrictions to it. Every employer shall consider thoroughly whether he fulfills the conditions required to implement the employee monitoring or not. The thesis introduces the reader to the legal framework of employee monitoring in the first place. It enlists relevant regulation and defines key terms which are necessary to understand the employee monitoring, such as privacy, surveillance, personal data etc. The key terms are often vague and thus difficult to interpret. The author then examines the provision of Section 316 Subsection 1 of the Labour Code in-depth. The Section prohibits the employees to use the employer's means for their personal needs. It also authorizes the employer to check compliance with the aforementioned prohibition. The relationship between first and second subsection of Section 316 of the Labour Code is also evaluated. The next part of the thesis describes employee monitoring which interferes with employees' privacy and which is regulated by Section 316 Subsection 2 of the Labour Code. Violation of the Employment Act Abstract The purpose and aim of this dissertation work was compactly and coherently to describe the individual types of violations of legal regulations in relation to their consequences for individual entities against whom the negative impacts are directed. The work, based on the current legal regulation of employment, divides the violations of obligations into individual areas, which can be further broken down by entities violating obligations and (by) the seriousness of individual violations. The issue of violation of the Employment Act includes two fundamental areas. The first area, which forms an inherent part of most substantive regulations, is the area of administrative offenses, responding primarily to violations of obligations imposed upon employers. Especially the third, fhe fifth and the sixth chapter focus on this field. The second area of the Employment Act, which is vital for the topic at hand, regulates and sets obligations for individuals, persons interested in the job and especially job seekers who, through the Labour Office, exercise their basic social rights guaranteed by the Charter of Fundamental Rights and Freedoms, i.e. the right to work. Overtime and consequent demands

My diploma thesis deals with the topic of overtime work and demands connected with this issue. The thesis is divided into a theoretical and a practical part. The theoretical part describes basic terminology of working time and its division. Also, records of working hours, required working hours that are closely related with overtime work. Next, this part deals with overtime pay, with its remuneration and defines who cannot perform the overtime work according to law. And last but not least, it deals with problems of labour inspectorate that monitors compliance of overtime work. The partical part focuses on interviews (concerning overtime work) with individual workers and employers of selected companies.The aim of the thesis is to compare attitudes of various companies in the area of overtime work and its comparison and evaluation. I would also like to acquaint a reader with a new proposal to amend the remuneration for overtime work. The end of my thesis includes evaluation of results derived from interviews with workers and employers from particular companies.
