Právní aspekty investičního životního pojištění Abstrakt Investiční životní pojištění (dále jen IŽP) je pojištění, kdy je vyplaceno pojistné plnění v případě dožití, nebo smrti. Částka pro případ dožití je přímo závislá na hodnotě individuálního fondu, jehož hodnota se odvíjí od zvolené investiční strategie, nastavení smlouvy a výši pojistného. Cílem této práce je nastínit investiční životní pojištění z hlediska práva. Práce je rozdělena na část teoretickou a praktickou a dále do 6 kapitol. Teoretická část řeší popsání IŽP podle právní teorie, platném právu a smluvní úpravě. První kapitola rozebírá zařazení IŽP do pojištění a jeho třídění. Dále objasňuje pohled finanční vědy na IŽP a rozebírá existenci pojistného zájmu v rámci IŽP, kde není garantovaná částka pro případ smrti. Druhá kapitola popisuje podle platné právní úpravy všechny aspekty IŽP. První je rozebrána pojistná částka pro případ smrti a rizikové pojistné, zdravotní dotazník, vývoj rizika smrti v čase, problematika obmyšlené osoby. V dalším bodě je rozebrána částka pro případ dožití a faktory, které ji ovlivňují jako jsou investiční fondy, podílové jednotky, náklady v rámci IŽP. Také jsou popsány vlastnosti kapitálového pojištění a daňových výhod spojených s IŽP. Ve třetí kapitole jsem rozepsal úpravu zprostředkování pojištění, která plyne ze... Law aspects of unit linked insurance Abstract United linked insurance is an insurance (hereinafter referred to as ULI), which pays the insurance benefit in the event of survival to a stipulated age or death. The insurance benefit in the event of survival to a stipulated age is directly dependant on investment fund in which insurance premium is being invested. The goal of this thesis is to outline the law aspects of ULI. Thesis is divided into theoretical and practical part. Theoretical part covers law theory of ULI, current law and contract law. First chapter of theoretical part explains ULI as an insurance and its classification. Furthermore, it explains the view of financial science on ULI and describe the existence of insurable interest within an ULI, where there is no guaranteed amount in the event of death. The second chapter describes all aspects of ULI according to the applicable legislation. The first part deals with the insurance benefit in case of death and fee structures that covers it. It also explains the health questionnaire, the development of the risk of death over time, the issue of beneficiary from contract in the event of death.
