Law aspects of unit linked insurance Abstract United linked insurance is an insurance (hereinafter referred to as ULI), which pays the insurance benefit in the event of survival to a stipulated age or death. The insurance benefit in the event of survival to a stipulated age is directly dependant on investment fund in which insurance premium is being invested. The goal of this thesis is to outline the law aspects of ULI. Thesis is divided into theoretical and practical part. Theoretical part covers law theory of ULI, current law and contract law. First chapter of theoretical part explains ULI as an insurance and its classification. Furthermore, it explains the view of financial science on ULI and describe the existence of insurable interest within an ULI, where there is no guaranteed amount in the event of death. The second chapter describes all aspects of ULI according to the applicable legislation. The first part deals with the insurance benefit in case of death and fee structures that covers it. It also explains the health questionnaire, the development of the risk of death over time, the issue of beneficiary from contract in the event of death. Status of public awareness of the Czech Republic with the new law on consumer credit

This work examines the consumers' awareness of consumer credit. Consumer debt in the Czech Republic grows. Non-bank institutions were developing along with the debt. Unlike banks, these institutions would provide loans to consumers even without researching the client's solvency. The consumer then ended up in a situation where they did not have a way of paying the debt off (the so called debt trap). This is why the state felt the need to regulate non-bank institutions, leading to the creation of a new consumer credit act. It is act number 257/2016 Coll. The work consists of ascertaining the public awareness of the changes to the new consumer credit act. A questionnaire survey was chosen as the method. Two hundred and ten respondents of various age categories participated in the questionnaire. The questionnaire was evaluated using scientific methods: analysis, deduction and synthesis. The aim of the thesis is to determine the state of awareness of the Czech public about changes in the new Consumer Credit Act.

Protection of rights in life insurance Abstract The subject of this rigorous thesis is the protection of rights in life insurance. The main reason for choosing this topic is the fact that completing my master's degree program in law, I have entered the private sphere as a corporate lawyer of an international insurance company and in this position I am active, althought with another international insurance company, still today. In my position, among other things, I represent the insurance company in private disputes with the insured persons, typically on the payment of insurance benefits (claims). I also represent the insurance company during the public hearing efore the Czech NAtional Bank and, last but not least, in my agenda is the representation of the insurance company in the proceedings with the clients efore the Financial Arbiter. Legal Status of the Financial Arbiter in Comparison with Selected Regulatory and Control Institutions in the Czech Republic and EU The topic of my thesis is legal status of the Financial arbiter in the Czech Republic. It represent a specific institution for out-of-court settlement of financial disputes between providers of some financial services and their clients. The Financial arbiter does not substitute the role of courts; instead it operates alongside the judicial system and offers to the clients of financial institutions swift and free of charge alternative to the legal proceedings, which emphasizes reconciliation. In the opening chapter of this thesis I looked into the theoretical concept of this institution and characterized it as an administrative authority sui generis. In order to obtain better understanding of the institutional status of the Financial arbiter, I further compared the Financial arbiter with similar institutions in the Czech Republic and the EU. This thesis deals with the topic of "Legal aspects of the position of financial arbiters in Czech Republic and selected EU countries". At the beginning of this thesis is described the consumer protection policy in European union. There are also mentioned reasons, objectives and instruments of consumer protection in the financial market. The Czech Republic, as a member of European union, implements european consumer protection policy. In the area of consumer protection in the financial market operates primarily these entities: Czech National Bank, Czech Trade Inspection Authority, consumer organisations and professional associations of entrepreneurs in the financial market. Second part of this thesis is dedicated to the possibilities of settlement of consumer disputes. Disputes between entrepreneurs and consumers in the financial market can be solved before the court or out of court. The main topic of the thesis are different methods of Electronic banking fraud and options of Electronic banking security. The history of Electronic banking and current legal regulations including definition of some ambigious terms are described in the first part. In this part there are also described means of remote access to Electronic banking, which also outlines present options of online communication with the bank. Analysis of different methods and practical forms of fraud of different kinds of Electronic banking are described in the next part. The fraud of payment cards and internet banking are those that are mostly specified. Various types of security and fraud prevention including solutions of problems that may arise are outlined in the last part. Responsibility for fraud is portrayed in the very last part of the thesis.
The Financial Arbiter in the Czech Republic

The presented thesis provides us with a brief excursion into the organizational structure of the Office of the Financial Arbiter, mainly deals with the origin and development of this institute. These include the legal definition of its scope, method of establishment and termination of the institute, requirements for the performance of the Financial Arbitrator and his deputy. Broader opportunities in these areas are engaged in the first chapter. The second chapter is the introduction of practical outputs of the decision-making activities of the Financial Arbiter. Most often it is a fee disputes, disputes regarding the validity of the contract or compliance with its provisions, as well as disputes in the area of payments, life insurance and foreign exchange activities. The conclusion evaluates the long-term benefits of the institute of the Financial Arbitrator and outlined its future development.
Comparison of consumer credit with regard to the methodology for calculating the APR

The aim is to describe the topic of consumer credit in the Czech Republic. The theoretical part is especially applicable legislation and the methodology for calculating the APR. In the practical part is an analysis and evaluation of consumer credit products with regadr to the APR by using a custom application.

The diploma thesis deals with the new legal legislation on the field of protection of the bank client as a consumer in the legal system of Czech Republic and evaluation of the level set by regulation. The theses itself provides a complex view on particular areas of the protection of the consumer on the field of commercial banking, which has undergone major amendments during last years, such as consumer loans, payments, insurance claims from deposits and financial arbiter. Particular areas of the protection of the consumer are amended by the results of the researches concentrated on financial literacy of consumers, evaluation of the possible impacts on the consumer and banking institution and moreover there is outlined possible development in the stated area.
Development of function "Financial Arbiter of the Czech Republic"

The subject of this bachelor thesis is development of function "Financial Arbiter of the Czech Republic". In the first chapter I described the function with the intention of its competence and purpose. After that I outlined the development of this function and I continued to outline preliminary planned changes, which should come into existence probably in 2011. In this thesis I focused on international cooperation with similar foreign organization, as well. In conclusion I thought about importance of financial arbiter to consumers.
